    2022 Vendor Application and Contract The following application is not a guarantee of acceptance to any of our events. The Vendor contract and full vendor fee are due prior to the booth space being reserved. The undersigned vendor agrees to follow all rules and regulations set forth by the Paisley Pumpkin if accepted. Payment will be returned if not accepted. This agreement is between The Paisley Pumpkin, LLC. and the vendor/exhibitor filing this contract for the 2022 Merry Mustang Market being held at Ponderosa High School.

    Booths will be set up in the hallways of Ponderosa High School.

    There is a basketball tournament going on the same day as the event which will help provide some good customer traffic but it takes away the opportunity for larger booth sizes in the gyms or cafeteria.  Most booths will be 6 X 10. We have room for approximately 1 dozen 10 x 10 booths. Vendors can also purchase 2 side by side booths for a 6 x 20 space.

    We reserve the right to determine the eligibility of any company or product for inclusion in the event.

                You must read and scroll to the bottom of the policies in order to accept.
              • ***The Merry Market booth numbers will be assigned the week of the Event! Look for an email from the Paisley Pumpkin at least 2 days prior to the event. Waiting until the week of helps us avoid inadvertently assigning "like" vendors next to each other. However, last-minute cancellations and/or the addition of last-minute vendors may result in "like" vendors being positioned near one another.

                 

                Check In: Check in and set up begins at 6:30am the morning of the event. Vendor must be set up by 9:00am! *Unloading will be easiest by the side bus loop doors. Vendors can use designated load and unload areas near doors to quickly drop off booth supplies. Vendors will need to park elsewhere and we ask that come prepared with your own helpers if you cannot carry your setup in from the parking lot areas yourself.

                Check Out: Take down cannot begin before 3:00pm. A fee of up to $150 may be assessed on any vendors taking down prior to the end of the event. 

                I agree to adhere to all the policies set forth by The Paisley Pumpkin, Ponderosa High School, and Douglas County. Failure to follow the rules and guidelines may result in forfeit of booth space and booth rental fees. The Paisley Pumpkin and Ponderosa High School are in no way responsible for loss of business in this or any other case.

                This contract is valid for the Merry Mustang Market at Ponderosa High School in Parker, CO being held on December 10th, 2022 from 9:00am to 3:00pm.

                The market may be postponed or cancelled if extreme weather conditions are forecasted. Emails will go out to vendors prior to the event if there are any changes to the event date due to weather, city, county or state mandates that would require us to cancel the event.

              • Vendor Space Agreement

                The Paisley Pumpkin (Lessor) hereby leases to Vendor/Exhibitor space subject to the following terms and conditions. Vendor agrees to pay Lessor the amounts set out in the application for use of vendor space. It is understood that the exhibit space provided to Vendor shall be one of many vendor spaces comprising the event.

                Merchandise Allowed: "The Paisley Pumpkin" is dedicated to providing the consumer with quality merchandise and services. It is not a venue for disposing of unwanted household merchandise. What constitutes inappropriate merchandise will be the sole discretion of The Paisley Pumpkin and Ponderosa High School. We will evaluate the admission of exhibitors with unique merchandise or services that we feel compliment the market. All applicants must provide a detailed description of their business, merchandise, and services they intend to sell or market at the event. If you have questions about whether or not your items will meet our requirements, please e-mail 2 or 3 good quality photos of a representative sample of your items with descriptions to info@thepaisleypumpkin.com.

                Exclusivity: No guarantee of exclusivity is made or implied. However, we will do our best to provide a unique blend of products and services for the betterment of the event.

                Booth boundaries will be monitored. Vendors are not allowed to place merchandise beyond specific boundaries. They are also not allowed to stand far outside of their booth to solicit customers to visit their booth. *Also known as "CatCalling." Cat calling from your booth is also prohibited. Walkways must remain clear and booths must be viewable from the walkways.

                Payment: Acceptable payment methods include credit card, debit card, PayPal. We are no longer accepting cash or check. There will be a 3.5% credit card processing fee. 

                Subleasing, Booth Restrictions: Exhibitors/Vendors are not allowed under any circumstances to sublease their spaces. The vendor signing the contract is expected to attend the event. If an unknown person checks-in on the event date, they will not be allowed to exhibit. Booth rental fees will not be refunded. Contracted booth space is for the contracted Vendor/Exhibitor only. NO MORE THAN ONE BUSINESS PER BOOTH SPACE.

                Refunds and Cancellation: This is a fundraiser for The Ponderosa Pickleball club. Once a vendor is accepted, there will be not be refunds for any reason.

                We do ask that if a vendor is unable to attend the event, vendor shall notify Lessor by phone at 480-678-9599 or email info@thepaisleypumpkin.com or risk being banned from future event dates.

                Vendor Sales & Sales Tax: Vendors are responsible for the sales of their merchandise. Collecting payment, charging and paying the appropriate sales taxes are the responsibility of the vendor. It is strongly recommended that vendors offer a credit card payment option, as many buyers do not carry a lot of cash. Accepting credit cards, checks and other payment options are the responsibility of the vendor.

                Weather: There are no refunds for inclement weather. The Merry Mustang Market will likely be held rain or shine! In the event that the market requires cancellation due to severe weather in the area, the event may be rescheduled. The date is to be set by the Lessor and no refunds will be given. 

                General & Legal: Fire, liability, event cancellation, and theft insurance, if so desired, must be taken out by each vendor at his/her own expense.
                Vendor will indemnify and hold harmless The Merry Mustang Market, The Paisley Pumpkin, Ponderosa High School and their respective agents, employees, and students from any and all claims, demands, suits, asserted by any person, firm, or corporation or other entity, arising out of Vendor’s participation in the above described event and to reimburse The Paisley Pumpkin and the school for all reasonably incurred expenses including legal fees expended in defense of such claims.
                While we will be advertising prior to this event, vendor recognizes that this contract is not contingent upon any advertising, publicity, promotional considerations or weather conditions.
                We make no guarantee of the number of participants or attendees or a guarantee of sales for individual vendors.
                Vendors agree to allow us to take photographs during the event, and give us permission to use photos to promote this event in the future.
                Any and all matters or questions not specifically covered by the preceding rules/ regulations & information shall be subject solely to the decision of The Paisley Pumpkin.  All vehicles entering Ponderosa High School as a vendor or vendor helper must carry vehicle liability insurance. 

                Vendors must take care not to damage school property while at the event. Any damage done to walls, carpet, etc will result in a fine to cover repairs. Ponderosa will assess the damages and determine the appropriate fine. 

                Vendor Check-In: All vendors will be required to check in at the Exhibitor check in station. Vendors may NOT begin setting up until they have checked in at the head table.  Be prepared to transport your items by foot to your booth location. *If you have friends or family helping you, they must also abide by the set up and parking regulations for the Merry Mustang Market. 

                Vendor Check-Out: The Merry Mustang Market will be on hand to help facilitate a smooth take down process of booths starting at 3:00pm. Vendors cannot park in a place that obstructs traffic to load and unload.  "The Paisley Pumpkin" has the right to make changes to the end-of-day procedures as required in order to ensure a safe and orderly process. 

                Trash Removal: Leaving trash and unwanted merchandise of any kind is not allowed. Clean up fees will apply to any vendor leaving trash behind. The trash receptacles located throughout the school are for paper/food/etc., not merchandise, boxes or large items. All unwanted merchandise, empty boxes, and large packing items must be carted up and taken away with you!!! What constitutes excessive trash will be the discretion of The Paisley Pumpkin.

                Inappropriate/Unsafe Behavior: Vendors behaving in an obscene or inappropriate manner as determined by The Paisley Pumpkin, Ponderosa High School or Douglas County will be asked to leave the event immediately and will forfeit booth rental fees. 

              • Terms and Conditions:

                1) All merchandise displays will be subject to Lessor's approval. Lessor reserves the right to cancel a booth reservation prior to the event at its sole discretion if the vendor or his/her products are deemed to be detrimental to or inconsistent with the quality, theme or dignified image of the event. No large flags, signage or banners are allowed outside of your booth space.

                2) Lessor and Ponderosa High School Pickleball club shall organize and promote the event.

                3) Lessor reserves the right to assign all space locations and make space assignment changes prior to the event opening. Booth spots and event times may be slightly altered. Lessors will notify vendors via email about any changes.

                4) Lessor is not responsible or liable for the loss or damage to Exhibitor's property from theft, mysterious disappearance, damage by fire, water, weather, accident or any other cause.

                5) Lessor make no representations or warranties not expressly set forth herein.

                6) Vendor agrees to provide Lessors with a description of the general exhibition content and agrees to only display products, represent services, or display signs that have been approved by Lessors in its sole discretion. Vendor shall not display or sell drug-related paraphernalia or pornography, Positively NO guns, ammunition or explosives are to be brought in, sold or traded. Alcoholic beverages may not be dispensed or consumed on the premises by patrons or vendors. Not following this section shall result in fines.

                7) Vendor agrees to design, construct, and operate their exhibit in accordance with the best interests of the event, good taste, and the standards established by Lessors. Lessors shall have sole discretion to determine whether vendor's exhibit and/or products are in compliance with the requirements of this Agreement.

                8) Vendor agrees to have exhibit set up, complete and clean, by the 9:00am start of the event. Vendors must also keep exhibit clean and open for business during ALL HOURS of the event. Exhibitor also agrees to remove all remaining trash and merchandise from booth space. Failure to do either will result in a monetary fine.

                9) Vendor agrees to keep the exhibit within the boundaries of the space leased and arrange the exhibit in such a way as to avoid interference with other vendor booths. (This included individuals staffing the booths) Failure to comply with this provision will result in additional charges for space used or dismissal from event.

                10) Vendor agrees to duly report all sales made during the exhibition in accordance with the appropriate sales tax regulations. Vendors also agree to comply with all pertinent city, county, state and federal laws, ordinances, fire and safety codes.

                11) Vendor agrees to be responsible for the payment of any damage charges assessed by The Paisley Pumpkin and Ponderosa High School for failure to observe the rules and regulations.

                12) Vendor accepts total responsibility for his/her exhibit and its safety and agrees to conduct his/her activities on the event premises so as not to endanger any person lawfully thereon. Lessor, school, and county shall have no responsibility for damages to the exhibit caused by fire, robbery, accident or any other destructive cause. Vendor also accepts total responsibility for any and all injuries to vendor, his/her family, officers, agents, customers, employees, or other representatives while they are on the event premises and for any injuries to other persons that may occur within the confines of the event, or which are caused in whole or part by vendor's products or exhibit or by vendor, his/her family, officers, agents, employees, or other representatives.

                13) Refunds will not be made for any reason and cancellation or reschedule will be determined by the Lessor.

                14) Vendor agrees to participate in the event registered for. In the event that the vendor is unable to attend the Merry Mustang Market, the vendor shall notify Lessors by email at info@thepaisleypumpkin.com prior to the event or the vendor risks being banned from future events. 

                15) Should Vendor fail to comply in any material respect with the terms of this Agreement, the payments made to the time of breach shall be retained by Lessor as liquidated damages, and Lessor shall have the right to reassign contracted space to another vendor. Such discretions will be based on the best outcome for the event.

                16) Vendor agrees to indemnify, defend and protect Lessor, Douglas County and Ponderosa High School against and hold and save Lessor harmless from any and all claims, demands, suits, liability, damages, loss or costs of whatever kind of nature which might result from any of vendor's merchandise, or from any action or failure to act by Lessor or any of his/her family, officers, agents, volunteers, employees or other representatives, including but not limited to claims of loss or damage, harm or injury to the person or property of vendor or any of his/her family, officers, agents, employees, or other representatives, or of third persons.

                17) It is mutually agreed that no amendments, alterations or variations of this agreement shall be valid unless made in writing and signed by both parties.

                18) Booth Space will be reserved when the application and the contract are accepted by the Lessor. Payment for booth space must be made in full and received by the Lessor prior to the deadline.

                19) Exhibitor agrees that his/her submitted application / contract along with the terms and conditions herein are made part of this Agreement.

                20) Vendor will be charged in the event the exhibitor damages the parking lot, sidewalk, walls, flooring, leaves the booth with trash, unwanted merchandise, or breaks event rules.

                21) Vendor/Exhibitor will abide by set up and take down rules. 

                 

                Upon check-in, exhibitors are required to donate an item valued at $15 or more to the drawing benefiting the Ponderosa Pickleball Club.
