LIABILITY RELEASE FORM
PLEASE READ CAREFULLY
1. PURPOSE OF STAY
My horse will be brought to Patchwork Park for the purpose of BOOTCAMP TRAINING / SALES . The objective is to resolve a behavioural issue, improve education, to advertise for sale or to make tweaks to allow the owner to connect better with their horse.
2. PERMISSION TO HANDLE AND ATTEND
I give permission for persons representing Patchwork Park to handle, work / ride, feed and attend to my horse as part of BOOTCAMP requirement. Patchwork Park will endeavour to perform humane, fair, necessary and realistic training methods to improve my horse’s education or behaviour. I will hold Patchwork Park blameless should my horse return with worsening or unresolved behaviour. I am invited and encouraged to attend training sessions to engage with my horse while on training.
3. SALES TERMS AND CONDITIONS
If my horse has arrived at Patchwork Park for the purpose of sale, I understand that for varying circumstances, my horse may not sell, or be saleable. Every horse goes through a minimum of 2 weeks "probation" whereby Patchwork Park can assess and determine their suitability for sale, identify any issues, quirks, soundness concerns or undesirable behaviours, to best target the market. A horse may be "sacked" from the program within this timeframe if they are deemed as unsound, unsafe or unsuitable for the general market. I understand that I must be realistic about my horse's market value, and be somewhat negotiable to sell, particularly in times where the market is quiet, my horse has quirks or issues that would depreciate its sale price, or if not a lot of interest has been generated after some time. Patchwork Park will endeavour to sell my horse to the best possible home, for a price that meets the current market. The final decision of the new home of the horse is at my discretion, and Patchwork Park simply retains a commission of sale. Funds for my horse will be sent directly to Patchwork Park for holding (until the horse has been collected). Any outstanding bills, commissions or costs owed to Patchwork Park will be deducted from these proceedings, and any remaining funds will be sent to my bank account of choice. I may withdraw my horse from sale at any stage, provided all costs are paid. I may also use Patchwork Park advertisements and materials (that I have already paid for) to sell my horse from home, where no commission costs or further training expenses will accrue.
4. RIDING OF HORSE WHILE ON TRAINING
If I want to ride my horse while it is on training with Patchwork Park, I may trade any number of my allocated sessions (under package) for an instructed ride. This does not incur additional cost. I must not ride my horse without prior arrangement with Patchwork Park while on BOOTCAMP. I must be wearing an Australian Standard Approved riding helmet and riding boots for all mounted sessions and fully enclosed shoes while on the ground. I must be under instruction and supervision while on site to ensure training is not disturbed.
5. PAYMENT FOR SERVICE
I will receive a projected invoice after my paperwork has been received and processed. My spot in the BOOTCAMP queue will not be held until my non refundable deposit (off the balance of the invoice) of $44 has been paid upfront. If I pay my deposit, then later decide to forfeit (before arrival) I am able to defer my position in the training queue until a later stage, or apply this credit to another invoice or horse. After the first week of arrival, I will receive the same invoice again, with any amendments, credits or deposits applied. Further invoices will be sent after each week of training has been conducted, and I have 2 weeks after receiving any invoice to settle the balance. Non payment (and non communication of efforts to do so) will accrue late fees and eventual engagement of debt collectors.
6. AGISTMENT TERMS / RISK OF INJURY
I have inspected my yard / paddock and I am happy with the condition of fences, shelter, water source, etc. My horse will be housed individually unless I have given permission for it to share. If my horse is in a shared paddock, I am aware of and accept the following risks: My horse could get kicked by another horse. Resulting veterinary bills are my responsibility. I could get kicked, bitten, trampled or stepped on by another horse while attempting to handle my own horse. My rugs, paddock boots or other equipment could get damaged by another horse, trees or fencing.
7. FEED AND BASIC HUSBANDRY
If I have not selected Patchwork's hay and hard feed packages, I will be required to source my own feed. If I neglect to keep my feed stocked up for my horse, Patchwork Park will begin to charge the standard day rate ($8.25/day for hay, $5.50/day for hard feed). I will be required to pay this before any other training commences. My horse will not be left without feed at any stage.
8. RISK OF DAMAGE
I acknowledge that there is always a chance of DEATH OR SERIOUS INJURY when working with horses. I understand that horses are living creatures that can act unpredictably, making them at times dangerous or damaging. I accept all responsibility for this risk. I agree to act sensibly, refraining from interacting with other horses aside from my own (unless granted permission by the owner, even during an emergency where management must be notified) while visiting my horse. I will not allow inexperienced persons (accompanying me or others) to be hurt or harmed by my own horse. This includes acting irresponsibly by allowing inexperienced persons to ride or handle unsuitable horses, etc. I acknowledge that there is a risk of INJURY OR DEATH to my horse while on agistment or training, as horses are at times unpredictable or self-destructive. Patchwork Park will endeavour to keep my horse safe, however should unpreventable damages occur, resulting in the death or serious injury to my horse, I relinquish all rights to prosecution to Patchwork Park. I will act in a way to avoid damages to any assets or equipment on site. Should deliberate damages occur, I understand that there may be additional costs incurred to replace or repair items affected.
9. SAFE PROXIMITY BETWEEN HORSES
I MUST KEEP MY HORSE AWAY from other horses (that are not in my shared paddock, if applicable) at all times. This is to prevent the spread of diseases and also prevent risk of injury to myself or any horse through biting, striking or kicking. A safe distance between horses will be created at all times. I will not allow my horse to sniff other horses over fences. I will not walk my horse within biting or kicking distance of another horse. I have been notified that Patchwork Park is home to many stallions and colts that may become aggressive if safe distances are not maintained.
10. HANDLING OF OTHER HORSES / WANDERING
I will not handle any horse other than my own without approval from the owner. I will not enter paddocks, stables or yards with horses other than my own (or my shared paddock), even if the horse is in trouble. If a horse requires assistance I will notify Patchwork Park Staff immediately. I WILL NOT WANDER / EXPLORE THIS FACILITY for any purpose other than tending to or visiting my horse. This is a private facility and Patchwork Park has a duty of care for agisted horses. I will not enter sheds or private residences unless given permission to do so.
11. SOBRIETY OF ALCOHOL, SMOKING OR ILLICIT DRUGS
I will not arrive on the facility UNLESS I am completely sober of alcohol and free from any drugs that may hinder my ability to make sensible decisions or remain safe. Patchwork Park premise is a SMOKE FREE ZONE. I will not smoke for the duration of my visit.
12. HORSE VICES / UNDESIRABLE BEHAVIOURS
I have been honest in declaring any vices to Patchwork Park that may cause damage to equipment. Such vices include excessive fence walking, weaving, windsucking, cribbing, etc. If my horse causes accelerated damage to property due to this, I may be required to fund repairs. I have been honest in declaring any challenging behavioural issues my horse has that may place staff at risk when tending to basic agreed husbandry requirements (i.e., biting, kicking, striking, running off halfway through rugging, headshy, etc.) Patchwork Park may send my horse home if it is deemed as dangerous, dishonest or unsafe to ride or handle. I will receive my entitled refunds as per Section 4 should this occur.
13. IN THE EVENT OF AN EMERGENCY
If my horse sustains a non-life threatening injury while on premise, Management will attempt to contact me before a vet is called. If I cannot be contacted, Patchwork Park will wait for my response prior to a vet being called. Immediate First Aid (hosing of injury, bandaging etc.) may be applied on my behalf if necessary and I consent to this. If my horse sustains a life threatening injury / illness, Patchwork Park will call a vet ASAP and then attempts will be made to contact me immediately afterwards. Patchwork Park will pick a vet based on distance and availability. Any veterinary expenses incurred are at my cost.
14. FIRE PLAN / NATURAL DISASTER PLAN
In the event of fire / flood, Management will make assessments to best protect the property and the horses, including my own horse. Management may choose to move my horse into a heavily populated paddock if necessary to improve survival outcomes. I may elect to remove my horse from the facility if natural disaster threatens my horse. If evacuation is necessary, I give Patchwork Park permission to send my horse on transport to any location away from danger. Resulting costs to do this are my responsibility. In the event of natural disaster, my horse takes priority over any of my other equipment / possessions, i.e. rugs, saddles etc. and any losses to this equipment are not the responsibility of Patchwork Park.
15. MY BEHAVIOUR
I will interact civilly and courteously towards other riders, staff members and management while on site. I will treat any horse on the property with dignity, empathy and respect, and understand that any form of animal cruelty is strictly forbidden. I may be asked to leave the property and/or further action taken if I am warned that my behaviour is unacceptable and I ignore the warning.
16. DOGS
I will not bring dogs onto the property without prior arrangement. Dogs with prior arrangement must be well behaved and safely restrained on a leash at all times.
17. CHILDREN
I will supervise my child / children at all times. I will not allow my child to handle, feed or enter any paddock, yard or stable of a horse on premise, unless it is with my own horse (Individual Paddocking only). I will not allow my child to wander the facility. If my horse is in a shared paddock I will not allow my young child (under 13) to enter the paddock. If my child wants to handle my horse I will remove it from the shared paddock first.
18. USE OF CAMERAS
I am permitted to use video and photography devices for the purpose of recording my own horse only. I am not permitted to take photos and videos of horses belonging to others, or training sessions of other riders without their consent. I may publish footage online of photos obtained on premise for the purpose of encouragement, improvement or positive remarks only. Footage is not to be obtained for the purpose of defamation.
19. GENERAL MAINTENANCE
Patchwork Park is not responsible for financing any general or exotic husbandry pertaining to my horse (i.e., farrier, worming, teeth etc.) Patchwork Park has a regular farrier, vet, chiropractor, saddle fitter and dentist available for use (cost to be covered by me), however I may elect to use my own professional of choice.
20. STALLIONS
I am permitted to bring a stallion onto the property for the purpose of BOOTCAMP / SALES, provided the following points are adhered to. My stallion is well behaved and able to be controlled by Patchwork Park staff. I provide Patchwork Park with clear EA Approved green stallion discs on either side of the animal (headstall) for use any time the horse is removed from its paddock. Handlers under 18 are experienced with stallions and are supervised by an adult at all times. I must be diligent with maintaining safe distances with other horses. Handlers of mares have right of way. I may provide a stallion chain or rearing bit, but not compulsory if my animal is well tempered and under control.
BY SIGNING THIS FORM, YOU ACKNOWLEDGE AND ACCEPT THE TERMS AND CONDITIONS OF THIS CONTRACT, AND HAVE CAREFULLY READ THE ABOVE CONDITIONS OF CONTRACT.
AS SOON AS THIS FORM IS PROCESSED, YOU WILL RECEIVE AN INVOICE FOR YOUR FIRST WEEK OF BOOTCAMP. A DEPOSIT OF $44 MUST BE PAID (OFF THE BALANCE OF YOUR INVOICE) TO SECURE YOUR SPOT IN THE TRAINING QUEUE.
