Annual Maintenance Agreement
Preventative Maintenance: Southeastern Elevator will perform a preventative maintenance examination on an annual basis per this agreement. The examination will include inspection, lubrication, adjustment and cleaning of parts and components in accordance with the manufacturer's recommendations. All cleaners and lubricants will be provided as needed. Recommendations for replacement parts and/or for components out of compliance with code will be provided to the owner. Examinations are to be performed during normal business hours of Monday through Friday, 8:00am to 5:00pm, excluding holidays.
Service: Service during normal business hours will be charged at our current standard rate. Service after normal business hours and weekends are limited to emergency or required handicapped access situations only. After hours rates are based on service area. Southeastern Elevator will endeavor to give prompt and efficient service, and priority to AMA customers; however, timing is subject to delays from weather and workload. For after normal hours service, call (252) 726-0075 and leave a message on the voice message system. Technicians on staff may be able to assist you in solving problems over the phone.
Repairs, Parts and Materials: The costs of repairs, parts and materials are not included in this agreement. The details of necessary repairs will be conveyed to the owner for approval before repair begins. Once approved, the repairs will be made as promptly as possible. Standard pricing, labor rates and appropriate sales tax will apply. A 10% discount on parts and materials is standard with this service agreement.
Clarifications/Liability: This agreement is applicable for Southeastern Elevator's CL950 brand of residential elevators. Southeastern Elevator may terminate this agreement any time with written/verbal notice if an elevator does not meet ASME A17 Code or in safe operating condition. Southeastern Elevator shall not be liable for any loss, damage or delay due to any cause beyond our reasonable control including, but not limited to; acts of government, labor disputes, fire, explosion, theft, vandalism, misuse, abuse, or acts of God. Under no circumstances shall we be liable for any indirect, special or consequential damage of any kind including, but not limited to;fines or penalties, loss or profits, loss of rents, loss of good will, loss of business opportunity, additional financing costs, or lossor use or any equipment or property, whether in contract, tort, including negligence, warranty or otherwise. We will not be responsible for any injuries or damages to any persons or property.
Agreement Period: The term of this contract will be one (1) year beginning on the date the agreement is signed. A renewal contract will be mailed 30 days prior to expiration.
Payment: Payment is due with the signed contract. Services will not begin until full payment is remitted. Invoices for parts and repairs are due upon receipt of invoice.
Annual Contract Price: $350.00
