Carrier agrees to tracking on each load and to routinely provide Broker, if and as requested via means acceptable to Broker, timely status updates regarding progress and location of
shipments tendered by Broker to Carrier and dispatched by Carrier. Updates will include, but are not limited to, confirmation of pick-up, route transit status, confirmation of delivery, and any time Carrier becomes aware that it will not meet agreed upon pick-up or delivery schedules. Such communications shall be made in a form acceptable to Broker including phone, fax or other means of electronic communication.
Driver must verify all product information listed on the Bill of Lading (BOL). This product information includes, but is not limited to: order number, case count/pallet count, commodity, temperature settings, customer address, dock number, and scheduled delivery times.
Driver should observe the loading procedure. If Driver is not allowed on the dock, he/she must notify MCS Logistics A.S.A.P. any damages of issues driver to notify loading supervisor & M.C.S Logistics
Carrier agrees they may be subject to the following accessorial penalties subject to the below conditions: Failure to send Signed POD within 24 hours $25 Deduction, Reefers - Failure to send Temperature recording tape with POD: $25 Deduction
If accepting Reefer freight, Carrier to have temperature checked PRIOR to loading to ensure that temp is at where it should be. Reefer maintains temp so temp of the product loading should already be temp given by shipper, Carrier must verify.
Equipment shall at all times be clean, dry, odor free, pest free and insect free and Carrier shall comply at all times with all applicable laws and regulations pertaining to transportation of food and food-related products.
DRIVER MUST AGREE TO TRACKING!! There will be a $100 or more deduction in pay if we cant track the driver & update our Customer.
Insurance Recap:
FOR DRIVER ASSIST LOADS: THERE SHOULD BE NO CUSTOMER PRODUCTS WITHOUT A PAID RECEIPT IN THE TRACTOR! If there is any theft of customer product that Carrier is unloading we will be filing a claim with insurance, a freightguard report, company will be removed from working with us & a fee will be assessed.
Without limiting Carrier’s duty to comply with applicable law, each vehicle used by Carrier to provide transportation must be equipped with a
functional Electronic Logging Device (“ELD”) compliant with the applicable FMCSA ELD rules at all times, medical card for each driver, paper logs & fire extinguisher.
Carrier shall procure and maintain in full force continuously throughout the term of this Agreement for the protection of both Carrier and Broker, the
following types of insurance;
Broad Form Comprehensive Commercial General Liability Insurance coverage from an insurance company with a Best’s rating of “A” or greater
that covers Carrier’s business and operations, including contractual liability, in amounts of not less than:
Bodily Injury
$1,000,000 per occurrence
$1,000,000 annual aggregates
Property Damage
$1,000,000 per occurrence
$1,000,000 annual aggregates
$50,000 Trailer interchange (if PO load)
Workers Compensation as required by statute & Employers Liability Insurance with limits not less than $500k per occurrence
Comprehensive Automobile Liability Insurance from and Insurance company with a Best’s rating of “A” must be maintained by Carrier in an amount
of not less than $1,000,000 coverage as to all claims alleging bodily injury or property damage liability, or such greater amount as required by
Applicable Law.
