The Atlanta Chapter of Jack and Jill of America, Inc. (hereinafter referred to as "JJATL") reserves the right to market you/your items before/during/after to include social media and photos (we reserve the right to use a photo taken at our event including your picture to advertise our next event). LIABILITY: In-Kind Donors shall comply with all laws, ordinances, rules and regulations of any lawful authority, agency or government entity which apply to the use of its display space, equipment or an equipment they may be operating, including without limitation, any state or local applicable fire and building code and/or health regulations applicable to the locality in which the event is taking place. The In-Kind Donor shall be solely responsible for any and all injuries to persons or damages to property or any other injury, claim, damage or loss of whatever nature, arising from or related to In-Kind Donor's services at the Event. In-kind Donor shall indemnify, save and hold harmless JJATL, its agents and volunteers from and against all liability, loss, damages, claims, costs and expenses (including reasonable attorney’s fees) arising out of injury to any person (including death) or damage to property or any other injury, claim, damage, loss, cost or expense arising from the Event performed by In-Kind Donor including, but not limited to, any negligence, act or omission of In-kind Donor. The In-kind Donor agrees to accept responsibility for all materials, equipment, and goods furnished by or operated by him/her, and used or displayed in the booth and/or service area and accepts full responsibility for his/her personal property and any property or equipment they may be operating. JJATL shall not be liable for any loss or damage to the property of In-kind Donor or any of its representatives, employees, agents, patrons and guests, because of fire, robbery, accidents, or any other cause whatsoever that may arise from In-kind Donor’s use, operation or occupancy of its allocated space during the Event. The In-kind Donor agrees to indemnify and hold harmless JJATL and its representatives, and agents against any and all claims of any person whomsoever, from acts or omissions of the in-kind donor, its representatives, employees, agents, patrons, or guests.
