Bradford Fitness
You acknowledge that you be engaging in certain Activity at Bradford Fitness. Because the Activity can be strenuous and subject you to serious injury or death, Bradford Fitness urges you to obtain a physical examination, including a concussion evaluation, from a doctor before beginning aby exercise or training program. Further, you will be engaging in the Activity in a confined space close to others which carries with it certain risks of exposure to disease and to injury caused by the negligent acts of others. You agree that you are voluntarily participating in the Activity and assume all risks of injury or damage to you or your property from whatever cause including but not limited to the malfunction of equipment or facilities, the negligent acts or omissions of others, and the spread of disease.
By signing this liability waiver and release you release and discharge Bradford Fitness, its employees and owners, your personal trainer, instructor, and physical therapist (collectively the "Bradford Fitness Parties") from any and all claims or causes of action for bodily injury, death, disability, paralysis, concussions, property damage or theft, or other loss of any kind caused by or arising from the Activity.
For purpose of this release from liability reference to "Activity" includes but not limited to: (a) your use of all amenities and equipment in the Bradford Fitness facility and any off site location and your participation in any activity, class. program, personal training, or instruction; and (b) instruction. training, supervision, or dietary recommendations provided by Bradford Fitness Parties.
You understand that you are not required to participate in the Activity, and if you choose to participate in the Activity, that there are many other opportunities avaliable for you to participate in the same or similar activities elsewhere.
If any part of this liability waiver and release is determined to be unenforceable for any reason or under any circumstance, it is intended that all other terms will be enforced in all other circumstances. You acknowledge that you have carefully read this waiver and release and fully understand that by signing you agree to voluntarily give up any right that you may otherwise have to bring legal action against Bradford Fitness Parties for negligence, or any other personal injury or property damage or loss action.
Bradford Fitness Performance
I hereby acknowledge and agree that participation in lessons, clinics, camps; and participation in all activities conducted within the Bradford Fitness facilities as well as off-site activities sponsored by Bradford Fitness, LLC have inherent risks.
In Consideration of the services provided by Bradford Fitness, LLC, their agents, officers, participants, consultants, employees, and all persons or entities acting in any capacity on their behalf (hereinafter referred to as "Bradford Fitness") I now agree and certify as follows;
1. I acknowlesge and fully understand that I, the participant (if participant is 18 years of age or older) or parent/legal guardian of the listed minor participant, will be engaging in activities that may involve risk of serious injury which might result not olny from my own actions, inactions, or negligence, but from the actions, inactions, or negligence of others or the conditions of the premises or of any equipment used. Further, that there may be other risks not known or not reasonably foreseeable at this time. The risks may include, but are not limited to: nature of the activity, latent or apparent defects of conditions in equipment or property supplied by the :Bradford FItness" or other entity; acts of the other participants in this activity, employees, volunteers or agents of the "Bradford FItnes"; my own physical caondition, acts or omissions; conditions of the "Bradford Fitness" surrounding grounds or terrain and accidents connected with their use; first aid emergency treatment or other services.
2. Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. WHile particular rules and personal disipline may reduce this risk, the risk of serious illness and death does exist; and;
3. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, and assume full responsibility for my participation; and, I expressly agree and promise to accept and assume all the risls existing in this activity. My participation in this activity is purely voluntary and I elect, in spite of the risks, to participate. I assume all the foregoing risks and accept personal responsibility for the damages following such injury.
4. On behalf of myself, my children, my parents, my heirs, assigns, personal representatives I hereby voluntarily release, waive forever discharge. and agree to indemnify and hold harmless "Bradford Fitness", and each of their respective commissioners, directors, agents, sponsors, and other employees, its parent, subsidiaries, affiliates, employees, distributors, and agents, other facility participans, and, if applicable, operator or lessors of premises used to conduct the event/activity, from any and all liability for any and all claims, demands of causes of action which are in any way connected wth my participation in this activity or my use of the "Bradford Fitness' equipment or facilities.
5. I hereby certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating in these activities or alternatively I agree to bear the cost of such injury or damage myself. I further certify that I have no medical or physical conditions,, which could interfere with my safety in this activity, or else I am willing to assume and bear the cost of all risks that may be created, directly or indirectly, by any such condition.
6. I hereby certify that I have read and am familiar with the "Bradford Fitness" Rules and Regulations and will comply with conditions set forth therein.
7. I acknowledge and certify that I am at least 18 years old, or the parent or legal guardian of the participant under 18. I hereby provide the "Bradford Fitness" permission to administer basic First Aid and I authorize its agents or employees to contact 911 or other emergency personnel as needed.
By signing this document, I acknowledge that if anyone is hurt, or property is damage during paricipation in this activity a cournt of law may find me to have waived my right to maintain a lawsuit against the "Bradford Fitness", and any of the other parties associated with the "Bradford Fitness", on the basis of any claim from which I have released them herein.
Photography / Videography
Events may be videotaped and/or photographed for use in the future marketing materials. By signing below, you acknowledge that you understand the likely event of professional or amateur photography and videotaping of the event in which you or your child participates, and agree to hold Bradford Fitness or any of its subsidiaries, affiliates and contracted partners harmless from any claims that would arise out of any internet, email or any other public display or dissemination of pictures and videos in which you or your child is displayed, portrayed or pictured. You further acknowledge and understand that you have no ownership rights to such photos/video/marketing material.
Use of Likeness
Participants and his/her parents or guardian hereby authorize "Bradford Fitness" and its assigns to use any and all photographs, pictures, videos or other likenesses of participants in its promotional materials or social media platforms.
I HAVE HAD SUFFICIENT OPPORTUNITY TO READ THE ENTIRE DOCUMENT. I HAVE READ AND UNDERSTOOD IT, AND I AGREE TO BE BOUND BY ITS TERMS.
