1. Management
The Owner appoints Pure Rental Limited to act as an Agent in the management of the property on our behalf, and as such do authorise the Agent to:
(a) Manage any existing tenancies advertise and arrange new tenancies as necessity arises, including:
a. signing Tenancy Agreements which accord with the Residential Tenancies Act 1986 on the Owners behalf for such term as the Agent considers appropriate not exceeding any termination date specified in writing by the Owner at any time.
(b) Act as the Owner’s agent, under the terms of the Residential Tenancies Act 1986.
(c) After the Agent inspects the property; to approve the refund to the tenant on our account of all or part of
this bond as the Agent, using best judgment decide if such an action is fair and reasonable.
(d) Collect rents on the Owners behalf and to make payments to the Owner as directed in the Schedule or otherwise as directed in writing by the Owner from time to time.
(e) To file applications and to attend Mediation and Hearings at the Tenancy Tribunal on the Agent’s behalf and wherever possible to act on any Orders issued.
(f) To if necessary, appoint a debt collection agency to pursue any outstanding amounts from tenants.
(g) To send us statements as soon as possible after the Agent’s balance date at the end of the month.
(h) Collect a bond to be paid to the Tenancy Services Centre of the Department of Building and Housing on the Owners behalf, and when the tenancy is terminated and after inspection of the Property by the Agent, to approve the refund to the tenant on the Owners account of all or part of such bond as the Agent in its discretion decides is fair and reasonable, in
accordance with the provisions of the Residential Tenancies Act 1986.
(i) Arrange such repairs and maintenance to the Property that may in the Agent’s discretion from time to time be reasonably required to maintain the Property in good and tenantable repair, order and condition and to pay for such repairs and maintenance on the Owners account.
(j) Deduct its property changes and reimbursements for moneys expended on the Owner’s account from rents and other moneys held on the Owners behalf.
(k) To let the property when required and to prepare and sign Tenancy Agreements on the Agent’s behalf.
(l) To set new rent levels from time to time so that the property remains reasonably tenanted and reasonably reflects the current market level of rents for such properties.
2. Repairs
The Owner authorises the Agent to spend up to one the week’s rent on any one repair without reference to the Owner/s; except where the failure to complete the repairs might endanger the tenants or occupant’s health and safety or the Tenancy Tribunal makes a Work Order and there is limited time to comply with the Order, all other repairs must have my prior approval.
3. Fees
(a) The Owner agrees to pay the Agent 8% on all rent
monies collected.
(b) The Owner agrees to pay the Agent $55 per routine
inspection.
(c) The Owner agrees to pay the Agent $150 per Ingoing/Outgoing inspection.
(d) The Owner agrees to pay the Agent $65 per credit check.
(e) The Owner agrees to pay the Agent $50 for the end of financial year statement per property.
(f) The Owner agrees to pay the Agent Tribunal attendance and Preparation Fee of $375
(g) The Owner agrees to pay the Agent Tenancy Mediation Lodgement Fee $20.44 (including GST)
(h) Letting Fee- The Owner agrees to pay the Agent the Letting Fee of one Week.
(I) The Owner agrees to pay the Agent any advertising costs.
(j) GST is payable on top of all fees and charges payable by the Owner to Agent, without exception.
(k) The owner agrees to pay all fees with 14 days of receipt of an invoice, or the Agent is authorised to deduct them from rent monies until paid in full.
4. Resource and Building Consents
(a) The Owner warrants that the property has all relevant building and resource consents and complies with all
council requirements as to building, health and safety and fencing of swimming pool and spa pool.
(b) The Owner is not aware of any pending or existing the Weather-tight issues effecting the building.
(c) The Owner’s to the best of our knowledge advise that the property has not been used for the production, manufacture or use of any illicit substances.
5. Tenancy Agreement
The Owner acknowledges that our name/s will be declared on the Tenancy Agreement and further acknowledge that if the property is in the name of a Trust or a Company, Pure Rental Ltd will be required to issue on our behalf 90 days’ notice instead of 42 if the Owner or any member of our family require the property for our own use.
6. No Liability for Damage/Arrears of Rent
Pure Rental Ltd shall use its best endeavors to ensure continuity of occupation at market rentals and maintenance of the property, but shall not be liable to the Owner(s) for any defaults in payment of rent or any damage caused to property by any tenant or other payment due by the tenant or otherwise, whether or not the tenancy has been arranged by Pure Rental Ltd.
7. Privacy Consent
I agree to information relating to the property being passed to any person for marketing purposes and for the compilation and distribution of statistics.
8. Term of Authority and Cancellation
(a) This Authority commences immediately upon execution by the parties for a minimum twelve (12)-month period. Thereafter the Authority may be cancelled by either party giving one month’s notice provided that no such notice may be served with twelve (12) months from commencement of the
Authority, should neither party serve notice to terminate the agreement it willautomatically renew for a further 12 month period.
(b) The Owners acknowledge and agree that if a dispute between the owner and the agent shall arise which affects or concerns the safety of the tenancy premises, and such dispute cannot be resolved to the satisfaction of the agent then the agent at the agent’s sole discretion shall have the right to terminate this Authority with immediate effect, upon service of cancellation.
(c) The Owners acknowledge that should early termination from the agreement prior to the initial twelve (12) month period ending, Pure Rental withhold the right to claim any remaining commission, fees and disbursements from us for the remaining minimum management term.
(d) Notice of cancellation of this Authority must be served in writing to the email or contact address provided in this Authority.
9. Chimney
The Owners authorise the Agent to have the chimney cleaned annually to comply with Health & Safety and Insurance policy requirement.
10. Heat Pump
The Owners authorise the Agent to have the heat pump serviced and cleaned annually to comply with Health & Safety and Insurance policy requirement.
11. Subject: Indemnity Clause
(a) The Owner acknowledges, that the Owner indemnifies the agent against all actions, claims, costs and expenses whatsoever, which may be taken or made against the agent or incurred by the agent, in the course of and arising out of the proper performance of the agent’s duties as the property manager or the exercise of any the Owners duties, or authorities contained in this management authority.
(b) The Owner acknowledges that with this appointment of Pure Rental Ltd, under the terms of the Residential Tenancies Act, shall be deemed to be the landlord.
(c) The Owner agrees that by signing this Authority warrant that The Owner is the owner/s of the rental premises or is authorised to enter this Authority and have the authority to make this appointment.
11. Body Corporate
The Owner agrees to advise the property manager of any Body Corporate Rules that may apply and to provide copy of same rules.
12. Healthy Homes Statement of Intent
The Owner/s agrees that the Property Manager can include the following Statement of Intent in Tenancy agreements and Tenancy Renewals and further agrees to adhere to the Healthy Home Requirements and have the Property compliant by the regulated completion dates, should the property not meet the requirements the Owner accepts that all liability remains the sole responsibility of the Owner and not Pure Rental Limited.“Declaration by Landlord(s) in respect of S.13A (1CA) Residential Tenancies Act 1986
declare:
a. That on or after the commencement of the tenancy, I/We will comply with the healthy homes standards as required by S.45(1)(bb)or 66 I (1)(bb) and
b. including any information which may be prescribed by regulations made under S.138B(5) and(ICB) If there is a written variation or renewal of the tenancy agreement in accordance with S.13B (1), then I / We the
landlord(s), further declare:
a. That on or after the time when the variation or renewal takes effect, I/We will comply with the healthy homes standards as required by S.45(1)(bb) or S.66 I (1)(66) (as the case may be);and
b. and including any information which may be prescribed by regulations made under S.138B(5).
