  • Enterprise Development Agreement

    (Beneficiary Enterprise)

     

    1.       The Measured Entity will run a legal education project for the purpose of advancing and supporting the financial, operational and/or developmental sustainability of the Beneficiary, in accordance with Enterprise Development element as outlined in the Broad-Based Black Economic Empowerment Codes of Good Practice.

     

    2.       Notwithstanding the date of signature hereof, this agreement commences on 28 September 2022.

     

    3.       The Beneficiary Enterprise hereby confirms and undertakes to uphold the following:

     

    3.1   That the Enterprise has and will uphold more than 51% black ownership, based on the flow-through principle, and qualifies as an Enterprise Development Beneficiary as defined in the Codes.

     

    3.2   The Measured Entity does not hold majority, calculated in terms of the normal flow-through principle, of the Beneficiary Enterprise’s equity.

     

    3.3   The Beneficiary Enterprise is in possession of a sworn affidavit that is valid at the date of entering into this agreement.

     

    4.       The Beneficiary Enterprise is under no trading restrictions as regards customers or suppliers and is free to develop its business by way of expanding its customer base and locations.
