Rules and Regulations 1.) You have purchased an area measuring 12’ X 12’. Your display and sale of items is restricted within that 12’ X 12’ space. 2.) Pekin Marigold Festival’s Art in the Park sponsored by Vonderheide Floor Coverings is intended to be a true art & craft show. Vendors agree that all items they are selling are handcrafted originals. The committee may conduct checks of booths and products during the Festival. 3.) Any products purchased for resale must be altered in some way. For example; you may purchase and sell a placemat if you have made an alteration to it in some way, but you cannot sell just the placemat by itself since you have not altered it. You can sell beads if you have arranged them in a unique design, but you cannot sell individual beads by themselves that you have purchased for resale. 4.) Buy/sell items are NOT allowed. Buy/sell is defined as an item purchased and then offered for resale without any alteration. 5.) No electricity is available to Art in the Park vendors. Gas powered generators are not allowed. Only battery powered (UL approved) generators are allowed. 7.) The Marigold Festival has a “Pet Free Zone”. This zone includes all of Art In the Park, Community Spotlight, Festive Foods, Carnival and applies to vendors also. 8.) Vendors asking to be assigned to the same booth spot each year will find layout varies from year to year. The same booth number may not be in the exact same place as last year. The committee will try to place you as close as possible to the spot you have requested, but cannot guarantee you will be in the exact same spot. 9.) Booth fees are non-refundable after August 1, 2023. 10.) The committee reserves the right to add additional rules and regulations to protect the well-being and benefit of festival participants. INDEMNIFICATION: The Applicant agrees to hold harmless and indemnify the Marigold Festival Committee, the Pekin Area Chamber of Commerce, their individual members, officers or agents from any and all claims arising out of the Applicants participation. In the event the Committee must retain legal counsel by reason of default or breach of any terms or conditions of this Agreement by the Applicant, the Applicant agrees to pay all such attorneys’ fees and any and all associated costs or expenses incurred by the Committee in connection therewith. MISCELLANEOUS: Should these Rules be interpreted as contradicting any state or local laws or ordinances, it is agreed that such law shall supersede these Rules. Should any provision herein be held unconstitutional or otherwise invalid, it is agreed that all other provisions shall remain in full force and effect.
