  • SEBERT LANDSCAPING INDEPENDENT CONTRACTOR AGREEMENT FOR SNOW REMOVAL

  • THIS INDEPENDENT CONTRACTOR AGREEMENT FOR SNOW REMOVAL (hereinafter referred to as "this Agreement") dated as of {date93} by and between Sebert Landscaping Company, an Illinois corporation, ("Sebert") and ("Independent Contractor" Sebert and Independent Contractor are individually. a ("Party" and together. the ("Parties"

    In consideration of the mutual representations, warranties, covenants and agreements herein contained. the Parties agree as follows:

    1. Sebert has entered into a contract with one or more property owners and or one or more general contractors on an individual contract basis for contracts to provide snow removal and or salting services the snow removal work.

    2. Sebert agrees to contract the Independent Contractor from time to time to provide labor, materials, equipment and/or vehicles in connection with the snow removal work. consistent with this agreement and the contract. and Independent Contractor agrees to be retained by Sebert from time to time to provide labor, equipment and/or vehicles in connection with the Snow Removal Work, consistent with this Agreement and the Contracts.

    3. Independent Contractor shall provide the snow removal work to the Owners and/or General Contractors specified by Sebert. Independent Contractor, and its own business judgment, shall decide whether it wishes to accept or reject Snow Removal Work offered by Sebert.

    4. Independent Contractor and Sebert shall negotiate an hourly rate to be paid to Independent Contractor if Independent Contractor accepts the contracted for work. Independent Contractor shall provide Sebert with a timesheet indicating the number of hours worked. The timesheet shall be provided to Sebert within 24 hours of completing the snow removal work from the most recent snowfall. Independent Contractor shall be paid two weeks from the Friday following the most recent snowfall. Independent Contractor understands that s/he is responsible for the payment of all taxes, including income taxes.

    5. Independent Contractor shall take all reasonable safety precautions when performing the snow removal work, including following all applicable laws.

    6. Independent Contractor is an Independent Contractor under this Agreement, and this Agreement does not constitute and is not intended to establish Independent Contractor as an employee. agent. joint venture or representative of Sebert or any customer or affiliate of Sebert. Independent Contractor shall determine and its sole discretion, the manner and method of providing the snow provided. however, such Snow Removal Work shall be provided in a "first class" workmanlike manner and on a timely basis.

    7. Independent Contractor does not guarantee personal services to Sebert and Independent Contractor shall solely determine whether Independent Contractor or Independent Contractor's employees, agents or independent contractors will perform the services for Sebert under this Agreement. Independent Contractor shall bid on jobs, turn down work and set its own schedule. Independent Contractor shall not be reimbursed for business expenses. Independent Contractor will not be controlled, directed, supervised, or trained by Sebert.

    8. While performing work as an independent contractor for Sebert Snow removal services Independent contractor will have the Modeco Job tracking Application downloaded to their telephone with location services turned on as Contractor enters and leaves the site. The application will be used to track which tasks and jobs are being performed on various sites as requested by Sebert. Sebert will not use any tracking information for any purpose other than to track work done on requested sites.

    This Agreement, including all terms and conditions hereof, is expressly agreed to and constitutes the entire agreement of the state. No other agreement or understanding, oral or written, expressed or implied, are part of this Agreement unless specified herein.

    2.am not subject to backup withholding because: (a) am exempt from backup withholding. or (b) have not been notified by the Internal Revenue Service (IRS) that am subject to backup withholding as a result of a failure to report all interest or dividends, or (c) the IRS has notified me that am no longer subject to backup withholding: and
    3. am a U.S. citizen or other U.S. person (defined below): and
    4. The FATCA code(s) entered on this form of any) indicating that am exempt from FATCA reporting is correct.

    PURPOSE OF FORM:
    An individual or entity (Form W-9 requester) who is required to file an
    information return with the IRS must obtain your correct taxpayer identification number (TIN) which may be your social security number (SSN individual taxpayer identification number (ITIN adoption taxpayer identification number (ATIN or employer identification number (EIN to report on an information return the amount paid to you, or other amount reportable on an information return.   • Snow Independent Contractor - Verification and Check process

    Checks will be ready for pick-up every two weeks from the Friday following the week of snow fall (unless you are communicated a different day by the snow coordinator Please see your snow coordinator for scheduled pick-up times, dates and location. Checks are that are not picked up within the scheduled pick up times must be picked up at the Bartlett location during the regular operating hours.

    Every contractor must bring a government-issued picture ID every time they are picking up a check. Checks will not be released without the government-issued picture ID and checks will not be released to anyone except for the contractor named on the check.

    There is a $30.00 stop payment fee on any check that needs to be re-issued.

    Accounting will notify of any changes to our policy, or you can call the office at (630) 497-1000 with any questions.
