MY DETAILS

I declair and agree to the following;

Personal Guarantee

a) I, the Director of the above Company, unconditionally guarantee the performance of the Company with regards to the supply of genuine goods and/or repayments of its debts to K&J Supplies Pty Ltd, Director, being Deepesh Dhanjee of K&J Supplies Pty Ltd Australia, ACN: 609719057, ABN: 11422629643. This is pursuant to the agreements made between us or our members of staff in email, writing or via WhatsApp communication, further pursuant to the agreements and arrangements specified on invoices, between the companies and via all other communications.

b) If my Company fails to provide stock as agreed upon in The Terms specified in K&J Supplie's 'Terms and Condition's' or as outlined in invoices, invoice terms or/and other communication or fails to make any payment to K&J Supplies or if my company fails to perform any of its obligations, I will make all payments to K&J Supplies or return the money to K&J Supplies where K&J Supplies has purchased goods with pre-payment and the goods have not been supplied or not been supplied as specified on the invoice, as if I were the principal of the Agreement.

c) Disputes arising out of or in connection with this agreement or any PI or Invoice or the goods or if my account is outstanding for 30 days past the invoice due date and not otherwise formally extended in writing, either party may refer the matter to the international chamber of commerce in accordance with the ICC arbitration rules. The seat of arbitration shall be Melbourne Australia. The applicable law shall be the laws of the state of Victoria Australia and the Federal Laws of Australia where applicable. The number of arbitrators shall be 1. The arbitration shall be conducted in English and both parties agree that this arbitration clause is binding on the parties in accordance with the New York convention on the recognition and enforcement of foreign arbitial awards 1958 and the parties acknowledge and agree that they wave their rites to forum non conveniens.

STATEMENT - K&J Supplies reserves the right to conduct reference checks on your company. K&J Supplies adheres to strick privacy and confidentiality obligations. These checks are to establish the credibility, creditworthyness and financial strength of your company only. K&J Supplies will check that you are the said person K&J is dealing with and that you do belong to the organisation you attest to be part of and that the organisation itself is in good standing. 

DECLARATION- I am the authorised person to sign on behalf of my company and hereby apply to open an account with K&J Supplies Pty Ltd. I declare that the above information and that the uploaded documents are true, correct, and complete and is given to induce K&J Supplies to extend credit. I authorise K&J Supplies to make such credit investigation as the Company sees fit, including contacting trade references and obtaining credit reports. I am aware that K&J Supplies uses credit insurers to verify and monitor my creditworthiness.

Deepesh Dhanjee Director of K&J Supplies agrees to the terms in this contaract.
