TERMS AND CONDITIONS
• It is understood that Christine Snow is the exclusive official photographer retained to perform the photographic services requested on this Contract.
• Upon signature, Photographer shall reserve the time and date agreed upon. Unless Photographer is able to fully replace the cancelled reservation, all sitting fees and retainers are nonrefundable, even if the portrait is canceled for any reason other than inclement weather.
• If, in the opinion of Photographer, inclement weather or other adverse conditions prevent the creation of a portrait meeting the artistic standards of Photographer, may elect to use an alternate location or to reschedule the portrait. No part of any order, will be delivered until the balance is paid in full.
• The Client signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend the Photographer in the event of litigation arising out of such use. Digital files and previews remain the exclusive property of Photographer.
• If Photographer cannot perform this Contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then Photographer shall return any deposit or sitting fee to the Client but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, or otherwise lost or damaged without fault on the part of Photographer. In the event that Photographer fails to perform for any other reason, Photographer shall not be liable for any amount in excess of all monies paid.
• Client will not hold Photographer or the owner of the property liable for any injury that may occur during the session.
• Original photographs are not included, only edits. Photographer retains the right to edit the photographs and omit any image. It is understood that Photographer will not deliver every exposure taken. Client agrees to abide by Photographer’s editing decisions.
• The charges in this Contract are based on Photographer’s Standard Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.
• Client is responsible for making a backup of all photos from the digital download. Photographer will make every attempt to keep archival copies of photos, but does not guarantee that they will be retained indefinitely.
• The images that are being provided to you are licensed to you for any reason personal, including but not limited to: printing, copying, emailing, and web publishing. Your license does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, or resale of any nature. Bearer agrees that he/she may not use any of Photographer’s images for commercial or editorial purposes, or enter any of Photographer’s images into competition without the express written permission of Photographer. You hereby grant to Sunshine Photography by Christine Snow the right to use and publish images and photographs taken at your photography session to further promote its service, including portfolio, web site, display, advertisement, and editorial use, unless otherwise discussed beforehand. Photographer agress to limit the use of these images and photographs to promotional use only. Client waives any right to inspect or approve the photograph(s), finished version(s) incorporating the photograph(s), or the use to which it may be applied, including written copy that may be created and appear in connection therewith. Sunshine Photography by Christine Snow retains all copyrights to the images and derivative works per USC Title 17 (US Copyright Law).
