Release Agreement
Womb & Fertility Massage Therapy & Empowered Feminine Trainings
As a Participant in the above Womb & Fertility Massage Therapy (WFMT) or Empowered Feminine (EF) Training, developed by Clare Spink, N.D - Organizer, I understand and agree:
Respect
- that I am receiving training techniques to treat clients in Women’s Health and/or Fertility. I will apply these techniques with respect for my clients and for the practice of WFMT/EF.
Trademark
- that Womb & Fertility Massage Therapy & Empowered Feminine are trademarks of the Organizer, with primary use belonging to the Organizer and the materials presented are proprietary materials and may not be reproduced or redistributed without prior written permission. When referring to Womb & Fertility Massage or Empowered Feminine in brochures, web sites, presentations or other places that may be relevant, I will acknowledge the work as developed by Clare Spink.
Content
- that by taking this course I am not authorized to teach WFMT or EF; only to host self-care workshops or teach clients in their own self-care. I will not use the practical techniques or written materials to instruct third parties in any way other than above, without further written permission from the Organizer.
Insurance
a) Qualified Therapists
- that I am an appropriately qualified professional, authorised to conduct the massage taught in this Training, with suitable liability insurance to participate in the training and to practice WFMT/EF with clients. I am solely responsible to understand and remain within the boundaries of my own professional training, license, and scope of practice while applying WFMT/EF, and will seek all necessary permission and, if needed, extended training.
b) Non-Qualified Therapists
- that I am solely responsible for ensuring that I complete the additional modules to comply with the requirements of a Governing Body and Insurance Company, as I am participating in the WMFT/EF course without prior massage qualification.
Certification
- that until I have completed the required Case Studies and Theory Exam and been issued with a certificate from WMFT/EF, I must not advertise or promote myself on social media, website or any written material as a qualified WMFT/EF Practitioner or charge clients for treatments. Case studies can be charged at an agreed rate, providing clients are aware they are receiving student level, case study treatments.
Refresher
- to attend a Refresher day once every three years to maintain high standards, update skills, remain listed on the WMFT/EF Therapist Finder and participate in the Facebook support group.
Competency
- that I will complete a Practical Assessment on the final day of the course.
- that if I do not meet the quality requirements as assessed by the WMFT/EF Tutor, I will be provided with guidance to meet the WMFT/EF standards and may be required to attend further paid mentor sessions or resit the course at half price. *this occurrence is extremely rare
By signing below, I hereby release, and agree to hold harmless Clare Spink, and its respective members, the owners and operators of the premises on which the Training is conducted, (each considered one of the Released Partiesherein) from all liability, claims, demands, losses, or damages caused or alleged to have been caused in whole or in part by any act or omission of the Released Parties in connection with the Training and my practice of WFMT/EF or other techniques discussed in the training, and further agree that if, despite this release, I or anyone on my behalf makes a claim against any of the Released Parties named above, I agree to defend, indemnify, and hold harmless each of the Released Parties from any damages, claims, litigation expenses.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND AND AGREE TO ITS TERMS, AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
