By registering for VILLAGE OF ST. JOSEPH, ILLINOIS SEWER UTILITY EMAIL BILLING PROGRAM (the "PROGRAM"), you have opted-in to the program. As a registered participant, you will have the ability to receive certain email messages from the Village of St. Joseph containing information about your Sewer Utility Service and Account. To participate in the programs email messaging service, your phone, mobile device, or computer must be enabled for email messaging.
PLEASE CAREFULLY REVIEW THE FOLLOWING ADDITIONAL TERMS:
You agree to provide true, accurate, and complete information about yourself during the program registration process, and to update this information promptly when it changes. If you provide any information that is untrue or inaccurate, not current, or incomplete, or if we suspect your information is untrue or inaccurate, not current, or incomplete, we may, in our sole discretion, suspend or terminate such program registration and/or access or refuse current or future access. 2. Opting-out or asking questions: You have the ability to opt-out of (discontinue your participation in) the program at any time. You also have the ability to opt back in, subject to the conditions of the program.
The Village of St. Joseph reserves the right, in its sole discretion, to cancel or suspend any or all the program, in whole or in part, for any reason, with or without notice to you. If you wish to cancel your participation in the program, you must deliver to the Village a written notice expressly conveying your intention to discontinue your participation in the program. Your response will be processed during the billing cycle 30 days after your written notice is requested. Notice via emailis acceptable. These Terms and conditions contain the entire agreement between you and the Village of St. Joseph regarding the use of the program. IF any part of these terms and conditions is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of these terms and conditions, and the remaining positions shall remain in full force and effect.
3. No Guarantee: TheVillage of St. Joseph is not responsible for incomplete, lost, late, or misdirect messages, including (but not limited to) undelivered messages resulting from any form of filtering by your mobile carrier or service provider or otherwise. 4. Disclaimer of Warranties and Limitation on Liability: You expressly understand and agree that your participation in the program is at your sole risk. The program is provided on an "AS IS" and "AS AVAILABLE" basis. The Village of St. Joseph, and its officers, agents, and employees expressly disclaim all liability for and make no warranty that (a) the program will meet your requirements; (b) the program will be uninterrupted, timely, secure, or error-free; or (c) the results that may be obtained for the use of the program will be accurate or reliable. You expressly understand and agree that the Village of St. Joseph, and its officers, agents, and employees shall not be liable to you for any direct, indirect, incidental, special ,consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, even if the Village has been advised of the possibility of such damages, resulting from the use or the inability to use the program, unauthorized access to or alterations to transmissions or data, incorrect data contained in any email, statements or conduct of any third party regarding the program, or any other matter relating to the program.
