It must be recognised that watersports are by their nature unpredictable, and therefore naturally involve an element of risk. By taking part in the course, you agree and acknowledge that:
(i) You are aware of the inherent element of risk involved in the sport and you accept responsibility exposing yourself to such inherent risk whilst taking part in ACF activity;
(ii) You will comply at all times with the instruction of the relevent ACF co-ordinators and particularly with regard to handling of boats, wearing of personal floatation devices, wearing of suitable clothing for the conditions;
(iii) You accept responsibility for any injury, damage or loss to the extent caused by your own negligence;
(iv) You will not participate in the course whilst impaired by alcohol, drugs or whilst otherwise unfit to participate;
(v) The provision of safety boat cover is limited to such assistance as can be practically provided in the circumstances;
(vi) You are aware of any specific risks drawn to your attention by the ACF Co-ordinators on the day.
COVID-19
(i) You recognise that due to the nature of the sport it may not always be possible to maintain 2 metre social distancing, and if this is the case other appropriate controls will be used;
(ii) You will not attend the course if you are displaying symptoms of COVID-19 or are required to self-isolate.
MISCONDUCT
You understand that the ACF co-ordinator may exclude anyone from a particular session and evict anyone from the premises who refuses to comply with these Registration Terms or who misconducts themselves in any way or who causes damage or annoyance to other persons.
DATA PROTECTION
The information given by you on this form will be used by us to process your registration and for attending to you whilst you are at the course. The legal basis for processing this information shall be contract, or anticipation of a contract. Your information may be shared with third parties such as course venue or independent skippers / coaches / key safety individuals to facilitate your participation. Your information will be used and stored in accordance with the ACF privacy policy, available at https://acfsailing.org/privacy-policy/
PHOTOGRAPHY
We may take photographs and video footage of the course for use by us in connection with the promotion of us and our activities. If you object to the use of these images, please e-mail info@acfsailing.org.uk
CANCELLATION
Every attempt will be made to ensure the events run. However, the ACF organisers reserves the right to cancel the event at any time where it believes that cancellation is necessary due to unsuitable conditions or insufficient numbers.
Cancellation by the applicant: If you decide that you no longer want to attend the activity, the following provisions will apply;
Less than 8 weeks and more than 4 weeks notice:
· If the activity can be re-filled a 10% admin charge will be taken from your payment and the rest refunded.
· If the activity cannot be re-filled the ACF will retain 25% of the total activity contribution, the rest will be refunded. Refunds will be processed after re-filling the place or the start of the activity, whichever comes first.
Less than 4 weeks notice:
· If the activity can be re-filled a 10% admin charge will be taken from your payment and the rest refunded. Refunds will be processed after re-filled the place or the start of the activity, whichever comes first.
· If the activity cannot be refilled the ACF will retain 100% of the activity contribution, no refund will be available.
Cancellation by ACF: The full activity contribution, including any deposit will be returned. The ACF will not be liable under any circumstances for any cost or loss incurred as a result of its failure to conduct a particular activity. ACF reserves the right to cancel any course in the event of bad weather, insufficient number of delegates, equipment failure or otherwise.
