• Notice of Maricopa County, AZ Acting in Maladministration and Trespassing on the Rights of the People


    Notice to Agent is Notice to Principal and Notice to Principal is Notice to Agent

     
    I, one of the People of the 50 Republican States (as seen in Article II Section 2 of the Arizona Constitution) Sui Juris, am serving you with this Notice to that you and your agents may provide immediate due care;

    Please take Notice that We the People are the creators of all governments in our Nation, both federal and state. We the People have all political power and authority over ALL servants, agents and trustees of the People, and it is our right to reform, alter, or completely abolish any government at the mere danger of maladministration. We do not need to wait for an election to take the necessary steps to deal with any servants that violate their oath of office or act in any manner that harms, hinders, impairs or trespasses on the rights of the free People. Whenever any magistrate violates their oath to the People, we have the power and the right to remove them and their processes, without any interference and in whatever manner we agree and find expedient. (See evidence below)

    Arizona Constitution Article II Section 2: Political Power; Purpose of Government
    “All political power is inherent in the people, and governments derive their just powers from the consent of the governed, and are established to protect and maintain individual rights.”

    Virginia Constitution Article 1 Section 3:
    “That government is or ought to be, instituted for the common benefit, protection, and security of the people, nation, or community; of all the various modes and forms of government , that is best which is capable of producing the greatest degree of happiness and safety , and is most effectually secured against the danger of maladministration; and whenever any government shall be found inadequate or contrary to these purposes, a majority of the community has an indubitable, inalienable, and indefeasible right to reform, alter, or abolish it, in such manor as shall be judged most conductive to the public weal.”

    Maxim of Law: 51o: All political power in inherent in the people by decree of God, thus none can exist except it be derived from them. American Maxim

    Maxim of Law: 11h. The derivative power cannot be greater than the original from which it is derived. Noy, Max; Wing . Max 66; Finch, Law, b. 1, c. 3.

    Maxim of Law: 11s. One lawfully commanding must be obeyed. Jenk, Cent. 120.

    Maladministration: Bad management of public affairs; vicious or defective conduct in administration, or the performance of official duties, particularly of executive and ministerial duties, prescribed by law; as the maladministration of a king, or of any chief magistrate. Noah Webster’s 1828 American Dictionary of the English Language

    Please take Notice that your contract is with the People and those duties to which you are strictly bound are expressed in your trust indenture the Arizona Constitution. Please show where, as government officials employed in the County of Maricopa, Arizona, you were delegated any powers or privileges that allow you to act in any manner that harms, hinders, impairs or infringes on the guaranteed rights of the People. (See evidence below)

    Maxim of Law: 24k. The contract makes the law. Black’s, 2d. 704; Bouv. 135; Allen v. Merch. Bank of N.Y., 22 Wend. (N.Y.) 215, 233.

    Maxim of Law: 43a. Those things which cannot be given, or which are not in existence, are held as not expressed. Dig. 50, 17, 135.

    Maxim of Law: 11f. Power can never be delegated which the authority said to delegate never possessed itself. N.J. Steam Co. v. Merch Bank, 6 How. (47 U.S.) 344, 407.

    Please take Notice that the public servants and government officials of Maricopa County, Arizona are acting in maladministration and violating their oath of office. Are you aware that We the People can immediately remove, fire and terminate you from your public position when you are in maladministration and/or violate your oath of office. These actions are a violation of your contract with the People and are a criminal act of trespass against the rights of the free People. Do you understand that the People can hold you personally liable for any criminal actions or trespasses that you commit while acting in an official capacity and handling the affairs of the People? Please provide the constitutional provisions that grant you the authority to disregard the form of law and unlawfully conduct, delay and mismanage the People’s elections or your actions are a direct violation of your contract with the People and are a trespass against the guaranteed rights of the People with full knowledge, intent and malice. (See evidence below)

    Arizona Constitution Article II Section 7: Oaths and Affirmations
    “The mode of administering an oath, or affirmation, shall be such as shall be most consistent with and binding upon the conscience of the person to whom such oath, or affirmation, may be administered.” 

    Pennsylvania Constitution 1776 Chapter II Section 22
    “Every officer of state, whether judicial or executive, shall be liable to be impeached by the general assembly, either when in office, or after his resignation, or removal for mal-administration: All impeachments shall be before the president or vice president and council, who shall hear and determine the same.”

    Maxim of Law: 4f. Faith must be observed. An agent must not violate the confidence reposed in him. Story, Ag. s. 192

    Maxim of Law: 84c. Punishment is due if the words of an oath be false. Black's, 840.

    Please take Notice that only the person receiving the highest number of legal votes shall be elected. Where did the People grant you, as trustees and servants of Maricopa County, the authority to act in a manner that harms, hinders, impairs, delays or trespasses on the right of the People to conduct lawful and valid elections? Where the law prescribes a form the nonobservance of it is fatal to the proceeding, and the whole becomes a nullity. Are you only counting the highest number of legal votes in the 2022 General Election or are you invalidating the entire proceeding by allowing illegal and unlawful methods of voting? (See evidence below)

    Arizona Constitution Article 7 Section 7:
    Highest Number of Votes Received as Determinative of Person Elected
    “In all elections held by the people in this state, the person, or persons, receiving the highest number of legal votes shall be declared elected.”

    Maxim of Law: 46d. Where the law prescribes a form, the nonobservance of it is fatal to the proceeding, and the whole becomes a nullity. Best, Ev. Introd. s. 59

    Maxim of Law: 46c. Where form is not observed, a nullity of the act is inferred or follows. 12 Coke, 7.

    Maxim of Law: 46b. Legal form is essential form. 10 Coke, 100.

    Please take Notice that the MCTEC is a public building and is NOT a private facility. Are you aware that you have NO authority as the Sheriff of Maricopa County, to barricade, block off and close access or restrict ANY public facilities from We the People? Your contract is with the People and at no time have you been delegated powers or privileges to infringe upon and trespass on the inherent rights of the free People. Please show where in the Arizona Constitution that we granted you the authority to trespass and trample on the rights of the People of Arizona and act in repeated maladministration. (See evidence below)

    Maxim of Law: 96h. One is a servant who is employed by a master to perform service in his affairs and whose physical conduct in performance of the service is controlled by the master. Evans v. Board of Ed. of Hays, 284 P. 2d 1068, 1071.

    Please take final Notice that it is my wish, order, and demand, that all Trustees, Servants, Agents, and BAR members are to immediately stop blocking and interfering in the People’s Inherent rights, including the right of all People to have legal, lawful elections where only legal votes are counted. Any man or woman who decides to suppress this Notice agrees to pay $500,000 per infraction, and any disputes by any public officials or private actors who are bound by contract to the Arizona Constitution agrees to have these matters heard before an arbitrator of my choice and bound thereby. If you believe any of the above claims are untrue or that you have authority to override the People’s power as a Public Servant, Private Actor, or Corporation and infringe on the People’s rights, please show where you were granted these Constitutional Authorities. All responses must be submitted by affidavit, sworn under penalty of perjury, within 5 days of receiving this Notice or you agree by acquiescence, all statements in this Notice to be true and fact. Furthermore, you agree that you are acting with full intent, knowledge, and malice by trespassing on the rights of the People, and no court shall be able to rehear this matter, but it shall stand as evidence, truth and law in all courts of record. Please send your affidavit via certified mail to the sender of this notice and post publicly on your government website including any social media or other public platforms.

     
    This Notice is sent to you in peace and with the love of Christ, so that you may provide due care to those who have all political power, the People.
