  • Third-Party Sale Consent & Intervenor Request Form

    Use this form is you are a purchaser looking to transfer ownership of a NORA auction property before construction is complete. NORA must first consent to the transfer prior to completing a third party sale.
  • REQUIRED DOCUMENTS FOR THIS FORM:

     

    Before submitting the request, please ensure all required documents listed below are collected and ready for upload. It is preferred that the title company handling the sale completes the form and uploads all documents together:

     

    • Construction timeline – A detailed month-by-month outline of the construction schedule through completion, including specific dates. 
    • Construction plans – Documentation confirming what will be built. If construction plans are not available, a signed contract from the builder will be accepted.
    • Proof of funding – Documentation demonstrating sufficient funds to complete construction. This may include a construction loan, a bank statement showing the buyer’s name with substantial available funds, a line of credit, or a combination of these items.

    Please note, submission of these items does not constitute approval of the consent request.

    The current owner will be required to remit a penalty for failing to meet the original obligation.

    A consent will be required and drafted by NORA to insert into the Act of Cash Sale, if approved. This document takes up 10 business days to process once all information is submitted accurately.

  • Construction should be complete within 180 days (or 6 months) from third party sale closing. 

    CONSTRUCTION TIMELINE - This timeline should outline the build of the home month by month until completion, including specific dates.

    CONSTRUCTION PLANS - These plans should confirm what is being built. If construction plans are not available, a signed contract with a building contractor will suffice.

    PROOF OF FUNDING - Documentation showing substantial funds to build. Acceptable Forms include

    • Current Bank Statement
    • Recent Pre-Approval Letter from Lender

  • NOTICE OF SIGNATURES & DOCUMENT RETURN POLICY

    If your third-party sale request is approved, NORA will provide the requestor with an unsigned consent form that must be executed with the sale. Prior to recording the sale, NORA requires the following be returned to us for execution and approval:

    1. Original signed consent (Please do not edit or reformat our consent)
    2. Copy of the Act of Cash Sale

    Once NORA receives all of the documents, NORA will route the consent internally.  Once it's been signed by the Executive Director, NORA will notify the requestor. The requestor will need to pick-up the executed consent from NORA's office. Requestor must record both the executed consent and the Act of Cash Sale.

    NULL AND VOID POLICY: If the consent is not recorded with the sale within 30 days of NORA's signature, the third-party sale and consent will be considered null and void. Please note that the document and NORA’s consent are only good for 30 days from NORA's signature date.

    The requestor is REQUIRED to share the recorded third-party Act of Sale including the executed consent via REPLY ALL to the email exchange specific to the request.

    PENALTY FEE POLICY: The original owner will be required to pay NORA a penalty fee for not meeting the original obligation. The fee is based on the original transaction and associated details.
