RELEASE OF LIABILITY * By checking this box and the box above, you agree to waive the liability of all volunteers, employees, managers, trainers, and related persons and facilities related to Mimosa Hills Farm, LLC except in the case of gross negligence. You understand that horses and other farm animals are inherently risky and injury or death could result from the fact that horses can sometimes be unpredictable, even if well trained and properly managed and all precautions are taken to try to ensure ones safety. Some inherit risks include but are not limited to falling off a horse, getting stepped on, kicked, pinned, bitten, slipping saddles, horses falling, and other direct and indirect actions of the equine. This includes all activities related to summer camps, lessons, trail rides, birthday parties, horse shows, clinics, farm tours, training, recreational riding, and any other event held on or off of the farm.

Partial On-site Lease - This is a shared lease, either with the owner, farm, or another individual. If the horse is shared with the farm it can still be used in lessons or for events. If the lease is shared with another individual then both people have equal access to the horse. It is both parties responsibility to communicate to the other about riding times and work out the best schedule. Partial leases only apply to the individual(s) who are leasing and cannot be extended to other family members or friends. The owner/farm is financially responsible for any and all upkeep of the horse (farrier/vet). Tack is provided.Full On-site Lease - A full lease allows the rider full access to the horse at any time and can be shared with appropriate direct family members. Routine vet and farrier expenses are the owners responsibility if leased month-to-month. For longer full leases the routine expenses fall on the person leasing.Full Off-site Lease - Horses leased and kept off-site must remain in a professional program unless they are leased specifically for trail riding purposes. The horse may only be transported by the owner, person leasing, or professional shipping company. The person leasing must carry full liability and mortality insurance or accept risk of loss value which is to be paid in full within 90 days in the event of complete loss of use or death of the horse. The person leasing is financially responsible for normal upkeep such as proper feed, farrier and veterinary care.
Duration of Lease*

Month-to-month - to maintain this lease a monthly lease fee must be paid at the beginning of each term. Either party can terminate the lease at anytime. If the horse being leased is also for sale, it can be sold at the end of each billing cycle (30 days). The person leasing will be given first right of refusal to buy the horse at the same price as the other potential buyer which will be valid through the end of the billing cycle. If the horse is sold mid lease or before the end of the month, the person leasing can continue their lease to the end of their billing cycle or opt to transfer their lease to a different horse. If the person leasing decides to buy the horse, money that was paid toward the lease will not apply to the purchase price.6 month lease - a lease fee must be paid in full at the beginning of each billing cycle (6 months). If the horse being leased is also for sale, the horse can be sold at the end of each billing cycle. The person leasing will be given first right of refusal at the same price as the other accepted offer. If the person leasing decides to buy the horse, 25% of the current lease term will be applied to the purchase price.12 month lease - a yearly lease fee must be paid at the beginning of each billing cycle (12 months). If the horse being leased is also for sale, the horse can only be sold at the end of the leasing period and the person leasing will be given first right of refusal to purchase the horse at the same accepted offer. If the person leasing decides to buy the horse, 50% of their current lease term can be applied to the purchase price.

Farm Rules

- All animals must be treated with respect

- All riders and drivers must wear a helmet when mounted or accept full liability of injury or death regardless of circumstances

- All riders must wear appropriate riding attire and boots

- Do not throw away food in trash cans

- Feed room, hay storage and shavings are off limits. Staff only

- Do not administer any medication, dewormer, or supplement without notifying owner

- Always use properly fitted halter AND lead rope when leading horses. No halter without lead ropes, no lead ropes without halter. Throat latch must be clipped. If the halter doesn't fit, get another one.

- only tie in designated areas

- Take care of and respect shared tack and equipment. You are responsible for replacing tack if it gets broken while you use it.

- no halters should be left on horses in stalls or turned out unless they are well fitted, leather or breakaway

- minors must be accompanied by an adult

- All riders and guests who come into contact with the horses must have a release form on file.

- 5mph speed limit on driveways. Please watch out for children and animals when driving

- clean up after your horse in all tacking and washing areas

- well marked trails on the farm can be used any time. Do not ride on neighboring trails without Crosby. Golf course, cow farm, and riding on the roads is not allowed without Crosby present.

- do not make changes to bridles or exchange bits without permission

- Personal tack and equipment can be stored in the "mailbox" room

- The main tack room in the old barn is private access and is off limits for guests

- feel free to use the refrigerator in the carriage house but do not take other people's drinks or snacks that are in there except water and Iceys

- The farm is not responsible for stolen or damaged tack. Any personal tack that is left behind and unclaimed for 1 year is property of the farm

- NO SMOKING ANYWHERE ON THE FARM

- well behaved, non destructive and non aggressive dogs are allowed as long as they do not cause any distress to other animals or people while at the Farm. Dog owners are responsible for damages to property or livestock while visiting

- bullying or disrespect of any kind toward others or animals will not be tolerated and will be refused service. Refunds will not be given if dismissed because of poor actions.

Other Terms

-There are no refunds given for leases for any reason. Lack of time, weather conditions, injury, etc are not grounds for full or partial refunds or extension of time.

-Gaps of payment are not grounds for extension of time. Failure to pay for a new term will be assumed late payment or lack of payment unless the leasee specifically informs the owner before the term ends that the lease is being terminated at the end of the lease term. (Example: Horse x is being lease for 30 days starting January 1. The leasee does not pay for the next term until February 15 but has not informed the owner of their intention to terminate the lease at the end of the 30 days. This does not extend the lease 30 days to March 15.

-Failure to pay or renew or termination of the lease for any reason forfeits any credits toward purchasing a horse for long term leases.
Outstanding Accounts

- Any fee is considered late and will incur a $25 late fee after 15 days. After 30 days a 15% interest will be applied to the overall balance.

- Returned or canceled checks will inquire a $40 penalty and must be repaid within 10 days. After 10 days a 15% interest rate will be applied

- in the event of non-payment, overdue payment beyond 60 days, or failure to repay returned checks and late or other penalties, Mimosa Hills Farm reserves the right to seek legal counsel to obtain fees. The person in debt will also be responsible for legal fees.
