Waiver of Claims and Liability Flux MMA/KS Jiu Jitsu

All students must sign this waiver of CLAIMS AND LIABILITY as well as the WAIVER/RELEASE FOR COMMUNICABLE DISEASES INCLUDING COVID-19. By signing this walver of claims and liability the student, parent or guardian acknowledges that they have read this agreement and will abide by all rules. Signing this waiver also means that the undersigned/student releases Flux MMA/KS Jiu Jitsu, Kyle Short, and its instructors from any liability in case of injury or death from the instruction at Flux MMA/KS Jiu Jitsu or during any form of training associated with Flux MMA/KS Jiu Jitsu, Kyle Short, or its instructors.

DO YOU HAVE ANY MEDICAL CONDITIONS THAT WOULD AFFECT YOUR ABILITY TO TRAIN?

In consideration of being allowed to attend this Brazilian Jiu litsu/Jiu-Jitsu/Grappling/Self-Defense/ Kids Class/KickBoxing, Sparring, Fitness, the undersigned/student acknowledges that this Brazilian Jiu litsu/Jiu-Jitsu/Grappling/Self-Defense/Kids Class/KickBoxing, Sparring. fitness are physical activities and that participation may result in serious injury including death. and or other damage, due not only to the undersigned/students actions, inaction or negligence, but also to that of others associated with and or present at these or other classes. Furthermore, I acknowledge that there may be risks not known to me and or not reasonably foreseeable at this time.I personally, totally and completely assume all risks involved or in any way related to my participation in this BrazilianJiu Jitsu/Jiu-Jitsu/Grappling/ Self-Defense/Kids Class/KickBoxing, Sparring, Fitness whether known or unknown to me at the present time. Participation in this Brazilian Jiu Jitsu/Jiu-Jitsu/Grappling/Self-Defense/Kids Class/KickBoxing, Sparring, Fitness is voluntary and entirely of my own free will. I hereby represent and certify that I am in good physical condition, and have no diseases, injuries or other physical or mental conditions that would impair my ability to participate in the Brazilian Jiu litsu/Jiu-Jitsu/Grappling/Self-Defense/Kids Class/KickBoxing, Sparring. Fitness. The undersigned/ student, heirs, executors and successors hereby waive claim of accidental and or negligent damages or injury against Flux MMA/KS Jiu Jitsu. Kyle Short, its instructors and any physical location where a Flux MMA/KS Jiu Jitsu class is taught. The undersigned/student also certifies that they are/will be covered by a medical insurance plan and will assume responsibility for all bills/costs associated with injuries sustained while attending or participating in a Flux MMA/KS Jiu Jitsu class or seminar.

ASSUMPTION OF RISK / WAIVER OF CLAIMS & LIABILITY / INDEMNIFICATION AGREEMENT

In consideration of being allowed to participate on behalf of Flux MMA/KS Jiu Jitsu athletic program and related events and activities, the undersigned acknowledges, appreciates, and agrees that:

1.Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA. influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and, 2.IKNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and, 3.I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. If, however, I observe and any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and, 4. I. for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Flux MMA/KS Jiu Jitsu their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event ("RELEASEES"), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property. WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE. to the fullest extent permitted by law.

I HAVE READ THIS CLAIMS AND LIABILITY AS WELL AS THE

WAIVER/RELEASE FOR COMMUNICABLE DISEASES INCLUDING

FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

This is to certify that I, as parent/guardian, with legal responsibility for this participant, have read and explained the provisions in this waiver/release to my child/ward including the risks of presence and participation and his/her personal responsibilities for adhering to the rules and regulations for protection against communicable diseases. Furthermore, my child/ward understands and accepts these risks and responsibilities. I for myself, my spouse, and child/ward do consent and agree to his/her release provided above for all the Releasees and myself, my spouse, and child/ward do release and agree to indemnify and hold harmless the Releasees for any and all liabilities incident to my minor child's/ward's presence or participation in these activities as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent provided by law.
