Waiver of Liability and Informed Consent Release 

I, the undersigned, hereby acknowledge that I am voluntarily participating in LVHS grooming services. I understand that the LVHS certified pet groomer will exercise all necessary and proper care and precautions to keep all pets safe during grooming appointments in order to prevent injury to any person, pet, or property.

I understand that there are dangers and risks to which my pet may be exposed to during grooming and acknowledge that I have had full opportunity to discuss any and all concerns I have regarding foregoing risks inherent with pet grooming with the LVHS certified pet groomer and its authorized representatives. 

I agree to hold harmless LVHS certified pet groomer from all claims of injury, loss, cost, expenses, or damage of personal, property and other wise, caused during the course of grooming or under the care, custody or control of LVHS certified pet groomer. 

I hereby accept and assume, without reservation, all risks associated with my pet being groomed, including, but not limited to: the risks of any and all injuries to myself, my pet and any of my family members, guests or third parties who may be present; the risks that my pet may cause injury to other persons and/or pets involved; and the risks that saliva, water, food, and/or other pet debris may be present in the grooming area. 

I have read and understand the LVHS Grooming Policies, and agree to abide by them. 

This is a legally binding Liability Release, Waiver, Discharge and Covenant Not to Sue made be me, as lawful consideration for participating in the LVHS Pet Grooming service. I, for myself, my heirs, next of kin, executors, administrators, legal representatives, successors and assigns (the “Releasing Party”), hereby waive, release, discharge and hold harmless Lehigh Valley Humane Society Pet Grooming Service, and their members, managers, agents, and employees (the “Released Party”) from any and all injuries, losses, claims and damages to any person or persons of any nature its directors, officers, employees, agents, sponsors, organizers, volunteers, Board Members or other representatives, their successors and/or assigns, (hereinafter collectively the “Releases”) from any and all liability to the Undersigned for any loss, harm, damage, claim, in-jury or accident to the person or property of the Undersigned, whether caused by any ordinary negligent act or omission of the Releases while the Undersigned or his/her dog is engaged in or participating in dog grooming/boarding or using any groomer or Business facilities in connection therewith. 

This Waiver of Liability & Informed Consent Release shall be legally binding on the Releasing Party. Further, should the Releasing Party assert a claim to the contrary to what I have agreed to in this Waiver of Liability and Informed Consent Release, the claiming party shall be liable for all expenses (including attorney’s fees, court costs and consultant fees) incurred by both the Releasing Party and the Released Party.

No waiver or modification of any provision herein shall be valid unless expressly agreed to in writing by both the Released Party and the Releasing Party.

I consent to myself and/or my dog being the subject of photographs and/or audiovisual recording and authorize LVHS Pet Grooming Service and to cause the same to be exhibited for educational purposes or marketing tools as still photographs, video or other similar media. I further acknowledge that I will not be compensated for these uses, and that LVHS exclusively owns all rights to images, videos and recordings, and to any derivative works created by them. I waive the right to inspect or approve of the uses of any printed or electronic copy material.

Every provision herein is intended to be severable. If any one or more of the provisions herein is found to be unenforceable or invalid, that shall not affect the other terms and provisions hereof, which shall remain binding and enforceable. This foregoing release and waiver, and assumption of risk is intended to be as expansive, broad and inclusive as permitted by PA law.

I assure the LVHS that there are no health-related reasons or problems which preclude or restrict my pet's participation in this activity. I further assure the LVHS that I have adequate pet insurance necessary to provide for and pay any medical costs that may directly or indirectly result from my participation in this activity, and I will indemnify and hold the LVHS harmless for any such medical costs.
