This terms of service agreement applies in first instance to all business-related and/or contractual work produced by the artist, unless explicitly said otherwise:

0) Any person (from here on also referred to as "you"), by agreeing to make use of any service the artist (also "FonkiMonki", or referred in the first person "I" from now on) offer, states that they A) are over the legal age required to access this service and B) have read these Terms of service and have agreed to them.

1) PRICING - Any price may be discussed, but once settled, it cannot be changed for as long as the service remains the same. However, if you would like to upgrade it (or downgrade it, provided further work hasn't been done), arrangements may be made, so long as I agree with them.

2) PAYMENT AND CONTRACT - Any contract is only established after payment, which should always be upfront, and by any means I offer. I will not be responsible for any alleged contract that is unpaid.

3) SINGLE EXCHANGE POLICY - All services are purchased individually. Money exchanges will be held by each individual case, even if purchasing in bulk.

4) PERMISSIONS AND RIGHTS TO THE USER - The service provides you with a product ("artwork"), which you are free to post, print and distribute. Editing, and commercial uses of the artwork are in first stance not permitted, but you may ask for permission allowing such uses. At all times I retain my rights as the author of the artwork, including, but not limited to, the publication of said piece from my part.

5) REFUNDS - There will be no refunds once money has changed hands.

6) TERMINATION - I keep the right to choose who I make business with. At any point during my service, I may terminate the exchange with a refund (full refund if no work has been completed, partial refund if otherwise). You will lose all your rights to the work in progress and/or final product. This policy will be followed particularly if any aggression, threat or abuse from your side is perceived.

7) DEADLINES - Deadlines, and compensation in the case of not meeting them, may be discussed and made only upon reasonable request and my approval.

8) END OF CONTRACT - This contract ends when the product is considered finished by the artist. Once reached this point, refunds are not possible. Additions and edits will impart a fee.

9) ADDITIONAL CONDITIONS - Additional conditions may be stated publicly, to which you have the right to know entirely and be answered about.

10) AGE RESTRICTION - In order to commission FonkiMonki you must be eighteen (18) years of age or older, and indicate such with the terms and conditions of this Agreement by checking the "I am 18 or older and have acknowledged the Terms of service" checkbox on the registration page. You will not be allowed to commission me if you are not 18 years old or more, and have not checked that box.

11) To the extent that one or more of these provisions are illegal or unenforceable, the remainder of this agreement shall remain valid and enforceable to the greatest extent in law. All parts of this document may be altered at any point without warning. In case of doubt, contact me.

1) Fill out the commission form

2) I will always contact you back via the email you provided in the form, to tell you if I am going to work on your commission or not. We will then discuss any detail that may be unclear and confirm the price.
If I didn't contact you back, try to reach me out through the form or my other sites, like my twitter for example.

3) Once we are both in agreement, I will send you a link to the payment invoice. Please do not write any comment in it. All commissions are paid up front.

4) I will send you all steps of the process, usually as follow:

  - a rough sketch to pin down pose and general proportions (this is the best moment to ask for revision, although I might still refuse them or charge a fee if it's too different from what we initially agreed on),
  - full sketch (up from this point all the files will be in original resolution and shared with my Patreon supporters, and streamed on discord),
  - lineart (up from this point I am unlikely to accept any revision without a fee, unless it's a minor change),
  - flat color,
  - shaded picture if you picked that option in the form,
  - a MEGA folder with all of the above and a PSD file of the picture once we are done.

All these pictures, in original resolution, are exclusive to you, the commissioner(s), and my Patreon supporters. Do not redistribute these original files.

5) I will then upload the picture(s) on my different sites (usually Twitter, Cohost, Hentai Foundry, rule34 and e-hentai galleries) in a lower resolution. Once it is done, you can share these public versions and upload them on various sites, as long as I haven't shared them there already and you give me proper credit. You can also ask me for a version of the commission with a watermark if you prefer so.

 

Additional tips:

Have references ready! If you have specific sizes (character height, penis, breasts, etc) in mind, give reference picture of them instead of sizes in units, it'll be faster and way more clear. Commissions that includes character designing (no reference picture of the character) are more expensive, the price may vary depending on the complexity but is usually around +50%.

Stay reasonable with the feedback. I appreciate suggestions but please keep them short and send them in one message rather than dribbling it progressively. I also need a minimum of artistic freedom and keep the right to refuse a commission if I feel like I don't have enough control over what I'm drawing.

It's okay to ask! If you're unsure weither or not I'm okay to draw your kink don't be shy. I might refuse if it's not my jam but I won't kink shame. You can check my gallery to see if I already drew something similar, or directly contact me through my sites, like my twitter for example.
