  • If everyone on the lease is leaving, then you need to submit an Expiration of Lease Form or Early Termination of Lease form.

  • NOTE: Eclipse Property Management will send out a legally binding form to all current tenants to sign before removing any tenant.

    Example of the form:

    1. Return of Security Deposit to Removed Tenant: 
      The Tenants paid a security deposit in the amount of $_________ pursuant to the terms of this Lease. The full security deposit must remain on the property.  The Removed Tenant's portion of said security deposit is $_______. Upon all conditions of this Form being met, Landlord’s Agent agrees to return the Removed Tenant’s portion of the security deposit to the Removed Tenant, within 60 days of the completion of everything listed in section 6 of this form. 
    2. Replenishment of Portion of Security Deposit: 
      The Remaining Tenants hereby agree to replenish the security deposit in the amount of $__________, to maintain the required security deposit amount that is required pursuant to the Lease. Removed Tenant explicitly understands that Removed Tenant's portion of the security deposit shall NOT be returned until such amount is replenished to Landlord's Agent.
    3. Removed Tenant Fee: 
      As described in the Lease, Eclipse Property Management (“Landlord’s Agent”) charges a fee of $175.00 (the “Removed Tenant Fee”) to remove a Tenant from the Lease (the “Removed Tenant”).  Landlord’s Agent will add this fee to the Tenant Ledger when the request is made to remove a Tenant.  Landlord’s Agent may use funds from the security deposit pending return to the Removed Tenant to satisfy this fee.
    4. Utilities: 
      Any utilities in the name of the Removed Tenant shall be transferred to and maintained by one or more of the Remaining Tenants.  Tenants shall facilitate this transfer and provide proof of transfer.
    5. Damages: 
      No walkthrough or examination of the Leased Premises is occurring due to removing the Removed Tenant from the Lease. Landlord's Agent, therefore, is not holding Removed Tenant responsible for any damages to the Leased Premises. Landlord's Agent will hold all Remaining Tenants responsible for any and all damages to the Leased Premises even if such damages were caused by Removed Tenant. 
    6. Form Completion:
      This Form is not valid or enforceable until the following is complete:
      1. The Removed Tenant Fee described above is paid to Landlord's Agent.
      2. The replenishment of the security deposit described above has been paid to Landlord's Agent.
      3. All utilities are in the names of at least one of the Remaining Tenants.
      4. This Form has been signed by the Removed Tenant, all Remaining Tenants, and Landlord's Agent.
