Terms and conditions of the contract:
We reserve the right to refuse puppy sales to anyone at any time for any reason!
Note: Qilin, has the option of first pick(s) of the litter at any time of male or female.
Buyer understand that pet puppies are pups priced with slight imperfections and we do not guarantee against comsmetics or slight defects that may not affect the well-being of the dog and we do not gurantee any puppies are show/breeding quality.
Deposits:
If you place a deposit on a future litter and there is not a puppy in the available litter you joined for initially your position will move into the next available slot on the list. If possible, the puppy Buyer will also be given the opportunity to move to the end of the deposit list on available puppies of the opposite sex.
Due to the inconvenience created for the breeder and other client or potential client families, you will lose your deposit if any of the following apply:
1. Changing your mind about the purchase after an amount of time spent occupying a spot on a list. Failure of the Buyer to complete this purchase would subject Seller to lost opportunities to sell the Puppy to some other Buyer and retention of the Deposit is meant to compensate Seller for his possible loss.
2. If you fail to confirm your intent of purchase after pups are born or you are non-responsive throughout the developing stages thereafter.
3. Failure to collect puppy on the scheduled availability dates for that given litter.
4. Failure to use your deposit within 24-months will result in forfeiture of the deposit.
If you choose to push your deposit back, you will no longer be locked into the original price format. If the price increases you will have to pay whatever the price is at the time you choose to get a puppy.
Fees/Tax: There is a 3.5% fee added to all paypal tranactions. We are also required to collect 6% sales tax on all puppies by law.
Breeder Obligations:
1. Notify buyer within a week after the of birth of the litter.
2. Register the litter with Limited AKC
3. Administer first set of vaccinations and worming for the puppy.
5. Puppies are dewormed at 2,4,6 weeks of age and again right before leaving.
6. Provide the puppy with a microchip Provide a health record for the puppy
Buyer Obligations:
1. Your puppy MUST See a vet within 3-days. If your puppy does not see the vet within 3-days of purchase then the whole guarantee will be voided.
2. It is understood that you will purchase SAFEGUARD dewormer in advance so that you may continue the deworming process once you bring your puppy home to ensure a healthy transition. It is understood that you must deworm your puppy within one week of their arrival home with SAFEGUARD for five-consecutive days. Puppies will need to be dewormed every 10-days until the puppy reaches 16-weeks of age to continue our deworming schedule.
3. Keep the puppy in the house as part of the family that is suitable for their needs. You agree to provide a safe and loving home for your puppy, provide fresh water and quality food appropriate veterinary care including, but not limited to, vaccines and heartworm preventative, a home with a yard, shelter and adequate room for daily exercise, companionship.
4. Register the puppies microchip within 30-days
5. All puppies names must start with the Prefix of Qilins In front of their AKC name.
6. Puppies that are being transported with our shipper must be paid for in full before the puppy can leave Nosam.
7. If you are picking up in person you will bring the final balance in Cash.
8. Purchase pet insurance for your puppy by go home date.
9. Spay & Neuter your puppy by 15-months of age. Provide proof of this procedure to Qilin.
Vaccine reccomendations
Distemper + Parvovirus administered at 8, 10, 12, 16 weeks of age. 1x a year thereafter. 5-ways, lepto and lyme are not recommended for this breed due to vaccine related reactions.
Rabies-give 3-4 weeks apart from other vaccines.
Visits: Due to scheduling, safety of our home, health of our dogs and puppies;It is understood that visits without an appointment are not allowed and are not scheduled until the puppies have received their first round of vaccines or are ready to go home by families who have made a deposit on a specific pup or litter. Usually around 8-weeks of age!
Price
It is understood this completed contract ensure the privilege to purchase a puppy and your remaining balance will be paid in full (during the availability week of the list you join and must include any additional kenneling or training fees if applicable).
Your initial purchase price only applies to the price format at that time. If you switch to a different list with a higher pricing format your deposit will transfer but you will be required to fill out a new contract for the new list at the pricing format during that given time. This means if you decide to wait for a puppy and transfer your deposit to a later list for any reason if the price changes you are required to pay the difference.
Due to the inconvenience created for the breeder and other client or potential client families, you will lose your deposit if any of the following apply: If the contract must be terminated for any reason.
A. If you fail to pay the balance of your pup by the scheduled availability dates for that given litter.
B. If you fail to confirm your intent of purchase after pups are born or you are non-responsive throughout the developing stages thereafter.
C. Changing your mind about the purchase after an amount of time spent occupying a spot on a list. Failure of the Buyer to complete this purchase would subject Seller to lost opportunities to sell the Puppy to some other Buyer and retention of the Deposit is meant to compensate Seller for his possible loss. This includes newly developed allergies, health issues or deciding you no longer want a puppy from this kennel or pricing format.
D. Refuse to pay the agreed upon price listed in this contract
The Seller reserves the right to void this transaction (deposit remains non-refundable) if we learn of any reason why Buyer might not be suitable for the puppy – (I e. Conflict between buyer & seller, buyer is found to be an animal abuser, violent person, representative of a Pet Store, representative of a pharmaceutical research laboratory or etc.).
If the transaction is voided through some tragic accident if the Puppy were to die or otherwise be seriously injured before it goes to its new home then, of course, the deposit will be returned to the Buyer; unless the Buyer wishes to apply the Deposit to another Puppy, if one is available, or to a puppy from the next available litter.
Any deposits on litters that are not fulfilled are transferred to the next litter or another upcoming litter by mutual decision. If we are unable to produce a puppy that fits what you are looking for (based on sex and color) within 24-months we will return your deposit.
If you choose to transfer your deposit due to unforeseen circumstances that no longer allows you to purchase your puppy then you must use this deposit within 2-years or it will be lost.
Price: Puppy prices are NON-NEGOTIABLE! The price you agree to pay is listed in the contract at the time of signing and this is the price you are expected to pay for your puppy in full by 8-weeks of age. If other puppies in the litter are discounted after you have signed the contract you are still locked in for agreed upon price format. Refusal to pay the agreed upon price will result in a void of contract and you will forfeit your position on the list.
Delivery: Please note we do ship puppies as Cargo. If your puppy must be transported it must be with a USDA ground shipper or Flight Nanny it is up to you as the buyer to arrange and pay costs associated with that. There will be a $50.00 fee to cover the extra certificate needed for puppies to be shipped via ground or fly in cabin. We can also meet you at our local airline and you can fly your pup back with you in cabin.
Failure to collect: It is understood that our puppies join their families at 8-weeks of age or the scheduled availability date for each litter or upon an agreed date for the puppy you are buying. If you are unable to pick the puppy up on the agreed upon date for that puppy or litter. A $15 fee is required for each additional day after the set pick up date for that puppy.(note: balances and kenneling fees must be paid prior to picking up if you don’t pick the puppy up on the availability date). This fee covers extra vaccines/food/vetting and training. This means if we set a date for you to collect a puppy and you cannot pick it up on the agreed upon date there is a $15-day boarding fee for each day that you do not collect the dog after the agreed upon date. If you fail to pay the fee or do not pick the dog up within 30-days Qilin reserves the right to resell the puppy with no refunds.
Health: At 10-weeks weeks of age the pups are ready to leave our home and join their new family. We know we have done our best in raising your new family member. All pups leaving our home will have already been micro-chipped. Any pup/dog being returned must match their said microchip number in order for this guarantee to be honored.

[1] GENERAL HEALTH
Qilin certifies that, upon Puppy Buyer’s receipt, the puppy is in good health and has been given their first set of vaccinations, has been dewormed and provided with a health record.
Puppy Buyer can return the puppy at Puppy Buyer’s expense for a full refund up to the cost of the puppy, if it develops an illness within three days of pick up. If during examination by Puppy Buyer’s veterinarian a genetic issue is found and documented in writing by the examining veterinarian, the puppy may also be returned at Puppy Buyer’s expense for a full refund up to the cost of the puppy.
Any condition that is minor, correctable, or a breed related minor condition is not covered. Conditions which could go away, or are considered to be a condition which a puppy will likely grow out of is not covered. The conditions not covered include but are not limited to: the presence of external parasites such as fleas, ticks, lice, mites, mange, etc. or internal parasites such as roundworms, whipworms, hookworms, tapeworms, giardia, coccidia, poisoning, reproductive problems, accidents, vaccine or medicine-related reactions, umbilical hernias, undescended testicles, viruses, UTI's, lack of veterinary care, veterinary error, lack of training, or behavioral problems.), you may, within 3 days of purchase, return the puppy (along with the AKC registration papers and all materials) for a full refund.
A written, signed, and dated statement from your veterinarian is required detailing the description of symptoms supporting his/her opinion and an explanation as to why this puppy would be a poor health risk. This exam and all associated costs are the buyer’s responsibility. Please note that this is 3 days from when the pup leaves our premises. Should a puppy be returned for a refund it must be returned within 24-hours of notifying Qilin of the puppy's illness.
Qilin will not be responsible for any vet expense or diagnostic testing for any reason. We reserve the right to have a second option obtained from another veterinarian of our choosing. If a puppy should die before the extent of this guarantee a necropsy must be performed within 24 hours of the puppy’s’ passing to determine the cause. Findings must be forwarded to Qilin's from the vet directly.
No other warranties or guarantees, expressed or implied, are made under
this contract except as stated here.
RETURN OF DOG: If at any time you feel your dog no longer fits in with your family and lifestyle, please return he/she back to Qilin where we will provide proper placement. Under no circumstances should a puppy be sold, transferred, traded, or surrendered to an animal control facility, shelter, rescue or a cash refund given for the return. Failure to return the puppy to the seller will result in prosecution a $5,000 fine and any legal fee's or money spent to get the dog back or placed in an appropriate home.
NON-BREEDING: All Qilin puppies are sold on AKC Limited registration as pets and should be spayed/neutered by 15 months of age. Proof of Spay/Neuter is required to be sent to Qilin Chinese Crested by 15-months of age. Buyer understands that the dog is not premitted to produce any litters within its lifetime. AKC papers will be mailed out to each buyer once they provide proof of spay/neuter. Buyer understands this means the breeder will retain the AKC papers until proof of this has been sent to the breeder. If proof of spay/neuter is not sent by 15-months unless a written statement from your vet deems that your dog cannot be fixed at that time there will be a $2,000 fine owed to Qilin Chinese Crested. There will be a $10,000 fine for any dog that is bred without written premission & Full AKC breeding rights. $5,000 fine for any subsequent litters produced there after.
Other Agreements
Breeder hereby released from any and all future liability to Puppy Buyer with regard to the puppy. Puppy Buyer agrees that from the date they take possession of the puppy, Puppy Buyer accepts all liability for the actions of the puppy and holds Qilin harmless with regard to any and all third parties.
If for any reason the health gurantee is voided the rest of the contract will remain intact.
This contract contains the entire agreement between Buyer and the seller and no other statements, agreements or attachments, written or verbal, made by either party that is not contained in this written contract shall be valid or binding and is signed by both parties. If any part of this contract is not legal according to local laws, the rest of the contract shall remain unaffected. If any part of this contract is breached by the Buyer the Seller is released from all further obligations.
Buyer agrees not to attack and or criticize the Seller in private or public emails, phone calls, forums, blogs, social networks and any other type of online media at any time during or subsequent to contract period in a way which brings financial harm or bad name to the Seller. In the case of breach of this clause, the buyer agrees to pay five thousand dollars ($5,000) to the Seller as damages.
The contract & warranty only applies to the original buyer outlined in this contract. If the puppy or dog is sold or transferred to another home the guarantee will be null & void.
In the event of any litigation in connection with this health warranty/contract, by signing this contract, the purchaser agrees to be responsible for breeder’s attorney fees. Venue and jurisdiction for litigation arising out of or related to this contract shall be exclusively in breeder’s current county and state.
No other warranties or guarantees, expressed or implied, are made under this contract except as stated herein.
When signing the contract all buyers guarantee that their sole purpose in coming to our property is to buy a puppy & that they are NOT working undercover for HSUS, PETA or any other animal rights extremist group, rescue or any groups affiliated with the sole purpose to end animal ownership & violate the rights of dog breeders. Also, that they will NOT give information about our property to any humane society or animal rights organization under penalty of prosecution. The Animal Enterprise Terrorism Act (AETA) is a United States federal law (Pub.L. 109–374; 18 U.S.C. § 43) that prohibits any person from engaging in certain conduct "for the purpose of damaging or interfering with the operations of an animal enterprise. “The statute covers any act that either "damages or causes the loss of any real or personal property" or "places a person in reasonable fear" of injury.
Buyer agrees to the above terms when signing this contract.
