Notwithstanding the limitation of liability hereunder, it is expressly understood under no circumstances shall Releasees be liable for more than the entry fee paid by Participant for this event.

This Release expressly releases Releasees from injuries and damages which are caused by Releasees’ negligence, whether active, passive, ordinary or gross, or otherwise. I acknowledge that the driving instructors of the Event are independent contractors, and not agents of BINGE Track Days. In the event I permit any other person to drive my vehicle during the Event, I hereby release Releasees from any and all injuries and damages which are caused by negligence, whether active, passive, ordinary or gross, or otherwise of said driver. I further agree to indemnify and hold harmless Releasees from any and all claims, demands or liability in breach or violation of the terms of this Release.

Participants are required to have their vehicles inspected by a qualified mechanic prior to the Event, and to bring the completed tech inspection form to registration. The responsibility of ensuring that the vehicle is safe and in proper mechanical condition to participate in the Event falls exclusively upon the Participant and his or her mechanic.

I acknowledge that the inspection of my helmet by the Event organizers is for the sole purpose of determining whether my helmet has a label indicating that it has met the minimum, 2015 standards of the Snell Memorial Foundation for special application helmets, and that it appears from a visual inspection to contain the appropriate Snell rating sticker or label and to be capable of meeting those standards at the present time. I acknowledge that the Event organizers make no guarantee of fitness for use in “passing” my helmet, and that I am relying solely on my own judgment in using the helmet in the Event. I release, acquit and forever discharge Releasees from any and all liability, claims, demands, or causes of action that arise from my wearing the inspected helmet, from my attendance at the Event, or from any injury sustained by me, regardless of their negligence.

I represent that I am over the age of 18 years, that I understand that I am participating in a dangerous activity, and that my helmet has not previously been worn in a collision, dropped, or struck by a hard object. I further acknowledge that the above conditions also apply to any helmet that I borrow from a Releasee, and that I alone am responsible for my decision to wear a borrowed helmet.
