The Rental of underwater camera equipment offered by Scuba IQ (hereinafter called "Lessor") to its customers (hereinafter called “Lessee”), is subject to the following Equipment Rental Terms and Conditions. By accepting equipment furnished under this agreement, the Lessee accepts and agrees to the Terms and Conditions.
Equipment, as referred to herein, shall include all other related items as specified on this Rental Agreement.
1. AVAILABILITY & ACCEPTANCE
All equipment rentals are subject to the availability of equipment at the time of order. Any such order shall be subject to these Terms and Conditions and be deemed part of such order upon acceptance thereof by Lessor. No additional agreements will be binding upon Lessor unless specifically agreed to in writing by Scuba IQ.
Failure of the Lessor to object to provisions contained in any communication from a Lessee, shall not be construed as a waiver of these Terms and Conditions, nor an acceptance of any such provisions.
This contract and these Terms and Conditions shall constitute the entire agreement between Lessor and Lessee.
2. ORDERING
All orders for Rental must be made in advance, and are subject to the availability of the rental Equipment. Rental orders are only confirmed once payment has been completed in full, and the Terms and Conditions of Rental are agreed to.
When completing the order and payment for the Rental, please ensure that the correct number of days are selected, to avoid any unnecessary delays.
3. RENTAL PERIOD
The Rental period begins on the day of delivery of the Equipment by The Lessor to the Lessee and ends on the day of the Equipment being returned to The Lessor. No allowance is made for Weekends (Saturdays and Sundays) and/or Public Holidays. Lessee is obligated to return the Equipment to Lessor within the stipulated or agreed time frame, or risk incurring additional day(s) of rental charge accordingly. Standard Rental periods are as follows:

For overnight or multi-day trips, Rental charges apply for the entire duration of the trip.
4. CANCELLATION
All cancellations require 24 hours' notice in writing. Cancellation within 24 hours will incur a fee equal to the cost of the first day’s Rental
5. USAGE
Lessee agrees that equipment usage shall be limited to that for which the Equipment is designed. The Lessor will provide instruction on the basic operation of the Equipment, and offer general advice on its use.
The Lessee agrees that Equipment Rental does not grant the Lessee any title or property rights in the Equipment; all title and property rights shall remain with the Lessor.
6. CONDITION OF EQUIPMENT
The Lessor agrees to ensure that the Equipment included under this agreement is in good working order when delivered to the Lessee, at the start of the agreed Rental period.
In the event that the Lessor is unable to provide the agreed Equipment, the Lessor will offer a suitable replacement or a full refund of the Rental fees.
The Equipment included under this agreement is as follows:
GoPro HERO 11 or 13 Black Camera
GoPro Protective Housing
GoPro Camera Handle
Protective carry case
For overnight or multi-day trips, a spare battery and charging cable will also be provided.
7. DAMAGE, LOSS, OR MISSING EQUIPMENT
The Lessee agrees to pay for any damage or loss of the Equipment, regardless of cause, and to keep the Equipment and its accessories in good repair and operating condition at all times. Total loss of the Equipment or for Equipment returned from Lessee inoperative, damaged, or with missing components will incur costs equivalent to the current cost for replacement with original, genuine ‘GoPro’ parts. These costs are listed below:
GoPro HERO. $650
GoPro Protective Case $100
GoPro Camera Handle $60
Protective Carry Case $30
These prices are in Australian Dollars (AUD) and current as of 01/01/2026.
Any equipment that cannot be returned to the Lessor will be invoiced to the Lessee at its current published list price - see above.
8. COLLECTION AND RETURN
Collection and Return of the Equipment is to be made at a time and location agreed upon by Scuba IQ. For details, please see the schedule in Clause 3 of this agreement. Early return of the Equipment is not subject to a refund in part or full unless agreed by the Lessor.
9. SUBLETTING
No part of the equipment shall be sublet, transferred, or assigned by Lessee or removed from the location at which it was intended by Lessor to be used, as represented by Lessee, except with the prior consent of the Lessor.
10. TITLE
Title to the equipment now, and at all times hereafter shall remain and be vested only in the Lessor. Lessee shall keep the lessee's interest in this agreement and the Equipment free from all liens and encumbrances.
11. GENERAL
These terms and conditions, as produced by Scuba IQ at the time of equipment rental, are the Equipment rental Terms and Conditions between Lessor and Lessee, and may be amended without notice, at the Lessor’s sole discretion.
