Wilde Lake Karate & Learning Center WAIVER, RELEASE, ASSUMPTION OF RISK, INDEMNITY, CONSENT AGREEMENT, and cancelation policy.
WAIVER, RELEASE, AND ASSUMPTION OF RISK AGREEMENT
I acknowledge and fully understand that participation in various activities offered by Wilde Lake Karate & Learning Center ("WLK"), including martial arts classes, before and after-school programs, summer camp, birthday parties, indoor and outdoor activities, and numerous other events, involves inherent risks. These risks may include, but are not limited to, the potential for severe injury, illness, or other unforeseen events that cannot be entirely eliminated or controlled.I am aware that such activities may encompass a wide range of experiences, such as sports (e.g., gymnastics, soccer, basketball, bowling, swimming, skating), amusement rides, slot car racing, water park visits, animal shows, dance classes, and various other events (e.g., kids' night out, Halloween events, seasonal parties, and break camps). These activities may occur during different programs and events offered by WLK.In consideration of allowing my child to participate in these activities, I voluntarily release and forever discharge Wilde Lake Karate & Learning Center, Inc., its officers, agents, representatives, and employees from any claims, actions, suits, demands, or causes of action, whether in law or equity, related to any injury, illness, damage, or death that may occur while my child participates in WLK programs and activities.I also agree to indemnify, defend, and hold harmless WLK, including its officers, agents, representatives, and employees, from any claims, liabilities, or demands made by or on behalf of my child, including property damage, personal injury, illness, damage, or death. This indemnification includes any associated attorney's fees and costs.I have read, understood, and accepted the terms of this Waiver, Release, and Assumption of Risk Agreement. I voluntarily and willingly agree to be legally bound by its contents.I acknowledge that all of these risks are inherent in these activities and that these activities and other activities my child might engage in pose the possibility of severe injury, illness, and other risks that cannot be eliminated, altered, or controlled.
I acknowledge the possibility of motor vehicle accidents that may occur while transporting camp participants to or from activities, including before and after-school transportation, summer camp, or day camp field trips. I grant my permission for my child to participate in all Summer Day Camp, before-after school activities, and any activities offered by WLK. This includes, but is not limited to, the activities described above and outlined in the weekly schedule.I acknowledge and assume the risks involved in these activities and for any damage, illness, injury, or death resulting from such risks to myself and my child. I confirm that no physical, emotional, or mental problems or limitations are associated with my child's participation in any programs mentioned at Wilde Lake karate and all other activities, except as I disclosed in writing to WLK.RELEASE, WAIVER OR LIABILITY, AND INDEMNIFICATION: In consideration of my child being permitted to participate in Wilde Lake Karate's programs, I, on behalf of myself and my child, do hereby release and forever discharge Wilde Lake Karate and Learning Center, Inc., its officers, agents, representatives, and employees, of and from all manner of actions, suits, claims and demands whatsoever, in law or equity, concerning any injury, illness, damage, or death occurring to my child while he or she participates in any camp programs and activities. I hereby agree to indemnify and hold harmless Wilde Lake Karate and Learning Center, Inc. and its officers, agents, representatives, and employees concerning any claim asserted by or on behalf of my child as a result of property damage or personal injury, illness, damage or death, which indemnity and holding harmless includes any attorney's fees and costs. I have read and understood the above and agree to be bound by the terms of this document. Authorization and Waiver: I authorize WLK to act on my behalf in an emergency requiring medical attention or any other humane action. I waive and release WLK from all liability for any injuries or illnesses incurred.I understand that participation in Wilde Lake Karate and all other activities inside and outside WLK involves physical activity and, as such, carries with it the risk of injury. Should an injury occur, all medical expenses incurred are the sole responsibility of the participant or family, including all activities inside and outside this facility. I authorize and permit the Ride Form Authorization of Transportation. I hereby authorize WLK to transport my child to all activities. If I elect NOT to have my child participate in a particular activity, I will notify the School in writing of my decision. Furthermore, I will make alternative arrangements for my child for the duration of the planned activity. I have documented below all precautions and instructions regarding my child's medication. I have noted any special Health-related conditions or allergies regarding my child. I agreed to all the above waiver of liabilities by signing my name on this liability waiver for WLK.
I Understand WLK's Martial Arts After School Program is based on the contract between parents, legal guardians, and their children for taking martial arts classes, and Wilde Lake Karate is NOT a childcare center.
To maintain a safe and qualitatively sound program, we occasionally find it necessary to apply our discipline policy. Effective and positive behavior management methods are (1) REDIRECTION: We will stop the child and calmly learn what has happened, why, and how they see the issue, and then suggest other ways of handling the situation. Then, we will redirect their attention. (2) SEPARATION: We will have some separation time to the child t for a short time; this allows them to calm down. Then we will explain other ways of good behavior. (3) A parent conference will be held if a child's behavior remains problematic. If there is little or no improvement in the child's behavior after the parent conference, termination of enrollment may become necessary. Termination of registration will be at the discretion of WLK's staff.
Testing Fees: A testing fee is charged for each examination to cover the costs of registration, promotion, certificates, and a new belt.
Payment Default:Failure to adhere to the contract terms, including breaching provisions, late payments exceeding 21 days, or written repudiation, may result in a suspension of membership privileges. In such cases, you must settle the entire outstanding balance, minus eligible refunds as specified.Default occurs when scheduled payments are not made, or the total balance remains unpaid after the contract's end date. Interest, at the specified Annual Percentage Rate, applies to the remaining financed amount until fully paid. Legal action may be taken to obtain a court judgment for the outstanding balance, with associated court costs and reasonable attorney's fees payable by you.You remain responsible for payments even if you do not use our services. A bad check fee may apply for insufficient funds. Late charges, $40.00 or 8% of the defaulted amount (whichever is greater), may be assessed. In default, the contract may transfer to an independent financial institution for collection.
Our Rules and Regulations: The member shall follow all of the rules and regulations of the School, including hours of operation, which have been made available to you and are posted in the School. We can revoke your membership privileges if these rules and regulations are not followed, and we expressly reserve the right to change these rules, regulations, and hours of operation. In addition, we expressly reserve the right to add to, eliminate, or alter any piece of martial equipment, furniture, or fixture when deemed necessary or desirable if, in our judgment, it is in the best interest of our members.
Release of liability: It is understood that accidents occur from time to time due to the nature of the training that the School is providing. While all precautions will be taken to ensure the safety of all students, it is impossible to guarantee that such accidents will not occur. Therefore, suppose you are involved in an accident that subjects you to any injury. In that case, you agree to hold the School harmless and that neither you, a parent, a guardian, or any other financially responsible person will take no action against the School. Change Of Contract: Any change in this contract may only be made if you and the School agree in writing to any such charge.Age or Parental Consent Certification: By signing this contract, you are certifying that you are either of legal age or that you are signing this contract as a parent or legal guardian of a minor, and by signing this contract on behalf of any child, you hereby agree that you shall be responsible for all payments due hereunder and that you will indemnify and hold School harmless for any injuries, losses, or damages sustained to anyone as a result of the minor's participation in this program of instruction. Governing Law: This agreement shall be governed by the laws of Maryland, and there are no other agreements, terms, promises, or obligations of either you or us which are not contained within this agreement. The remainder will not be affected if any clause or provision of this agreement is unenforceable under any present or future law. Cancellation for Medical Reasons: while this contract is in effect and the member submits written documentation from a physician indicating that continued use of school facilities would impair the student's health and well-being, this contract may be canceled.
Notice of Consumer Rights: Our Health club registration number is (--E 2929----). The School is not required to carry a performance bond under Maryland law since we only collect up to three months' payment in advance or less than $200.00 in initiation fees (Registration Fee). You have the right to cancel this agreement within three (3) business days (including Saturday) after the date this contract is signed.
Wilde Lake Karate Tuition & Cancellation Policy
Before School Program, After School Program, or Both Program
1. Tuition Structure:
Our program operates on a monthly tuition basis, not calculated on a weekly or daily rate.
There will be no tuition adjustments for holidays, winter break, spring break, or other holidays.
2. Additional Costs:
Special sessions like half-day and all-day camps are not included in the monthly tuition and will incur additional costs.
A test fee is applicable for assessments or evaluations conducted within the program.
3. Program Duration:
The program runs from the last week of August until the middle of June.
August and June are pro-rated months.
4. Registration and Cancellation:
A 3-day grace period is available post-registration for cancellation without obligation.
Post the 3-day grace period, you enter into a contract for a minimum of three months.
After the initial three months, membership shifts to a month-to-month basis.
A 30-day advance notice, from the beginning of the month, is required to cancel your program membership and avoid tuition obligations for the next month.
Summer Camp
A minimum of four weeks' notice is required for the cancellation of any week(s) of the summer camp. This allows us sufficient time to adjust our planning and open up the spot to other interested participants.
Registration Fee:
Please be aware that the registration fee is non-refundable.
Half Day, All Day Camp, other Daily Events
Cancellation Policy for Daily Programs and Events
Notice Period:
For cancellations of any daily programs such as half-day camp, all-day camp, party events, birthday parties, and belt test fees, we require a minimum of 10 days' advance notice.
Refund Policy:
In the event of a cancellation within the specified notice period, refunds will be provided in the form of credit for future services.
Martial Arts Classes:
To cancel your enrollment in our martial arts classes, a 30-day notice is required from the beginning of the month. This policy helps us manage our class sizes and instructor schedules effectively.
For example, if you wish to cancel starting from November 1st, your cancellation notice must be submitted by or before September 30th.
