  • IN CONSIDERATION of the rent received and the mutual promises herein, the owner of the subject property, 342 Upper Cherrytown Rd LLC, (“Owner”), does hereby grant temporary occupancy to you, hereinafter referred to as “Guest”, to certain property described below and under the following terms and conditions (“Agreement”).

    1. PROPERTY: The term “Property” will refer to the one-family dwelling, grounds, land, interior and exterior furnishing, and equipment, materials, and supplies at the premises located at 342 Upper Cherrytown Rd, Kerhonkson NY.

    2. MAXIMUM OCCUPANCY: The maximum number of overnight guests for this property is limited to six persons unless arrangements are made and agreed to by Owner in writing prior to check-in date.

    3. OBLIGATIONS OF THE PARTIES: It is understood that Guest is responsible for all damages. The Owner is not responsible for lost or stolen items. Nor is the Owner responsible for any loss or damage to Guest's property. Any damage incurred to the Property or house furnishings will be the responsibility of the Guest.

    Guest acknowledges that at the commencement of the rental, the property is in good and substantial repair except for any defect Guest may report to Owner during the first day of the rental. Any damage or breakage caused by guests must be reported to the Owner on or before the day of departure. The Owner is not responsible for any inconveniences that may occur for which they have no control. This includes, but is not limited to power outages, adverse weather conditions, mandatory evacuation, construction, mechanical or amenity-related failures such as television, etc. No refunds will be given for occurrences beyond the owner’s control.

    4. GUEST RESPONSIBILITIES: It is fully understood that the property should be left in reasonably clean, sanitary, condition; Guest agrees to be responsible for any repairs necessary due to their negligence (or their Guest’s).

    5. SPECIAL EVENTS: Guest may not throw a party or large gathering at the premises without express written permission of the Owner. A large gathering is defined as greater than 9 persons.

    6. NOISE: Although the house and grounds are private, there are neighbors in the vicinity. Guests agree to keep noise to reasonable levels, especially during nighttime hours.

    7. INDEMNITIES: Any unsafe or dangerous condition must be reported to the Owner immediately. Guest acknowledges that the use of the property is entirely at Guest’s risk. Guest shall indemnify and hold harmless Owner from any expenses, costs, damages, suits, actions, or liabilities arising directly from Guest’s use of the property, grounds, decks, stairs, fire-pit, common areas, and any other items on the property. Guest also agrees to defend the owner and his agents from any lawsuit alleging damages and/or personal injury that occurred during the Guest’s rental of the property, provided the incident was due to the Guest’s actions or negligence. Guest assumes liability associated with their Invitees, and agrees to indemnify and hold harmless Owner for any damages or liabilities caused by such Invitees.

    8. ENTIRE AGREEMENT: This Agreement and attached waivers, disclaimers and policies, constitute the entire agreement of the parties and supersedes all prior or contemporaneous oral or written agreements concerning this subject matter and should be governed by the laws of New York state.

    RENTAL POLICIES:

    1. GLASSWARE: May not be used in any outdoor area, use plastic provided instead.

    2. NO SMOKING: Smoking is strictly prohibited inside the house and evidence of smoking inside with result in a $550 extra cleaning fee and forfeiture security deposit if held. It is further understood that all evidence of smoking outside the house (including cigarette butts, ash, etc.), will be thoroughly removed and/or bagged in trash bags prior to departure.

    3. FIRES: Outdoor fires are permitted in the fire pit only, Guests are responsible for being aware of local ordinances and seasonal fire bans. Children must be supervised at all times near any fire and such fire should not be left unattended. Do not move the Fire Pit. No fireworks are permitted on the premises at any time.

    4. CHECK-IN & CHECK-OUT: Check-in time is typically after 4 pm, and check-out time is before 11 am. Unscheduled late check-outs following a 20-minute grace period will incur a $150 fee.

    5. EV CHARGING: Due to fire risk, please do not charge electric vehicles.

    6. PETS - One dog under 50 lb. is permitted upon request with an additional pet fee. Dogs must be added to the reservation at time of booking. Dogs are not permitted on beds. Excessive cleaning fees may apply.

    7. WEAPONS - no weapons permitted on the property.

    UPON SIGNATURE AND SUBMISSION, YOU AGREE YOU HAVE READ AND UNDERSTOOD THIS AGREEMENT AND ACCEPT ALL TERMS, CONDITIONS, AND RESTRICTIONS.
