This agreement is between Client , hereinafter referred to as the "Client(s)", and NC Photography, hereinafter referred to as the "Photographer(s)".

 

PERFORMANCE OF SERVICES: Photographer agrees to take photographs per clients request, allowing for artistic expression. Photographer agrees to create high quality photographs ideal for web display or print. Photographer will use professional editing to edit digital images to represent Photographers artistic style. Photographer agrees to provide a digital preview within 30 days of session date unless stated otherwise in writing.

 

PAYMENT: Client agrees to pay upon date of session the final amount due. In return Photographer agrees to provide X amount of images within X amount of time. The Photographer agrees to provide preview of images and print and product pricing for image purchase. Photographer agrees to provide session fee details before signing of

this document.

 

DEPOSIT: At the time of booking client agrees to pay an non-refundable amount to secure session date. The deposit amount will be applied towards the session fee for photography services. This amount is non-refundable/non-transferable for any reason.

 

CANCELLATION POLICY: All deposit fees are non-refundable/non-transferable. If cancellation is initiated by the photographer, all monies INCLUDING the deposit fee will be returned within 30 business days from the time of cancellation.

 

WORK PRODUCT OWNERSHIP: Any copyrightable works, ideas, discoveries or products (ie - “the work”) remain under the ownership of the photographer. Under no circumstances does this ownership transfer to the client.

 

PRINT PRODUCT ORDERING: All sales of products (ie prints, albums, digital images, etc) are final. Once client has ordered and payment has been made, there are no refunds or returns. All images are printed at a professional lab of the photographers choosing.

 

IMAGE ARCHIVE: All images will be available for purchase and/or download for 8 weeks following the session date. After 8 weeks images may be purged from the hard drive and no longer available for access. Photographer may retain certain images for promotional purposes. Photographer is not responsible for storing images beyond the 8 week period.

 

MODEL RELEASE: The Client hereby grants NC Photography and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same.

The Client hereby releases NC Photography and its legal representatives and assigns from all claims and liability relating to said photographs. Client grants NC Photography permission to display selected images resulting from this assignment as an example of NC Photography’s work and for entrance into photographic competitions and release all claims to profits that may arise from use of images.

I have read and understood this agreement, including the terms and conditions, and agree to be bound to them.

LIABILITY: Photographer is not responsible for any damage to person(s) or property during photo session. Client is responsible for their own children and their safety. Client releases Photographer of any and all liability.

 Photo Processing

*Basic Retouching included in your package includes color adjustments, white balance, contrast, and exposure adjustments. **Extra Retouching may include skin softening, blemish removal, etc. Retouching does not include item removal (eg. removing braces from teeth, hair from face, signs/lines or people from background, etc.) or body altering. All editing is done according to the photographer's own style and taste and to portfolio. Selected retouching is photographer’s choice. Additional requests for retouching will be at an extra cost to Client

 Client Cooperation You agree and acknowledge the importance of fully cooperating with The Photographer to allow us to obtain the best results while performing our services.

 INDEMNIFICATION: Client agrees to indemnify and hold harmless the Photographer from any claims, losses, fees, attorney fees, costs and judgements against the Photographer that result from acts or omission of the client, clients family members or any acting agent of the client.

 GOVERNING LAW: This contract shall be governed by the law of the state of Alberta,Canada.

I am the parent or legal guardian of any minor(s) named above and have the legal right and authority to execute the model release stipulations named in this contract on behalf of the minor. *
