Booth Information:

Vendor must provide all booth supplies, including pop-up tents, table and chairs. SMP is only providing booth space. Please note: This event is an outdoor event. Rain or shine. No Refunds.

California law requires that ALL SALES VENDORS have a California resale number. Your resale number is required above. Please include the letters in front of your numbers.

Setup starts at 1 PM . We ask that you unload and move your vehicle as quickly as possible.
Vehicles must be moved out of the vendor area no later than 3:30 PM.
We will not allow sellers to enter the selling area after 3:30 PM. No Exceptions.
Your space number will be given to you at check-in when you arrive.
Please bring your own setup equipment, pop up tent and weights in case of wind. This event is rain or shine.
Please do not tear down before 8 PM. Tear down may take place between 8:15 PM - 8:30 PM.
You will not be permitted to bring in your vehicle to load until 8:15 PM.
Please pick up your area before you leave. Please do not stuff event trash cans with your trash.

Terms and Conditions

1. Setup/ Break Down: All Exhibitors must be set up by 3:30 PM the day of the event. Exhibitors may begin setting up at 1 PM the day of the event. Break down can start no sooner than 8:15 PM on Saturday and must be completed by 10 PM. No vendor is to close before the official closing time. Sellers are responsible for their selling spaces. *Before leaving, be sure your area is clean and trash-free.

2. Staffing: Exhibitor booths must be manned at all times and intact until show closes at 8 PM. Sunrise MarketPlace and Sunrise Mall are not responsible for merchandise or displaymaterials.

3. Exhibitor Responsibility: Exhibitor will be fully responsible for any loss or damage to his or her property by theft, fire or casualty. Sunrise MarketPlace and Sunrise Mall expressly disclaims any responsibility for same. Exhibitors shall be responsible for any damage which may be incurred to the facilities as a result of or in connection with its
operation. Each exhibitor is responsible for the conduct of his employees and/or representatives and activities must not detract from the image or welfare of the event.

4. Exhibitor Spaces: Exhibitor spaces will be assigned. Placement, flow and competition will be taken into consideration to provide the best experience for event attendees. If you have special space needs, please include your request with your application and we will make every effort to accommodate you. Spaces are reserved on a first-come first-served basis. Vendors must ensure that none of their display equipment extends beyond the space they have booked; this includes any rails, stands or additional equipment.

5. One Business per table: Only one (1) business per vendor space; space may not be sublet or shared without prior approval of an authorized staff of the Sunrise MarketPlace.

6. Acceptance: Sunrise MarketPlace Brews in the Burbs Committee reserves the right to decline any application forspace if it deems such action to be in the best interest of the Brews in the Burbs Event.

7. Payment: The full payment is a non-refundable registration fee for the selected space and is due with the submission of this agreement. This fee will be used to cover advertising and other incidental costs associated with the production of this event.

8. Tables & Chairs: Each Exhibitor must furnish his or her own chairs, tables, stands, tent or canopy.

9. Outdoor exhibitors: All tents and canopies must be secured to the ground using weights/ sand bags in case of windy conditions.

10. Cancellation of space: Application fees are not refundable. Sunrise MarketPlace is not liable if weather or other conditions prevent the Exhibitor from attending and fulfilling the contractual obligation as an Exhibitor. No refunds will be made for weather, accident, health or other causes for non-participation.

Indemnification:

Notwithstanding any other term of this Agreement, vendor agrees to indemnify, defend and hold harmless Sunrise MarketPlace, Sunrise Mall, its current or future directors, professional staff, and their respective successors, heirs and assigns (the “Indemnities”), against any claim, liability, cost, damage, deficiency, loss, expense or obligation of any kind or nature (including without limitation reasonable attorneys’ fees and other costs and expenses of litigation) incurred by or imposed upon the Indemnitees or any one of them in connection with any claims, suits, actions, demands or judgments arising out of this Agreement (including, but not limited to, actions in the form of tort, warranty, or strict liability).

RELEASE AND WAIVER OF LIABILITY

The undersigned (“Participant”), hereby, on behalf of Participant and Participant’s heirs, executor and administrators, releases, waives discharges and covenants not to sue the Sunrise MarketPlace (“SMP”), Sunrise Mall or any of its affiliates, members of its Board of Directors, agents, contractors, volunteers, or other event personnel whether volunteers or paid staff (collectively, the “Releases”) from any and all liability, claims, demands, damages, cause of action, losses, or expenses (including attorneys’ fee and expenses) to Participant, on account of physical, mental, or emotional injury, or death of person of Participant or to the property of Participant, whether such injury or death be caused by the negligence, gross negligence of the Releasees or otherwise, suffered either during the event or while traveling to or from the event. Notwithstanding any other provision of this Release and Waiver of Liability, Participant release SMP and Sunrise Mall, but no other Releasee, from any liability whatsoever arising from any injury, damage, or death to Participant where said injury, damage, or death is the result of, or arises from any intentional or criminal conduct upon the part of an SMP or Sunrise Mall employee, agent or volunteer. Participant hereby assumes full responsibility for and risk of bodily injury to or death of Participant due to the negligence or gross negligence of Releasees and also releases SMP and Sunrise Mall, but no other Releasee, from any and all liability for the intentional or criminal acts of its volunteers, agents, and/or employees while Participant participates in or travels to and from the event. Participant further expressly agrees that the foregoing release and waiver is intended to be as broad and inclusive as is permitted by the law of the State of California, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. Participant has read and voluntarily signs this Release and Waiver of Liability, and further agrees that no oral representations, statement or inducement apart from the foregoing have been made, and that this Release and Waiver or Liability may only be modified by a written document signed by Participant and duly authorized representative of SMP or Sunrise Mall.
