FANTASTIC GARDENS MARKET APPLICATION JANUARY, FEBRUARY, MARCH, APRIL & MAY

THIS AGREEMENT is for FANTASTIC Gardens Market, held at 67 Avery Avenue, Patchogue, NY 11772. WHEREAS, Vendor has entered a contract with FANTASTIC Gardens Market. ("Owner") to set up their small business and sell their product/merchandise at the below location:

MARKET LOCATION: 67 Avery Avenue, Patchogue, NY 11772.

MARKET HOURS: Market will be held every Saturday & Sunday from 10 am to 2 pm.

MARKET NAME: FANTASTIC Gardens Market

DEFINITIONS IN THIS AGREEMENT:

The "Vendor" will be referred to as the Vendor

The "Fantastic Garden Market" will be referred to as FGM

The "Market Manager" will be referred to as MM

The FANTASTIC Gardens Market is designed to pique the curiosity of our customers, offering the latest in artisan food and beverage trends, providing healthy choices and promoting better health in our community. The FANTASTIC Gardens Market is supporting the entrepreneurial spirit by providing a home for small businesses from all over Long Island. Featuring local artisans, growers, craftsmen, skincare professionals and innovators with the goal of helping them succeed, our partnership with you is our primary focus.

Vendor is responsible for knowing and complying with all local, state, and federal laws, regulations, permits and license requirements for the product/products being sold.

PREPAREDNESS: Vendors should bring supplies that they may need, example-Rope, tie-downs,

Vendors will be assigned a location by the Market Manager. In the Spring and Summer Season, when the market is outdoors, tents must be held down by weights combined weight of 80 pounds, not just stakes in the ground. Be sure to have extra weights in the event of high winds. The Market Manager will instruct when and where to unload your vehicle and where to park your vehicle for the duration of

Spaces will be assigned based on the needs of each vendor and is at the discretion of the Market Manager. Please be sure to notify the MM of any special space requirements at the time of your application. (Example: electricity)

A Certificate of Insurance in the amount of $1,000,000 per occurrence and $2,000,000 in the aggregate for Premises Liability, Products/Completed Operations which would apply to bodily injury or property damage is necessary. The "Fantastic Gardens of Long Island," 67 Avery Avenue, Patchogue, NY must be listed as additional insured and certificate holder on your policy.

Vendors must be set up 15 minutes prior to the start of the daily markets. Set up starts at 8:30 am. Vendors that consistently show up late and are not set up by the market's opening, (3 times) will not be asked to join the following booking session.

All vendors are allowed to use the Fantastic Gardens Parking Lot to unload and pack their vehicles. To provide parking space and easy access to all of our customers, vendors are to park on the street at least one block away from the Market location.

The Market will be advertising consistently; however, each vendor is expected to also promote the market actively (via social media, word of mouth, etc to increase awareness and exposure.

Each Vendor is required to clean his/her assigned location at the end of each day and to keep it neat during the period that the market is open. All garbage generated from a day of activity at each Vendors location is to be neatly secured in a plastic bag and deposited in the Garbage Truck located at the back of the Garden Center. Direction will be provided at your first event.

Your dates of attendance must be selected at the start of open registration for the given period state, once they are approved, they must be paid in full to confirm your selected dates. Credit is only given out in the unforeseen instance of a market cancellation. There are no refunds. Failure to show up for market (without prior notification) will give the Market the right to reassign another vendor to your location for upcoming booked dates. Vendors with more than one last minute cancellation (defined as cancelling with less than 48 hours), will give the Market the right to remove the vendor from future bookings.

MARKET: Runs year-round, closed for inclement weather to protect the safety of our vendors and patrons. If the market is canceled due to bad weather conditions on a chosen date, the vendor will receive a credit for that day and be able to choose an alternative future date.

JANUARY, FEBRUARY, MARCH, APRIL & MAY.

After your application is reviewed and approved, we will send you an invoice for payment in the method

Space Size is 10 ft x 10 ft- (Please let us know the # of spaces needed)

I expressly acknowledge that the permission granted hereunder is freely revocable by the Market Manager and in view of such fact, / expressly assume the risk of making any expenditures in connection with this permission, evenif such expenditures are substantial. Without limiting any obligations of myself or other waivers contained in this permission and as a material part of the consideration for this permission, / fully RELEASE, WAIVE and DISCHARGE forever any and all claims, demands, rights and causes of action against, and covenants not to sue, Fontastic Gardens of Long Island and the Market Management, its departments, commissions, officers, directors and Employees, and all persons acting by, through or under each of them, under any present or future laws, statutes, or regulations, in the event that the Market exercises its right to revoke or terminate this permission. / understand and agree that neither the Fantastic Gardens of Long Island Property nor the Fantastic Gardens Market or Market Manager, shall be held responsible or made the subject of any claim for damages or liability arising from personal injury, property damage or loss of any sort to me, my guests, my customers, or any other person or loss of any other sort arising out of or related to participation in programs at the Fantastic Gardens of Long Island Market. / HEREBY AGREE TO FULLY RELEASE, INDEMNIFY AND HOLD HARMLESS THE Fontastic Gardens of Long Island, Fantastic Gardens Market and the Market Manager.
