    THIS AGREEMENT, for good and valuable consideration receipt of which is hereby acknowledged, dated   Pick a Date*   made by and between CALIFORNIA HORSE CENTER and MONTY AND PAT ROBERTS INC, hereinafter referred to as "STABLE", located at 901 East Highway 246, Solvang, CA. 93463, and        of                  hereinafter referred to as "BOARDER."

    These parties warrant that they have the right to enter into this agreement.   

  • 1. FEES, TERMS AND LOCATION

    BOARDER shall pay STABLE for boarding services as selected below:

  • NB. Feed pricing is based on current market price per pound. Subject to change in line with market fluctuations. 

    Equines fed less than 21 lb Alfalfa or 12 lb Orchard, or a combination thereof, will be billed at the minimum feed rate of $160 per month.

    For equines requiring additional supplementation, supplements can be fed with any meal provided they are supplied by BOARDER, prepacked in single doses inside an animal-proof container. 

  • Additional Services
  • In consideration of the aforementioned amounts paid by BOARDER in advance on the first day of each month, STABLE agrees to board the herein described equine on a month-to-month basis commencing   Pick a Date*.   

    At the commencement of this agreement, BOARDER agrees to pay the sum chosen above and also agrees to pay a deposit (equal to the monthly boarding and feed rate) with the first payment. If Boarding Fee increases during the term of this Agreement, BOARDER agrees to increase Security Deposit by the same proportion as the increase in Boarding Fee.

    Monthly charges are to be paid on the first day of each month. Payment is late by the fifth of the month. BOARDER agrees to give at least a 30-day written notice to terminate this agreement. If the equine leaves STABLE earlier, BOARDER agrees to pay the remainder of the 30 days of board. Deposit is refunded on final payment of all outstanding fees due.

    Late Fees: Boarding fees paid between the sixth and fifteenth day of the current month due will be subject to a late fee of $15.00. Fees received after the sixteenth will be subject to a late fee of $25.00. 

    BOARDER agrees to pay (on presentation of invoice) for any additional services, as may be requested from time to time, at the rate quoted by STABLE including, but not limited to, additional feed and/or bedding, ad-hoc stall board, holding horse for farrier or vet, short-term trailer parking, hand-walking, training or other exercise.

  • 3. VACCINATIONS & VETERINARY DISCLOSURE STATEMENT

  • All equines on premises must be up to date with their core vaccinations. Flu vaccine and Rhino must be administered at least 14 days prior to moving into this stable. A typical 5-way immunization injection (Tetanus, Eastern and Western Encephalitis, Rhino, Influenza) is recommended.
     
    All vaccination records must be received in office prior to equine entering STABLE. All records must be either a written receipt or an official vet statement showing vaccinations. No verbal records will be accepted. All vaccinations must be kept current during the equine's stay at STABLE.

    A negative current Coggins test is required for all horses arriving from out of state.
     
    At the commencement of this agreement, BOARDER agrees to allow STABLE access to any and all Veterinary information regarding boarded equine. This is true for any health concerns prior to boarding at this STABLE and during the equine’s time boarded at this STABLE. BOARDER must inform STABLE immediately of any and all Veterinary care that equine is receiving. In addition, BOARDER must inform STABLE immediately if equine is exhibiting any signs of illness such as nasal discharge, lack of appetite, noticeable swelling, temperature higher than 102 degrees.

    Copies of vaccination records (and proof of negative Coggins where needed) must be emailed to instructor@montyroberts.com prior to the equine's arrival date, or supplied in hard copy upon the equine's arrival. 

  • 4. FARRIERY & WORMING

  • All equines are required to be trimmed and/or shod as needed on a regular basis.
    BOARDER may designate a farrier upon approval from STABLE or a list of approved farriers can be provided. BOARDER is responsible for arranging all farrier visits directly with farrier, including any assistance needed (e.g. holding horse for farrier). All payment arrangements are to be made directly with farrier. 

     

    BOARDER is required to regularly deworm all equines boarded at STABLE. Deorming must be done on either a veterinary-approved worming schedule, or with fecal sampling. BOARDER is responsible for the arrangement and costs associated with deworming. 

  • 5. RISK OF LOSS

  • During the time that the equine(s) is/are in the custody of STABLE, STABLE shall not be liable for any sickness, disease, theft, death or injury which may be suffered by the equine. This includes, but is not limited to, any personal injury or disability the equine may receive while on STABLE's premises. BOARDER fully understands and hereby acknowledges that STABLE does not carry any insurance on any equines not owned by STABLE, including, but not limited to, such insurance for boarding or any other purposes, for which the equine(s) is/are covered under any public liability, accidental injury, theft or equine mortality insurance, and that all risks relating to boarding of equine(s), or for any other reason, for which the equine(s) is/are in the possession of STABLE, are to be borne by BOARDER. 

  • 6. HOLD HARMLESS

  • BOARDER agrees to hold STABLE harmless from any claim resulting from damage or injury caused by said equine, BOARDER or their guests and invitees, to anyone, including but not limited to legal fees and/or expenses incurred by STABLE in defense of such claims.

  • 7. LIABILITY INSURANCE

  • BOARDER warrants that they presently carry in full force and effect, and throughout the period of this agreement shall continue to carry and maintain in full force and effect, liability insurance protecting BOARDER and STABLE from any and all claim(s) arising out of or relating to this agreement. 
     
    BOARDER agrees to verify and take responsibility to ensure that all people having contact with equine(s) have signed a provided release at the facility entrance. BOARDER acknowledges the expectation of conduct and agrees to be bound thereby.
     
    BOARDER understands that minors, 14 and under, must have adult supervision.
     
    BOARDER agrees that by signing this form, they have read and understood the entire written boarding agreement and Appendix A. If BOARDER is found to not be adhering to all codes of conduct outlined in this agreement, STABLE can require BOARDER to move their equine(s) off of STABLE property immediately.

  • 8. EMERGENCY CARE

  • STABLE agrees to attempt to contact BOARDER, at the following emergency telephone number    *   *   or          should STABLE feel that medical treatment is needed for said equine,  provided however, that in the event the STABLE is unable to so contact BOARDER within a reasonable time, which time shall be judged and determined solely by STABLE, STABLE is then hereby authorized to secure emergency veterinary care and/or farrier care, and by any licensed providers of such care who are selected by STABLE, as STABLE determines is required for the health and well-being of said equine. The cost of such care secured shall be due and payable by BOARDER within fifteen days from the date BOARDER receives notice thereof, provided however, that STABLE is authorized to arrange direct billing by said care provider to the BOARDER.

    BOARDER agrees to notify STABLE of any and all change of addresses, emergency telephone numbers, itineraries or other information reasonably necessary to contact BOARDER in the event of an emergency. In the event BOARDER departs for vacation or is otherwise unavailable, prior to departure BOARDER shall notify STABLE as to what party is authorized to make decisions in the BOARDER'S place with regard to the health, well-being, and/or medical treatment of the equine.

    LIMITS OF CARE
    If STABLE is unable to contact BOARDER and emergency veterinary and/or farrier care exceeds  $ , BOARDER gives STABLE permission to discontinue care and/or euthanize equine, if veterinarian recommends it. STABLE agrees that by leaving the limits of care section blank, STABLE shall not put a limit on emergency veterinary care for the horse. 

    If this section is left blank, STABLE shall assume there are no limits of care, and BOARDER will be responsible for ALL veterinary and/or farrier expenses.

     

  • 9. FACILITIES USAGE

  • With the exception of boarders opting for the 'retiree' pasture board rate, use of the following facilities by BOARDER’S horse(s) are included in the monthly boarding agreement at no extra charge:

    • Mountain Trail course (after an approved lesson and/or clinic)
    • Bridle paths
    • 5/8 mile track
    • Covered arena
    • Large outdoor arena
    • 100 x 100 arena
    • Round pen 2
    • Round pen 3 
    • Washer & dryer 

    Use of the following facilities and areas are excluded from the monthly boarding rate but may be available at an additional charge:

    • Round pen 1 (opposite Learning Center entrance)
    • Learning Center school area (Gentling Facility, round pen and stalls at west end of property)
    • EuroXciser
    • Wellness Center
    • Pastures and pens for turnout*

    *Stall-boarded horses are turned out daily by STABLE staff on a planned rotational schedule, therefore BOARDERS are requested to check with staff as to location of horse(s) if not in stable, and to not turn out horses into any arenas, pens, pastures or turnout areas. Pasture-boarded horses do not have access to additional turnout areas. 

  • 10. STABLE RULES

  • STABLE is a violence-free facility. BOARDER abides by the Monty Roberts concepts which prohibit the abuse of a horse at any time, no hitting, no whips for pain, no unnecessarily harsh handling. We welcome all skill levels, breeds, disciplines and questions. We do not tolerate whipping or any other form of violent training. We believe the more you know, the gentler you are, and we are always happy to help you build trust and achieve outstanding results.  

    BOARDER hereby acknowledges receipt and understanding of the current STABLE Rules which are incorporated by reference in full in Appendix A, as if fully set forth herein. BOARDER agrees they and their guests and invitees will be bound and abide by these Rules, and accepts responsibility for the conduct of their guests and invitees according to these Rules.  

  • 11. DEFAULT

  • Either party may terminate this agreement for failure of the other party to meet any material terms of this agreement, including but not limited to Appendix A Stable Rules. In the case of a  default by one party, the other party shall have the right to recover legal fees and expenses, if any, incurred as a result of said default. Any payment due STABLE under this agreement shall be due and payable by the tenth day of the month and immediately in the event of termination. Failure to make any payment by said due date shall place BOARDER in default hereunder. Acceptance by STABLE of any late payment shall not constitute a waiver of subsequent due dates or determinations of default.  

  • 12. NOTICE OF TERMINATION

  • BOARDER agrees that thirty (30) days notice shall be given to STABLE as to the termination of this agreement. If BOARDER fails to stay current on bills for 60 consecutive days STABLE will consider it the BOARDER’S 30-DAY NOTICE of vacating STABLE.
     
    THIS AGREEMENT IS SUBJECT TO THE LAWS OF THE State of California.

  • APPENDIX A, CALIFORNIA HORSE CENTER CONDUCT RULES 
    BOARDER acknowledges the Rules include but are not limited to:  

    • Smoking is not allowed in any area on the property but safely at the Smoking corral. 
    • STABLE discourages bringing dogs on the property but if necessary, they must be on a leash at all times and can not be left unattended.
    • Anyone who intends on riding or working a horse on the premises must sign a liability release. This includes anyone BOARDER has invited to the CHC for any reason. All BOARDERS are responsible for getting a release signed by any person who will have contact with their horse.
    • Round Pens are not to be used as turnout pens. Please adhere to a 30-minute time limit when working your horse and others are waiting. Do not leave your horse unattended.
    • Do not ride in the turnout pastures. 
    • Any of our arenas can be used by boarders (with the exception of Round Pen 1 and the “school area” as defined in point 8) as long as we do not have an event or a ride group reserving an arena, which will be posted.
    • Children 18 and under must have a parent or guardian with them on the premises. They must be present and attentive at all times while children are interacting with equines in any way.
    • Helmets are optional, but California Horse Center strongly recommends always wearing a helmet when riding. Helmets are required for jumping regardless of age.
    • BOARDER is responsible to clean up after their horse whenever it is clipped, shaved, brushed, sprayed, thinned, or any piles in the aisle.
    • On the wash rack, always clean up after your horse and make sure to turn the water off.
    • Do not wash manure or hair down the drains.
    • Do not leave your horse alone in the barn while cross-tied. 
    • Do not tie your horse in the aisle or to stall fronts.
    • Do not store blankets, boxes, or any tack not used on a regular basis in the tack room. 
    • Any kind of feed other than hay (incl grain, supplements, treats) must be kept in the feed room and be stored in sealed containers to keep rodents under control. No feed of any kind in the tack room.
    • No ‘borrowing’ other’s hay, grain, or any other item without prior permission from the owner.
    • Be kind to others. Mean or rude behavior towards others is absolutely unacceptable and grounds for being asked to leave. We aim for a positive, stress-free environment for horses and humans.
    • Do not dump old hay, hay strings, or trash in the muck buckets or manure pile because it is composting to go back on the fields. 
    • Boarding barns are strictly for horses boarded here at CHC. No outside horses are allowed in the boarding barns at any time. This is to aid the biosecurity of the facility.
    • BOARDER Parking is in designated areas, closer to the barns.
    • Trailer parking is $50 per month. Please speak with the office to register your trailer. Other vehicles may not be stored on the property.
    • Please adhere to a 10 mph speed limit when driving on CHC property.


    STABLE may revise these Rules from time to time and BOARDER agrees any revision shall have the same force and effect as current Rules. Failure, as determined in STABLE’s sole discretion, of BOARDER or BOARDER’S guests and invitees to abide by STABLE Rules may result in STABLE declaring BOARDER in default hereunder and result in termination of this agreement.
