Copyright for Open Science (C4OS) Series | Workshop 3

Can we think of a Copyright system that provides equitable compensation to all involved parties, while maximising access to scientific resources and ensuring sustainable value production? Is the solution within the existing Copyright system or shall we look outside of it? Is Copyright reform attainable, and if yes, should it be incremental or radical? Finally, are new forms of legislation, such as data governance policy and legislation (from Open Data to Platform regulation), providing us with a new framework of thinking as to how we could achieve the desired balance between different copyright holders?

The Copyright for Open Science (C4OS), an initiative of OpenAIRE aims at addressing these questions in a series of three meetings/ workshops, where legal scholars, policy makers, publishers, creators, researchers and information scientists share their views as to how an equitable, sustainable and just model for Open Science may be achieved.

The series will conclude in a full day face-to-face event at the Onassis Stegi premises. Key points from the previous workshops will be summarized leading up to a keynote speech by John Willinsky

INFORMATION ON THE PROCESSING OF PERSONAL DATA IN THE CONTEXT OF THE EDUCATIONAL PROGRAMS OF THE ONASSIS FOUNDATION

We, the company ARIONA HELLAS S.A. located in Athens (at 2 Galaxia & Evridamantos Street) acting as the representative of the Alexander S. Onassis Public Benefit Foundation in Greece ("we" or "the Company"), will collect under the capacity of "controller" the data you provide to us ("Data") for your participation in the Onassis Foundation's Innovation Programs ("Innovation Programs") in accordance with the applicable legislation (Regulation 2016/679, Law nr.4624/2019 as in force) and the decisions and guidelines of the competent supervisory authority.

For the realization of the Innovation Programs, we collect the data necessary and indicated in the relevant participation forms that we send you or in supplementary documents, and in particular identification and contact data or information concerning your participation in the Innovation Program. Please note that in some Innovation Programs, which take place either through physical participation or remotely by electronic means (such as through video conference), there may be video and/or audio recording.

We do not collect special category data, except in exceptional and individual cases and only where it is required due to the specific circumstances of the respective Innovation Program (such as data on the existence of any special needs, disabilities) and provided that we have your explicit consent, unless the processing of such data is ordered on another legal basis, such as the compliance with a legal obligation or concerns data that you have obviously made public.

If you provide us with third party information (such as teachers’ data) you undertake the responsibility and warrant that you have taken all actions necessary for the lawful collection and transmission of such information to us, including the provision of this Ιnformation Notice to such individuals.

We will process your Data in order to enable you to participate in and realize the Innovation Programs. Due to the educational and artistic nature of the Innovation Programs, in cases where there will be image and/or sound recording, and unless you have otherwise granted to us a copyright license on such, we will display any material produced, subject to your consent, to the general public in the context of the promotion of our activities and actions through means of our choice, such as through our websites, social media, print, mass media or even online platforms such as YouTube.

We hereby inform you that your contact details (email), unless you indicate your objection to this, will be retained by the Company in order for the latter to send you newsletters about our educational activities, while you can revoke this decision at any time.

The said Data will be held and processed for the above purpose by our competent departments and personnel who handle the organization and promotion of the Innovation Programs and the Company's communication of our actions, as well as by third authorized partners and entities cooperating with us in the realization of the Innovation Programs, who will act as "processors" and will be bound by confidentiality obligation and other obligations defined in contracts and / or legal acts exclusively for the provision of services to us and not for their own benefit. For the purpose of carrying out the Innovation Programs, we may transfer your Data to our third party partners (such as, indicatively, and depending on the case, to photographers, travel agencies, ticketing system management providers).

We will collect and retain such Data for the entire duration of the Innovation Programs and after the realization of such Programs for the fulfilment of the purpose for which the Data was provided and in order to comply with our contractual and legal obligations, such as for as long as the relevant license to use and exploit any material produced may be valid, taking into consideration the requirements of the legislation in force, the limitation periods for bringing legal actions and our corporate purposes.

In case we do not receive all the information deemed necessary, we will not be able to fulfil the purposes stated herein and therefore we will not be able to include your participation in the Innovation Program.

You have the rights granted to you, under the specific terms and conditions therein, by law, and in particular, the right to be informed of and have access to your data that we will process, the right to rectification and/or erasure of such, the right to object to or request the restriction of the processing we do, the right to the portability of the data to another controller or processor. Where processing is based on your consent, you have the right to withdraw that consent at any time. The withdrawal of any consent you may have given will only be valid for the future and any processing that was carried out on the basis of that consent will remain lawful until its withdrawal. We will be able to retain and process as much Data as necessary, even after the withdrawal of consent, to the extent required or otherwise permitted by law and in particular in order to comply with our legal or regulatory obligations and/or to exercise and defend our legal rights.

The exercise of such rights should be done in writing by sending the relevant request to the email address gdpr@onassis.org to the attention of the Company's Data Protection Officer. In case you disagree with our processing of your Data and/or our response to your request, as described above, you are entitled to address a request to the competent supervising authority (the Personal Data Protection Authority), which, within the scope of its competence, will deal with written complaints in accordance with the instructions contained on its website (www.dpa.gr).

I hereby grant to ARIONA HELLAS S.A. (a company located in Athens, at 2 Galaxia and Evrydamanos Street, which acts as the representative of the Onassis Foundation in Greece and the manager of Onassis Stegi) and to the co-organizers a non-exclusive copyright license on my participation in the series of Workshops, under the terms and conditions set forth herein.
COPYRIGHT LICENCE

I, the undersigned, in my capacity as speaker and copyright holder of my presentation in the context of the workshop "Copyright for Open Science (C4OS) Series" (hereinafter referred to as "Workshop"), acknowledge and agree that the Workshop (as conducted online through Zoom digital platform) will be recorded and thus by virtue of this agreement I hereby grant to ARIONA HELLAS S.A, a company legally established in Athens, at 2 Galaxia and Evrydamantos Street, acting as the representative of the Onassis Foundation in Greece and the manager of Onassis Stegi ("Ariona"), as well as to co-organizers and supporters, a non-exclusive copyright license of all my rights in my presentation within the Workshop, in order for either one of the aforementioned licensees acting alone or all of them acting jointly:

(a) to record and direct or indirect reproduce such recording containing my performance/participation in the Workshop, temporarily or permanently, in whole or in part, by any means or in any form, in any media available now or in the future and on any tangible or intangible material carrier, for any lawful use, commercial or non-commercial, educational, archival or other

(b) to translate, dub and/or subtitle my speech in the context of the Workshop and to make any adjustment or alteration to the recording as required, for any lawful use, commercial or non-commercial, educational, archival or other

(c) to broadcast or rebroadcast to the public my participation in the frame of the Workshop as recorded (in extracts or in its entirety) on the material carrier by radio, television or through any online channel such as Onassis Channel or any channel chosen by the co-organizers and supporters, on any digital platform such as indicatively but not limited to YouTube, through any online music platform such as but not limited to SoundCloud, or by any other means such as electromagnetic waves, satellites, cables or by any other means parallel to the surface of the earth, by any known or unknown means, etc.,for any lawful use, commercial o non-commercial, educational, archival or other

(d) distribute the material carrier on which my participation in the frame of the Workshop has been recorded to any third party, to any organization, to the mass media as well as to the general public, by sale, public or private loan or in any other way, for any lawful use, commercial or non-commercial, educational, archival or other

(e) present to the public my participation as recorded in the frame of the Workshop to the material carrier through any online channel chosen by any of the licensees on the digital platforms YouTube, Facebook, Instagram, or by any other means for any lawful use, commercial or non-commercial, educational, archival or other and to make it available to the public by wired or wireless means or in any other manner so that anyone can access it at the time and place of their choosing (on demand), for temporary reproduction or for downloading from any website of any of the licensees, for distribution on online digital platforms, through any new digital technology and media and via the Internet, etc. etc., regardless of the technical means (computer, mobile device or other), for any lawful use, commercial or non-commercial, educational, archival or other

(f) include photographs or videos of my participation in the frame of the Workshop in any printed materials, audiovisual representations and extracts thereof, including screenings, public distribution and use and distribution of the material as part of other works. Promotion includes in particular the creation of videos showing how the Workshop was created ("making-of") for promotional, advertising and educational purposes, for archival purposes or for any other lawful use.

This copyright license is granted in perpetuity (i.e. for the entire duration of the copyright protection provided by law), is effective worldwide and covers all videos containing my participation that will be recorded during the course of the Workshop.

All of the above rights may be exercised by Ariona or its co-organizers and supporters, each acting alone or jointly, in their sole and absolute discretion, for any lawful use, whether commercial or non-commercial, in the context of promoting their activities and their cultural fields, for archival purposes or for any other lawful use, without restriction as to the means, number of uses and manner of exploitation.

I hereby acknowledge and agree that:

- all of the aforementioned licensees are in no way obliged to exercise any of the powers granted herein, the exercise of which is a right and not a duty or obligation of any of them, and the exercise of which remains in their sole discretion.

- in no event shall I be entitled to any fee or remuneration of any kind from any of the Licensees for the use by the Licensees of the above recording of my participation in the Workshop.

The present license is governed by Greek Law and for any dispute that may arise between the parties in relation to it, the Courts of Athens shall have exclusive jurisdiction.
We would like to inform you that the event venue is being filmed on behalf of Ariona Hellas SA (Galaxia 2, Athens, 117 45) representative of the Onassis Foundation in Greece. There will be a live broadcast of the event, and we will process the audiovisual material that will be produced in the context of the promotion of our activities and actions with means of our choice, such as through our websites, social media, print, mass media or even on-line platforms, such as our YouTube channel.
