A $20 fee per plot is due with your application, which helps
offset the cost of water used.
* Plots are 20 x 30 feet.
* A maximum of 3 plots per household will be assigned.
* Plots will be available after April 15th
(date will be emailed out & on Facebook)
* Tilling will only be provided once in the spring.
* Gardeners must have all plots planted no later than June 1st to avoid reassignment of their plot.
* Fencing to mark individual plots will not be allowed.
* Plots are to be gardened by person making application and MUST NOT be reassigned without permission of City Hall.
* Hydrants are onsite - Hoses will not be provided! Do NOT leave water running unattended or there may be a surcharge assessed for extra water used.
AGREEMENT AND WAIVER OF LIABILITY
I agree to be responsible for keeping the plot assigned to me as clean and neat as possible: supply my own seeds, fertilizer, and equipment; water my own lot, use cultivation and mulches to control weeds, use only approved herbicides and insecticides, and to keep the plot free of any unlawful or obnoxious plants.
I agree that the assignment of the plot to me constitutes only a license to use the assigned plot for household garden purposes and does not convey any estate in the plot. freehold or otherwise. While the assignment does not convey the right to use the plot in future years the City will attempt to assign the same plot when requested.
Waiver and Hold Harmless Agreement - I hereby knowingly and voluntarily waive any claim or claims I may have against the City of Emmetsburg or any of its officers, agents or employees for any injury or damage sustained by me or anyone arising out of the condition or use of the garden plot assigned, or use of city equipment, including damage to or destruction of the plants or produce of the garden. I understand and agree that the City of Emmetsburg makes no warranty or guarantee of the fitness of the plot for garden purposes.
By October 15, 2025, I will remove all garden refuse, stakes, cages, or other items. If such items are not removed by October 15, 2025, I hereby forfeit my garden plot for the 2026 gardening season.
