- YOUR EMPLOYER HAS 30 DAYS "AS GOOD FAITH COMPLIANCE" TO RESPOND TO YOUR REQUEST
QUALIFIED W2 EMPLOYEES
IF YOU WERE QUALIFED TO RECIEVE COVID-19 PAID SICK LEAVE AS A W2 EMPLOYEE from April 1st - December 31st 2020, YOUR EMPLOYER MAYBE REQUIRED TO ISSUE YOU A ENTITELMENT CHECK. (MORE THAN WHAT YOU RECIEVED AS A CREDIT IN YOUR TAX REFUND)
YOUR EMPLOYER IS THEN REQUIRED TO PROVIDE VERIFICATION TO THE IRS THAT YOU WHERE QUALIFIED FOR COVID-19 PAID SICK LEAVE AS AN W2 EMPLOYEE AND NOT AS THE EMPLOYER/BUSINESS. (Business name on your W2).
ONCE THEY HAVE UPDATED THIER RECORDS WITH THE IRS, YOUR EMPLOYER IS THEN REQUIRED TO ISSUE YOU AN UPDATED W2 WITH A COVID-19 PAID SICK LEAVE CODE PROVIDED ON IT FOR YOUR TAX RECORDS. THIS INFORMATION NEEDS TO BE UPDATED ON YOUR 2020 AND 2021 W2.
NON QUALIFIED W2 EMPLOYEES
IF YOU ARE NOT A QUALIFIED W2 EMPLOYEE FOR COVID-19 PAID SICK LEAVE, YOUR EMPLOYER MUST PROVIDE YOU A WRITING STATEMENT TO:
- PROVIDE TO THE IRS AS PROOF YOU DID NOT QUALIFY AS A W2 EMPLOYEE FOR COVID-19 PAID SICK LEAVE ENTITILMENTS AND PROVIDE AN UPDATED W2
- PROVIDE THE IRS WITH AN UPDATED PAID SICK LEAVE FORM THAT REPORTS YOU AS THE EMPLOYEE AND NOT THE BUSINESS/COMPANY (Business name on W2)
- YOUR EMPLOYER MUST PROVIDE YOU A STATEMENT OF QUALIFICATIONS EITHER WAY TO PROVIDE TO THE IRS AND ASSIST WITH YOUR IRS PAID SICK LEAVE NOTICE CLAIM.
