Session Fees and Payment
For sessions held with Lindsay Maahs Photography, a $50 retainer is due to reserve your session. Retainers are non refundable, but are transferable to a different session, date & time. The remaining session total is split into two payments. The first is due the day of your session and your final payment is due when your final selection is finished and ready for pick up. Payments can be made by cash, cheque (Lindsay Maahs Photography) or email transfer. Images will not be edited or relased until paid in full.
* For maternity session add-on packages, remaining balance after $50 retainer is paid, is split into 3 payments. The first is due the day of your maternity session, second at your newborn session and final payment is due when your final newborn selection is finished and ready for pick up.
Exclusivity
It is understood that Lindsay Maahs Photography is the exclusive official photographer retained to perform the photographic services requested on this contract. Behind the scenes photos from a cell phone are welcomed, but professional equipment used by the client is not permitted within the studio.
Image Minimum
Image minimum is a gallery consisting of at least 13 images for Newborn Sessions, 23 images for Newborn + family Sessions, 13 images for 13 images for Petite Newborn Sessions and 18 images for Maternity add-ons. If the expected image minimum cannot be met, due to an unexpected circumstance at the fault of the photographer before, during or after the scheduled session - this may include but not limited to, equipment failure both during the session or post production, sickness or unexpected accident - Lindsay Maahs Photography will agree to a re-shoot of the purchased session. If the expected image minimum, cannot be met due to client’s failure to provide reasonable assistance or cooperation, or if lateness results in a shortened session Lindsay Maahs Photography holds no liability and no further actions shall be taken.
Session Duration
It is up to the photographers discression to reschedule due to an unsettled infant. Often times if the little one is not settled within the first half of the session, rescheduling may be suggested.
Studio
It is understood that the home studio of Lindsay Maahs Photography is a pet friendly environment. All animals will be kept on a different floor and will not come into contact with clients. Please advise Lindsay Maahs Photography of any allergy issues.
Lateness
Client lateness may result in a shortened session at the photographers discression.
Illness
There is a strict no illness policy within the home studio of Lindsay Maahs Photography. Sessions MUST be rescheduled if clients have a cough, cold or flu.
Cancellation / Rescheduling
If an illness or situation prevents a photo session from taking place, client may reschedule their session at least 24 hours prior to their shoot once without penalty. Should client fail to give 24 hours notice, a $50 fee may be required for rebooking. If client decides to completely cancel the session, the retainer fee is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness or other circumstances beyond their control. Re-shoots are determined at the discretion of the photographer. Re-shoots will not be given for poor choices of clothing, make-up, hair or lack of cooperation by children or family members.
Covid - 19 Exceptions
If a SUSPECTED case of Covid-19 is the cause of the photography session not taking place - photographer or client - the session will be rescheduled, no earlier than 14 days from the original session date and no later than 1 year from original session date.
If a CONFIRMED case is the reason for the photography session not taking place the session can be rescheduled or the retainer returned with no penalty to the client.
Poses / Session Minimum
Since newborn photography is highly dependant upon the infants ability (mood, flexibility, sleepiness) specific poses are not guarenteed, but every effort is taken to provide variety within the gallery.
Proofing Gallery / Final Selection
The collection of images within the online proofing gallery will be a selection of the best images from the session. Selections will be made at the photographers discression using professional judgement. Requests to view every image from the session will not be upheld. Online proofing galleries will be available for 10 days - Final selections must be made within that time. If a gallery is left to expire, before final selections have been made, a $25 reloading fee will be required. RAW / unedited / proofing gallery images will not be released and are not available for purchase. Proofs within the online gallery will include basic editing and colour corrections. Final high resolution images delivered will include professional editing, artistic enhancements, basic retouching of blemishes, scars and softening of under eye circles - at the photographers discression according to creative vision. Additional retouching requrests may be discussed with the photographer and may require an additional fee for services. Final selections delivered via digital download must be downloaded within 10 days of delivery.
Social Media
Only images with the ‘Lindsay Maahs Photography’ logo may be used on social media sites or if watermarked images are unavailable, credit must be given to Lindsay Maahs Photography.
Digital Media Storage
Client is aware that digital media may deteriorate over time and it is the clients responsibility to create back up copies of final high resolution images delivered. Lindsay Maahs Photography is released from any liability for any claims based on deterioration or loss of files by client. Images will be kept by Lindsay Maahs Photography for 6 months after images are delivered and are not guarenteed to be archived longer. Additional charges will apply for additional copies, retrieval of images once archived, along with reposting of galleries after they have expired.
Products
Product prices will be honoured up to 3 months following the release of images. Product prices are subject to change without notice. Product discount that is included in sessions cannot be used to purchase additional digital files or digital collections. There is a $50 minimum order required when orders are placed.
Copyright
Lindsay Maahs Photography retains all copyrights to all images created during client’s session and reserves the right to use all images taken for any lawful purpose - this includes , but is not limited to advertising, marketing, promotion and publishing to social media sites, blogs or websites. Limited permission and print release will be given to the client for personal use only - personal printing of high resolution images and limited use on social media sites (watermarked versions or photo credit to Lindsay Maahs Photography). Editing, cropping, adding filters or using the images for anything outside of personal use - including, business promotion or other - is strictly prohibited.
Liability
The client will release Lindsay Maahs Photography of any liability due to injury caused during the session. It is agreed that all children and pets not be left unattended during session and that parents will provide assistance if needed to maintain a safe pose within a prop.
