    STEP 1 - Download "F45 Training" App

    You should now see all the upcoming classes.

    Click Profile > Create > Enter Details

    Note - this will create a "MindBody" account. MindBody is the management platform F45 uses to manage membership. If you already have a MindBody account you can just "sign in" using your existing credentials.

     

    It may require you to "Verify" your email address. Open the email in your email client to verify.

    Terms and Conditions

    1. Suspensions and Cancellations

    F45 understands that from time to time you may not be able to train due to holidays, rest periods, becoming sick or injured or wish to cancel your membership altogether. The following rules apply to suspensions and cancellations:

    Suspension:
    Memberships can be suspended at any time with 2 weeks notice.

    1 Week Minimum - 4 Week Maximum suspension per calendar year. If you require longer than 4 weeks there will be a $10 per week holding fee for the duration of the weeks required.

    Suspension periods will not count towards your contractual minimum term, and will extend any applicable minimum term by the number of suspended weeks taken. Membership may not be suspended during the notice period of a cancellation request. Suspensions cannot be backdated Pro-rata suspensions are not allowed (i.e. outside of the normal weekly billing cycle).

    Cancellation:
    Notification period: To cancel your membership month to month agreement we require
    * 30 days notice via email request to the studio
    * Complete the 'membership cancellation form" with all details required to action your cancellation.
    * Your 30 days notice will begin once the studio has received your membership cancellation form.
    * Membership payments will be required to be paid as per agreement until your 30 day cancellation date.
     
    Cancellation - Within 6 Month Contract:
    6 Month Membership - 30 days notice + $220 cancellation fee.

    After 6 month agreement is met, standard 30 days notice via email to cancel.

    A cancellation fee does NOT apply under the following circumstances: Sickness/Injury resulting in not being able to train for remainder of contract (must provide Doctors certificate).

     

    Cancellation - Within 3 Month Contract

    3 Month Membership - No suspension or termination available during the 1st 3 months. 

    Challenge Memberships:

    Challenge 6 week Pass - No suspension, extension or refund on this pass. Upfront payment of $449 only, includes 6 weeks access + 2 x Inbody Scans for the Challenge.

     

    Class Pass Purchases
    No refunds
    No suspensions or extensions on expiry dates.

    Class Pass Expiry Dates
    10-20 class packs = 3 months expiry from payment.
    30-50 class packs = 6 months expiry from payment.

     

    2. Class Booking & Class Cancellation Policy

    In the event that you book into a class and do not turn up, this is considered a "NO SHOW" or "LATE CANCELLATION". Your account will be charged a $5 dishonour fee with no notice. 

    DEFINITION OF A LATE CANCELLATION:
    - If you are booked into the first 3x AM sessions, you MUST cancel BY 9:00pm the night before. 
    - If you cancel your booking within 60 minutes of a session starting this is considered a 'late cancellation'

    Bookings for sessions open 7 Days in advance.

    3. Your Health

    You warrant that you are in good physical condition and you know of no medical or other reason why you cannot or should not do active or passive exercise. You recognise that the fitness instructor(s) is not able to provide me with medical advice with regard to my fitness, and that this information is used as a guideline to the limitations of my ability to exercise. I agree to not hold any certified trainer or directors of F45 liable for any injury that may occur during an F45 session.  
    If you are unwell or having any virus symptoms you will not risk the health of our staff or members by coming into the studio. Please contact the studio IMMEDIATELY if you test positive to COVID-19.

    4. Waiver Form

    You agree to sign a waiver form with F45 upon creating your profile with the F45 APP. Please read through this very carefully.

    5. Paying for memberships

    Membership fees are paid in advance, weekly, by direct debit from a credit card or bank account.

    6. Meeting Your Responsibilities

    You must make sure: your account can accept direct debits, there is enough money in your account on the payment day, you tell us if you are transferring or closing your account at least 72 hours before the next direct debit, you tell us about any changes to your credit card, such as its expiry date or number, at least 72 hours before your next debit. Fail to have funds in your account, F45 is not accountable for the insufficient fund fees that may occur from EZYdebit and / or your bank provider.

    7. What happens if your payment is declined or fails for any reason?

    If you do not fully pay your fees on the due date, F45 will suspend access to F45 until any outstanding balance has been paid and you have given us your updated account details if they are required. F45 will continue to debit your nominated account without notice, until F45 have received the total amount you owe F45. F45 will make a reasonable effort to advise you on the status of the failed payments by letting you know beforehand by: writing to the email address you provided For membership/s in your name, you must make sure that the payment method you choose remain valid for the length of your agreement. This includes third-party accounts. If the details you give us fail, you are liable for all resulting fees. You should update your details and are obligated to complete your minimum term of payments. If you fail to clear your owing membership payment after 3 days there will be a $10 dishonor fee automatically deducted from your account.

    8. Can F45 change your agreement?

    F45 may sometimes add to, change or remove our terms and conditions. This includes changing the opening and closing hours, the F45 services and facilities and membership fees. Sometimes, F45 may also close for refurbishment to improve the facilities. If this substantially reduces our ability to provide our service to you, F45 will reduce your membership fees accordingly on a pro-rata basis. The most up-to-date terms and conditions always apply. F45 will give you at least 28 days’ notice of any changes. If F45 do not fulfil our obligations to you, you may be able to cancel your membership. Unless the law states otherwise, you won’t have any other claim against us if this happens.

    9. Can F45 increase your fees?

    F45 reserve the right to increase your fees only at any time after your initial contract agreement has ended. F45 will make a reasonable effort to tell you about this at least 28 days beforehand by writing to the address you last gave us (which may be an email address). F45 will consider that you have received our letter or email on the second business day after it is sent. Where F45 have made a reasonable effort to let you know about a fee increase, you authorise us to increase any debits from your nominated account.

    10. Use of your image

    You agree to allow F45 Training to take a video or photo to use for promotion purposes from time to time. You agree to allow for your before/after challenge photos to be used on F45 social media platforms.

    11.  Minimum age

    The minimum age for training with us is 16 and over with Parent or Guardian Consent, or 18 years old.

    12. Children

    No children are to be on the studio floor while a session is in action. This is for the workplace health & safety of the children. If your child is old enough to be left unsupervised in our waiting area we are happy for this to occur, please speak to the studio directly for more details.

    Code of Conduct

    1. I will adhere to social distancing and ensure that I follow the reasonable directions of all F45 staff and trainers in relation to my participation in the F45 training sessions.

    2. I will diligently work to keep all equipment and stations clean following the directions provided by F45 staff and trainers.

    3. I will wash and sanitise my hands upon entering and exiting the studio.

    4. I will NOT enter the studio if I am feeling unwell, including (but not limited to): headache, fever, sore throat, nausea, sneezing, coughing and other cold and flu like symptoms.

    5. I do not have a temperature of 38 degrees, or higher when entering the studio. I agree that F45 staff may check my temperature using a non-contact digital thermometer.

    6. I acknowledge that if I am exhibiting symptoms referred to above, I may be asked to leave the Studio for the health and safety of all F45 staff, members and guests.

    7. If I contract or otherwise come into contract with a person who has, or is suspect to have, COVID-19, I will immediately notify my F45 Studio and otherwise refrain from attending the F45 Studio until there is no longer a risk of infecting any other person.

    I hereby acknowledge that I fully understand the above requirements and agree that I will at all times comply with the above requirements. I further acknowledge and agree that nothing in this Code of Conduct is intended to limit or otherwise modify the obligations and rights set out in my F45 membership terms and conditions, studio rules and any waivers or releases I have signed in relation to my attendance and use of the F45 Studio.

    Liability Waiver / Informed Consent

    I have agreed to participate in the F45 workouts, exercise and training programs (“Workouts”).

    I acknowledge and agree that the Workouts:
    • are a recreational sport activity; and
    • may involve strenuous physical activity including, but not limited to, muscle strength and endurance training, cardiovascular conditioning and training, and other various fitness activities.

    I hereby affirm, and I affirm each time I participate in a Workout, that:
    • I am in good physical condition and do not suffer from any known disability or condition which would prevent or limit my participation in this exercise program; and
    • I am participating in the Workouts voluntarily and at my own risk.

    I hereby release F45 Training Pty Ltd, F45 and their officers, agents and employees (the “Released Parties”) from any claims, demands, and causes of action as a result of my voluntary participation in the Workouts, to the extent permitted by law.

    I fully understand that I may injure myself as a result of my participation in the workouts and I hereby release the Released Parties from any liability now or in the future for conditions that I may obtain directly or indirectly from participating in the Workouts, to the fullest extent permitted by law. These conditions may include, but are not limited to, heart attacks, muscle strains, muscle pulls, muscle tears, broken bones, shin splints, heat prostration, injuries to knees, injuries to back, injuries to foot, or any other illness or soreness that I may incur, including death.

    COVID-19 Assumption of Risk and Waiver of Liability

    The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organisation . COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. F45 Training and the F45 franchised studios (“F45”) have done its best to put in place preventative measures to reduce the spread of COVID-19; however, F45 cannot guarantee that you will not become infected with COVID-19. Further, attending F45 could increase your risk of contracting COVID-19.

    By signing this agreement, you acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that you may be exposed to or infected by COVID-19 by attending F45 and that such exposure or infection may result in personal injury, illness, permanent disability, and death. You understand that the risk of becoming exposed to or infected by COVID-19 at F45 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, F45 employees and program participants.

    You voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to yourself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that you may experience or incur in connection with your attendance at F45 (“Claims”). You hereby release, covenant not to sue, discharge, and hold harmless F45, its employees, agents, and representatives, from the Claims. You understand and agree that this release includes any Claims based on the actions, omissions, or negligence of F45, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any F45 program.
