This document features important information in regards to your membership, please read this document carefully and thoroughly prior to signing.

I hereby elect to enter into this Membership Agreement with Learn N Play, LLC. located at 4127 NW 34th Steet, Gainesville, FL 32605, and abide by the following terms and conditions:

Terms and Conditions

MINIMUM MEMBERSHIP REQUIREMENT: All memberships have a three (3) month minimum commitment. In order to cancel your membership, please see the cancellation policy below.

PAYMENTS AND BILLING: Payments will be processed on the day you sign up for the membership and on the 1st of each month thereafter and will be charged automatically to the credit card or bank account on file.

AUTOMATIC RENEWAL: By intialing and signing this agreement, I authorize Learn N Play, LLC. to charge my credit/debit card or bank account for the Membership program. I acknowledge that the payment will be processed on the due date and it is my responsibility to maintain valid and current card/payment information with Learn N Play, LLC. or I will be responsible for any fees associated with a decline on my account. I agree that my failure to maintain valid and current card/payment information will constitute a default of this Membership Agreement (see "Declined Payment" policy section). If you do not wish for this Membership Agreement to automatically renew after the initial 3 month minimum, you must provide written notice of cancellation no less than two weeks (14) days prior to the conclusion of the then-current Membership Term.

DECLINED PAYMENT: If payment is declined for any reason, members will be given the option to make a payment no later than 3 business days after the payment is due. If payment is not made, a $50.00 late fee will be applied and any other card decline fees will be added to the account. After 1 week of non-payment or response from the member the membership will be in default and un-usable. Re-entry may only occur after the balance on the account has been paid in full.

CANCELLATION: Learn N Play, LLC. reserves the right to cancel this Membership Agreement. Circumstances for cancellation of the Membership Agreement could include, but are not limited to; noncompliance with posted rules, mistreatment of other participants, equipment or staff, etc. The Membership Agreement may be canceled by the Member at any time following the three month minimum, by providing written notice of cancellation to learnnplayllcfl@gmail.com no less than 14 days prior to the desired cancellation date. No refunds shall be due for any services available or rendered prior to cancellation. Partial months of memberships will not be pro-rated, therefore if a membership is canceled in the interim between membership terms, the member should expect to receive another billing.

OTHER TERMS OF MEMBERSHIP: Memberships and membership discounts are nontransferable to friends, family members, or any other party. Membership benefits (specific to the membership level assigned) apply to only those adult/minor members listed on this form at the time of enrollment. For family memberships - minors listed MUST be living in the immediate household. All membership fees/payments are exclusive to the membership and cannot be used towards any other Learn N Play services.

Membership fees are nonrefundable once they have been processed.

WAIVER AND RELEASE OF LIABILITY: Under Florida law, all indoor/outdoor activities at this location must be covered by a liability waiver. Learn N Play, LLC. is not liable for an injury to, or the death of, a participant in any activities resulting from the inherent risks of these physical activities.

Prior to Membership a Learn N Play, LLC. Liability Waiver MUST be completed for all particpants listed on this membership and be kept on file as long as the membership exists.

By signing below, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature.
