As a member I confirm that I have read and understand all MSKA rules and understand that I must follow all rules at every club event or face a possible lifetime ban.  By signing this form or acknowledging through a form of online registration, I agree to abide by all club rules.  I also relieve Mountain State Kayak Anglers (MSKA), Paddlesport Risk Management, LLC (PRM); their insurers, affiliates, co-partners, administrators, venue owners or any other person/entity (hereby referred to as "Releasees") utilized to facilitate an event of any and all liability.  I understand that I am competing in an uncontrolled environment and understand that Mountain State Kayak Anglers is not responsible for any injuries, deaths or loss of property when competing in an event.  I understand that I will not be monitored during the event in a capacity that protects my personal safety or property.

In consideration of being allowed to participate in any way, in the sports activity, related events and activities, the undersigned or digitally acknowledge member, acknowledges, appreciates, and agrees that: the risk of injury from the activities involved in this sport is significant, including the potential for permanent paralysis and / or death; and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury and death does exist; and, I KNOWLINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others and assume full responsibility for my participation.  If, however, I observe any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such hazard to the attention of the nearest official immediately; and, I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS, Mountain State Kayak Anglers (MSKA), Paddlesport Risk Management, LLC, their officers and directors, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE. 

Rapids & waterway navigation:

Competitors navigate rapids, waterways and/or current at their own risk.  No competitor should navigate a dangerous rapid.  Any dangerous rapids, especially over a class II should be avoided completely.  As a competitor, I recognize the danger of navigating any rapids, waterway and/or current.  I acknowledge that Mountain State Kayak Anglers or any representative of MSKA is not responsible for a decision to navigate a rapid.  I release MSKA, their representatives/affiliates from all liability in navigation of ANY waterway, current and/or rapids.

 

I also acknowledge that photographs and video may be taken of me in my participation in, and attendance at each event, and hereby freely agree to allow without restriction, all uses of such photos and videos in the reporting of the promotion of any event, its location, other sporting events, sport in general, and/or related purposes.  I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

As a legal guardian of anyone, especially those under 18, I understand and assume all risks for my minor in the same manner, described above for an adult member/participant.  I relieve MSKA of all liability for my minor as described above for a member/participant.  I also agree to and give the undersigned minor my permission to read and sign this form as well as assume personal liability for themselves.  I ALSO AGREE TO NOT LEAVE ANY MINOR UNATTENDED OR UNMONITORED DURING ANY/ALL MSKA events. 

 

All members, you will acknowledge this form via social media, in the “members group”.  You will also acknowledge this form and the rules when registering for an event, via TourneyX.

If any of the rules and/or agreements are not acceptable to you, please contact one of the MSKA administrators.

In addition to this form, all members will also be required to sign or digitally sign any waiver forms required by insurance providers of MSKA.
