Mary Market’s Sundancin’ Goldens

This contract is between Mary Chadwick and/or Ron Chadwick of Sundancin’ Goldens, hereinafter referred to as "Seller or Breeder" and {buyersName} and/or {cobuyersName} hereinafter referred to as "Buyer" residing at {address} in consideration of payment in full of the purchase price of ${purchasePrice} by Buyer to Seller, Seller agrees to transfer to Buyer, subject to the terms and conditions contained in this contract, the ownership of one {sex} collar color/temp name {collarColortemp} AKC registered Golden Retriever Puppy from Litter AKC #{litterAkc}, hereinafter referred to as "Puppy", born {bornOn} from the mating of Sire {sire} and Dam {dam} A ${depositPaid} deposit has been received toward the purchase price. The remainder of the balance ${balanceDue} is due at transfer on or about {approximateTransfer}.

Buyer's Acknowledgement

The Buyer, by signing this contract, acknowledges that he/she is aware that there are health problems that are common to the Golden Retriever breed. Some of these potential health problems are known to be genetic, some are believed to have some genetic predisposition, and the cause of others is unknown or random in occurrence. The Buyer further understands that the technology does not exist to predetermine most genetic outcomes of any breeding with respect to health, conformation, temperament, or performance ability. The Seller has also provided the Buyer sufficient information about diet that decreases the risk of disease-causing pre-geriatric death. The Buyer understands that the puppy will not be potty trained, and any training will be age-appropriate for the puppy within the litter. Buyer understands all training is the sole responsibility of the Buyer.

Buyer's Responsibility

1. The buyer agrees to conduct him/herself as a responsible Puppy owner.

2. Until all booster shots have been administered, it is the buyer's responsibility to protect the Puppy from fatal diseases by quarantining the Puppy from areas where unvaccinated dogs roam such as rest stops, dog parks, pet and hardware stores, restaurants, parks, hiking trails, beaches, sidewalks, etc. Basically, keep your Puppy off the ground except in your protected yard. Do not take your Puppy to dog shows, matches, or unprotected obedience classes until 3 rounds of vaccinations have been administered. It is the buyer's responsibility to ensure their Puppy receives all booster shots in 3–4-week intervals and state-required rabies vaccination at 6 months old.

3.  If the puppy dies before or after the 10 days, the owner is required to have a full autopsy performed to determine the main cause of death. If the new owner is found to be at fault, there will be no refund, if an autopsy is NOT performed there will be no refund and this contract ends with no further action or obligation from the Seller. In the event of health issues, not resulting in death, where the genetic condition is sufficiently serious in the opinion of two qualified veterinarians, at least one of whom is selected by the Seller, to warrant euthanasia of the dog within 1 year following the sale and physical removal of the dog, Seller binds themselves to one of the following:

   a. If Euthanized (CHOOSE 1):                                           
   

   i. Receive a replacement pup. The replacement will be of equivalent or better quality/price from the next litter of choice for up to 1 year. After 1 year from euthanasia, the contract is void.
   ii. Receive a refund of up to, but not greater than the purchase price (does not include any fee charges).

    
   b. If not Euthanized and corrective surgery is done (CHOOSE 1):
   

   i. Receive a refund for surgery receipts paid - up to, but not greater than the purchase price. If not Euthanized and corrective surgery is not a viable option for vets.
   ii. Receive a voucher for half of the price paid, to go towards a future puppy. The replacement will be from a future litter of equivalent or better quality/price. The owner has 10 years to use the said voucher.

4. Buyer agrees that Buyer is solely responsible for all costs and expenses of and related to the ownership of the Puppy including but not limited to feeding, veterinary care, and training.

5. Buyer further agrees that the Buyer is solely responsible for all actions of the Puppy and agrees to hold Seller harmless from any and all claims for Bodily Injury and/or Property Damages caused or alleged to have been by the Puppy.

6. The buyer agrees to provide the Puppy with a good and safe home and proper care and attention. The Puppy is not to ride loose in the back of pick-up trucks, is not to be chained, or be kenneled for over an hour, except while sleeping at night.

7. The Puppy is not to be a purely outside pet. When the Puppy is outdoors, it shall be provided protection from the elements by a dry, insulated, temperate, draft-free house. It is further agreed the Puppy shall be provided with shade from the sun and adequate food and water.

8. The Buyer agrees this Puppy will be examined by a licensed veterinarian at least once each year and will receive adequate vaccinations or titer tests, and treatments to ensure good health.

9. For the lifetime of the Puppy, in the event SUNDANCIN’ GOLDENS discovers the inhumane treatment of this Puppy, it is agreed SUNDANCIN’ GOLDENS has the right to immediately take possession of Puppy.

10. It is understood and accepted by the Buyer that home visits may be conducted by a person representing SUNDANCIN’ GOLDENS, to check on the welfare of the above-named Puppy during the first five years of the puppy’s life.

11. The buyer agrees to not violate any laws or ordinances with the Puppy.

12. The Buyer agrees to complete an annual health update when requested by the Seller. The form will be downloadable from our website.

13. The buyer agrees to notify us of any change of address or contact information.

14. It is agreed and understood by the Buyer and SUNDANCIN’ GOLDENS that this written agreement sets forth all promises, agreements, conditions, and understandings between them, oral or written, and that both parties have fully read and understand all of the agreement. The agreements shall ensure the benefit of and be binding upon the Buyer and Seller and their successors or beneficiaries.

15. In the event of the employment of an attorney by SUNDANCIN’ GOLDENS on account of any violation of this agreement, it is agreed the buyer shall pay SUNDANCIN’ GOLDENS’s attorney’s fees and court costs. This contract shall be construed by Washington State law.

Spay and Neuter Information

Recent studies have shown that neutering (refers to as spaying also) can have an adverse effect on the health of a dog. To further delve into this latest information, a team of researchers at UC Davis recently examined the veterinary records of 759 Golden Retrievers for hip dysplasia, cranial cruciate ligament tear, lymphosarcoma, hemangiosarcoma, and mast cell tumor. The dogs were grouped as intact, neutered before 12 months of age, or neutered after 12 months of age.

The study revealed that the disease rates were significantly higher in both males and females that were neutered both before and after 12 months of age. Early neutering was associated with an increased incidence of hip dysplasia, cranial cruciate ligament tear, and lymphosarcoma in males and of cranial cruciate ligament tear in females. Neutering after 12 months of age was associated with an increased risk of mast cell tumors and hemangiosarcoma in females.

The most notable results from this study include a doubled risk of hip dysplasia among dogs neutered before 12 months of age and an increased risk of mast cell tumors and hemangiosarcoma in dogs neutered after 12 months. Previous studies reported only a 17% increase in the risk of hip dysplasia in neutered dogs and this is the first study to report an increased risk of cancer in dogs neutered later.

Of the five diseases measured, the study reported that:

• There were no cases of cranial cruciate ligament rupture diagnosed in intact males or females, but in early neutered males and females the occurrences were 5% and 8%, respectively
• Almost 10% of early-neutered males were diagnosed with lymphosarcoma, three times more than intact males 
• The percentage of hemangiosarcoma cases in late-neutered females (about 8%) was four times more than intact and early-neutered females 
• There were no cases of mast cell tumors in intact females, but the occurrence was nearly 6% in late-neutered females 
• Of early-neutered males, 10% were diagnosed with hip dysplasia, double the occurrence in intact males.

Spay and Neuter Agreement

The Buyer agrees that the Puppy will remain intact for a minimum of 2 years. If any extenuating circumstance occurs 2 years before or with full registration that requires the Puppy to be altered, the Buyer agrees to receive approval from the Breeder, and this agreement may be amended with the Breeder’s consent.

Any deviation from this agreement without Breeder consent voids/nullifies the Puppy Purchase Contract/Health Warranty and will result in a $1000 fine and possible recovery of the puppy.

Hip and Joint Information

Besides genetics, there are many environmental elements that affect joint and skeletal health. To provide your puppy the absolute best chance to live a long pain-free life, it is important to keep the skeletal system in top condition.

Activities to avoid before 24 months

Kenneling in extreme cold or heat, keeping the Puppy on cement or slippery surfaces, allowing the Puppy to run on slippery floors, or uneven landscapes, sleeping outside in the cold, jog, running, jumping, or climbing steps excessively, and/or pressing on hips to force the Puppy to sit, or shoulders to force down. Especially avoid throwing a ball or toy for long distances and/or in a manner where the Puppy must jump to catch it. Your Puppy should not exercise to the point of painting for longer than 5 minutes until after 12 months of age.

HIP AND JOINT AGREEMENT

The buyer agrees to feed this Puppy a premium high-quality grain-inclusive Puppy Food that promotes slow growth until 12 months of age. After 12 months, the Buyer agrees to feed the Puppy a high-quality large breed grain inclusive adult food. SUNDANCIN’ GOLDENS recommends Victor grain INCLUSIVE and/or Purina ProPlan for large breeds. We also recommend supplementing the diet with NuVet vitamins, fish oil, olive oil, GMO-free beef gelatin, and Ester c. These supplements lubricate and build cartilage and strengthen the bone. We do NOT recommend high protein (over 28%) calcium puppy food or food that contains peas, legumes, potatoes, or sweet potatoes. Furthermore, the Buyer will keep said Puppy in a lean condition to promote healthy joint growth (must feel the ribs) for life, but the dog will not be allowed to become underweight, malnourished, or emaciated.

The Buyer agrees that all the instructions in this agreement will be followed. Receipts showing the type of food fed may be required if any conditions arise. Any deviation from this agreement voids the Puppy Purchase Contract/Health Warranty.

1.      The registration is full of a breeding/show agreement.

2.      The Seller in no way guarantees that this puppy/dog shall win in conformation and/or performance events.

3.      The Buyer of show/breeding puppies shall obtain OFA hip and elbow certification (or Penn Hip equivalent) as soon as possible after the puppy/dog reaches 24 months of age. This includes annual heart and eyes certifications.

4.      When the Seller receives a copy of these certifications or is notified that verification is available from the OFA website, the Seller will release ownership to the Buyer. This will help us continue to provide the healthiest, happiest, and soundest pets possible.

5.      Buyer will pay the transfer of ownership fee from the AKC after Certifications have been verified by the Seller from the OFA website.

6.      If the Buyer decides to spay/neuter the dog, the Seller will release ownership to the Buyer when the Seller receives a copy of the spay/neuter record from a Board-Certified Veterinarian.

7.      All breeding must be done by contract, and any dog bred to this Golden Retriever must have OFA hip, elbow, heart, and eyes certification, Genetic screening for Golden Retriever-prone diseases, and any other health clearances typical for the breed.

8.      No bitch should be bred to a male Golden Retriever without pre-breeding medical workup (that includes testing for brucellosis, a dangerous bacterial infection that causes the death of preborn puppies, and often sterilization) results for the bitch to be bred. Please refer to this breeding article for appropriate testing of the bitch before breeding.

9.      The Buyer acknowledges that special coat care, conditioning, training, and feeding are necessary to produce a competitive Golden Retriever in conformation and performance events and that this care and training is his/her responsibility.

10.   The Seller agrees that any deviation from the provisions of this contract will cause one of the following: the immediate return of the dog/pup to the breeder in good health and or a $5,000 fine will be due and payable to the breeder as a penalty. In the case of abuse, both the return of the animal and the fine will be imposed. If any legal action occurs, the prevailing party will be entitled to recover reasonable costs and all attorney fees.

11.   The Seller and the Buyer have read and understood the terms and conditions outlined above.

Each party acknowledges that they have read and understood the terms and conditions of this Contract and have voluntarily entered and are obligated to fulfill their obligations in every respect. By signature, each party agrees to this contract and acknowledges that they have received a signed copy at the time of transfer.
