JERICHO SAILING CENTRE ASSOCIATION & VIKING SAILING CLUB WAIVER
Your Viking membership dues do not include the mandatory fees for membership in the Jericho Sailing Centre Association. You will need to purchase your JSCA membership at the Jericho office and complete their waiver of liability. If you have a family membership with Vikings you also require a JSCA Family membership.
VIKING RELEASE OF ALL CLAIMS, WAIVER OF LIABILITY AND ASSUMPTIONS OF RISK
This Waiver is between the Viking Sailing Club (“VSC” or “Club”) and the undersigned applicant ("Applicant"). In consideration of VSC accepting the Applicant’s membership, as well as allowing the Application to participate in Club activities, the Applicant agrees to this Release of All Claims, Waiver of Liability, and Assumption of Risks (collectively, "This Agreement").
. The Applicant’s membership in the VSC may involve the participation of sailing and sailing-related activities with officers, volunteers, other members, their families and friends. Collectively these people and entities will be known as "Members".
. The Applicant waives any and all claims they may now or in the future have against, and release from all form of liability and agree not to sue the Members for any personal death, physical or emotional injury, property damage or loss sustained by The Applicant as a result of my participation in any activity with the Members due to any cause whatsoever, including without limitation, negligence on the part of the Members.
. The Applicant is aware that sailing is a sport which has higher than usual risks and dangers, some of which are:
. bodily inuring, such as cuts, scrapes, broken bones, and concussions
. hypothermia
. drowning
. operating in cold, slippery environments
. The Applicant accepts all of the risks above and the possibility of personal injury, death, property damage or loss resulting from participating VSC activities.
. The Applicant acknowledges that participating in club activities and sailing or learning to sail is derived from these inherent risks and contributes to that learning.
. The Applicant agrees to follow the directions of senior Members, VSC Officers, or boat Skippers and Second-in-Command when sailing.
. In entering into this agreement The Applicant is not relying on any oral, written, or visual representations or statements made by club Members or Officers.
. The Applicant confirms that they are at least 19 years of age and have read and understood this Agreement prior to signing it and that this Agreement will be binding upon their heirs, next of kin, executors, administrators, and successors.
. The Applicant agrees that this Agreement shall be governed in all respects by and interpreted in accordance with the laws of the Province of British Columbia.
. The Applicant promises to not sue any Participants in British Columbia or any jurisdiction outside of British Columbia in respect of any claim.
TERMS OF PAYMENT
. The Applicant understands that the Club will not under any circumstances refund paid membership fees.
. The Applicant confirms that they are at least 19 years of age and have read and understood this Agreement prior to signing it and that this Agreement will be binding upon their heirs, next of kin, executors, administrators, and successors.
VIKING TERMS AND CONDITIONS
I/We hereby apply for membership in the Viking Sailing Club. I/We agree to abide by the rules, regulations and constitution of the Club.
