I desire to take an aircraft tour operated by Florida Air Tours Inc. I understand and acknowledge that my aircraft ride is purely voluntary and I have made the decision to fly of my own free will. I further understand and acknowledge that, but for my voluntary execution of this Agreement, Florida Air Tours Inc. would not provide me with an aircraft tour. In consideration of Florida Air Tours Inc. providing me with an aircraft tour, I agree as follows:

Deseo realizar un recorrido en avión operado por Florida Air Tours Inc. Entiendo y reconozco que mi viaje en avión es puramente voluntario y he tomado la decisión de volar por mi propia voluntad. Además entiendo y reconozco que, de no ser por mi ejecución voluntaria de este Acuerdo, Florida Air Tours Inc. no me proporcionaría un recorrido en avión. En consideración a que Florida Air Tours Inc. me proporcione un recorrido en avión, acepto lo siguiente:

1. REPRESENTATIONS, WARRANTIES, AND ASSUMPTION OF RISK.

I freely and voluntarily choose to assume all the risks inherent in aircraft flight, including but not limited to risks of negligent conduct of others, equipment or aircraft malfunction, and improper or negligent operation of aircraft.

1. DECLARACIONES, GARANTÍAS Y ASUNCIÓN DE RIESGO.
Elijo libre y voluntariamente asumir todos los riesgos inherentes al vuelo de la aeronave, incluidos, entre otros, los riesgos de conducta negligente de otros, el mal funcionamiento del equipo o la aeronave y la operación inadecuada o negligente de la aeronave.

2. EMPTION AND RELEASE FROM LIABILITY.

I, my heirs, next of kin, assigns, executors, administrators, guardians, and legal representatives hereby EXEMPT, RELEASE, ACQUIT, FOREVER DISCHARGE, AND HOLD HARMLESS Florida Air Tours Inc., its' officers, directors agents, representatives, servants, employees, members, successors, and/or assigns, whether acting on the behalf of them or individually, from any and all liability, claims, demands, and causes of action of every nature whatsoever, whether in contract or in tort or under any other legal theory, arising out of my participation in an aircraft tour

2. RENUNCIA Y LIBERACIÓN DE RESPONSABILIDAD.
Yo, mis herederos, parientes más cercanos, cesionarios, albaceas, administradores, tutores y representantes legales por el presente EXPONEMOS, LIBERAMOS, EXONERAMOS, EXONERAMOS PARA SIEMPRE Y EXONERAMOS DE RESPONSABILIDAD Florida Air Tours Inc., sus funcionarios, directores, agentes, representantes, sirvientes, empleados, miembros, sucesores y/o cesionarios, ya sea que actúen en nombre de ellos o individualmente, de toda responsabilidad, reclamo, demanda y causa de acción de cualquier naturaleza, ya sea por contrato o agravio o bajo cualquier otro teoría legal, que surge de mi participación en un viaje en avión

3. COVENANT NOT TO SUE.

I, my heirs, next of kin, assigns, executors, administrators, guardians, and legal representatives agree never to institute any lawsuit of any nature, any action at law, or otherwise against Florida Air Tours Inc., its officers, directors, agents, representatives, servants, employees, members, successors, and/or assigns, nor to initiate or assist the prosecution of any claim for damages or any cause of action which I, my heirs, next of kin, assigns, executors, administrators, guardians, and legal representatives hereafter may have by reason of death or injury to my person or damage to my property arising out of my participation in an aircraft tour. Should any lawsuit or action at law or otherwise be instituted in violation of this Agreement, I, on behalf of myself, my heirs, next of kin, assigns, executors, administrators, guardians, and legal representatives, agree that the following corporate entities, their officers, directors, agents, representatives, servants, employees, members, successors, and/or assigns, shall be entitled to recover, in addition to any other damages which may be incurred, all attorney’s fees and costs
incurred in the defense of such actions, including appellate proceedings.

3. PACTO DE NO DEMANDAR.
Yo, mis herederos, parientes más cercanos, cesionarios, albaceas, administradores, tutores y representantes legales acordamos nunca entablar ninguna demanda de ninguna naturaleza, ninguna acción legal o de otra manera contra Florida Air Tours Inc., sus funcionarios, directores, agentes , representantes, servidores, empleados, miembros, sucesores y/o cesionarios, ni para iniciar o asistir en el enjuiciamiento de cualquier reclamo por daños o cualquier causa de acción que yo, mis herederos, parientes más cercanos, cesionarios, albaceas, administradores, tutores , y los representantes legales en lo sucesivo puedan tener por causa de muerte o lesión a mi persona o daño a mi propiedad que surja de mi participación en un viaje en avión. En caso de que se inicie una demanda o acción legal o de otro modo en violación de este Acuerdo, yo, en mi nombre, mis herederos, parientes más cercanos, cesionarios, albaceas, administradores, tutores y representantes legales, acepto que las siguientes entidades corporativas, sus funcionarios, directores, agentes, representantes, sirvientes, empleados, miembros, sucesores y/o cesionarios, tendrán derecho a recuperar, además de cualquier otro daño en el que se pueda incurrir, todos los honorarios y costos de abogados
incurridos en la defensa de tales acciones, incluyendo los procedimientos de apelación.

4. INDEMNITY AGAINST CLIAMS.

I, my heirs, next of kin, assigns, executors, administrators, guardians, and legal representatives agree to indemnify, defend, save, and hold harmless Florida Air Tours Inc., its officers, directors, agents, representatives, servants, employees, members, successors, and/or assigns with regards to any and all losses, claims, actions, and proceedings of every nature whatsoever which may be presented or initiated by any person or entity, arising directly or indirectly out of my participation in any aircraft tours.

4. INDEMNIZACIÓN CONTRA CLIMAS.
Yo, mis herederos, parientes más cercanos, cesionarios, albaceas, administradores, tutores y representantes legales acordamos indemnizar, defender, salvar y mantener indemne a Florida Air Tours Inc., sus funcionarios, directores, agentes, representantes, servidores, empleados, miembros, sucesores y/o cesionarios con respecto a todas y cada una de las pérdidas, reclamos, acciones y procedimientos de cualquier naturaleza que puedan ser presentados o iniciados por cualquier persona o entidad, que surjan directa o indirectamente de mi participación en cualquier viaje en avión .

5. WAIVER OF JURY TRIAL/APPLICABLE LAW/VENUE/JURISDICTION.

I agree that the law of the State of Florida shall apply to all issues arising out of this Agreement, including but not limited to the construction, interpretation, and validity of this Agreement, and that Florida law shall govern any dispute between me (including my heirs, next of kin, assigns, executors, administrators, guardians, and legal representatives) and Florida Air Tours Inc. (including its officers, directors, agents, representatives, servants, employees, members, successors, and/or assigns) arising out of my participation in an aircraft tour. In the event of any litigation arising out of this Agreement and/or my participation in an aircraft tour, I waive my right to a jury trial, and I agree that such litigation shall be brought in the Circuit or County Court of Brevard County, Florida. By signing this Agreement I, on behalf of myself, my heirs, next of kin, assigns, executors, administrators, guardians, and legal representatives, submit to the jurisdiction of the Circuit and County Court of Brevard County, Florida.

5. RENUNCIA A JUICIO CON JURADO/LEY APLICABLE/LUGAR/JURISDICCIÓN.
Acepto que la ley del Estado de Florida se aplicará a todas las cuestiones que surjan de este Acuerdo, incluidos, entre otros, la construcción, interpretación y validez de este Acuerdo, y que la ley de Florida regirá cualquier disputa entre mí (incluida mi herederos, parientes más cercanos, cesionarios, albaceas, administradores, tutores y representantes legales) y Florida Air Tours Inc. (incluidos sus funcionarios, directores, agentes, representantes, servidores, empleados, miembros, sucesores y/o cesionarios) que surjan de mi participación en un viaje en avión. 6. HEADINGS.

I agree that the headings and sub-headings used throughout the Agreement are for convenience only and have no significance in the interpretation of this Agreement.

6. TÍTULOS.
Acepto que los títulos y subtítulos utilizados en todo el Acuerdo son solo por conveniencia y no tienen importancia en la interpretación de este Acuerdo.

I EXPRESSLY ACKNOWLEDGE AND AGREE THAT THIS AGREEMENT IS INTENDED TO BE AS BROAD AND INCLUSIVE AS IS PERMITTED BY THE LAW OF THE STATE OF FLORIDA, AND THAT IF ANY PORTION HEREOF IS JUDICIALLY DETERMINED TO BE INVALID, THE BALANCE SHALL CONTINUE IN FULL LEGAL FORCE AND EFFECT. I HAVE READ THIS AGREEMENT AND UNDERSTAND AND AGREE TO ALL ITS TERMS AND PROVISIONS. NO ORAL REPRESENTATIONS, STATEMENTS OR INDUCEMENTS APART FROM THE FOREGOING WRITTEN AGREEMENT HAVE BEEN MADE TO ME. I UNDERSTAND THAT BY SIGNING THIS AGREEMENT, I AM RELEASING FLORIDA AIR TOURS INC. FROM ANY AND ALL LIABILITY THAT MAY ARISE OUT OF INJURY OR DEATH THAT I MAY SUFFER AS A PASSENGER IN AN AIRCRAFT TOUR. I AGREE TO PAY FOR ANY & ALL SERVICES AND MERCHANDISE RENDERED TO ME.

 

RECONOZCO Y ACEPTO EXPRESAMENTE QUE ESTE ACUERDO TIENE LA INTENCIÓN DE SER TAN AMPLIO E INCLUSIVO COMO LO PERMITE LA LEY DEL ESTADO DE FLORIDA, Y QUE SI ALGUNA PARTE DEL PRESENTE SE DETERMINA JUDICIALMENTE NO VÁLIDA, EL SALDO CONTINUARÁ CON TOTAL VIGENCIA LEGAL Y EFECTO. HE LEÍDO ESTE ACUERDO Y ENTIENDO Y ACEPTO TODOS SUS TÉRMINOS Y DISPOSICIONES. NO SE ME HAN HECHO NINGUNA REPRESENTACIÓN ORAL, DECLARACIONES O INCENTIVOS, APARTE DEL ACUERDO ESCRITO ANTERIOR. ENTIENDO QUE AL FIRMAR ESTE ACUERDO, ESTOY LIBERANDO A FLORIDA AIR TOURS INC. DE CUALQUIER RESPONSABILIDAD QUE PUEDE DERIVARSE DE LESIONES O MUERTE QUE PUEDO SUFRIR COMO PASAJERO EN UN TOUR DE AERONAVE. ESTOY DE ACUERDO EN PAGAR CUALQUIERA Y TODOS LOS SERVICIOS Y MERCANCÍAS QUE ME DAN.
