AGREEMENT

The following constitutes the Videography Agreement (the “agreement”) of Wildflower Cinema (the “videographer”). Please read the agreement in its entirety and contact the videographer if you have any questions or concerns about the agreement. As used in the agreement, all references to “you” or “your” or the “client” refers to the signer of this agreement. Checking the boxes and entering your name below will serve as your electronic signature reflecting your assent to the terms and conditions of the agreement. You will be able to preview the agreement prior to its submission, at which time you are encouraged to print a copy for your records.
TERMS & CONDITIONS

This agreement constitutes a binding contract for videography services and/or related products. By accepting this agreement, the contracting party agrees to pay Wildflower Cinema for the services and/or related products as provided by Wildflower Cinema at the price set forth by this agreement. The following terms and conditions also apply: Non-refundable reservation fee: A reservation deposit is due upon acceptance of this agreement. Once the agreement is accepted and the deposit is paid, Wildflower Cinema shall reserve the date and time agreed upon for the event and will not make any other reservations that will conflict with your event. For this reason, all deposits are non-refundable, even if the date is changed, or event is canceled for any reason. The person(s) whose signature(s) appear on this contract, agree that Wildflower Cinema, shall provide services to film their wedding and related events to the best of its abilities, in the manner described in this document. Wildflower Cinema requires that one meal be provided at the reception per videographer.
DESIRED FOOTAGE / COVERAGE

The contracting party will notify Wildflower Cinema of their desired footage / coverage in advance. While every effort will be made to accommodate the contracting parties’ desired list of footage and create the best video possible, no particular footage is guaranteed. Wildflower Cinema is not responsible for weather conditions, event schedule complications or incorrect addresses provided. Completion of final product: Wildflower Cinema's average time of delivery is 4-6 weeks (from your wedding day). Storage of completed files: Wildflower Cinema will store your completed video and raw footage for 3 months following delivery of your video package.
ARTISTIC STYLE

The contracting party acknowledges that it is familiar with Wildflower Cinema's portfolio and is requesting services with knowledge of Wildflower Cinema's style; that services are of a unique and artistic nature; that videos may be different from videos previously made by Wildflower Cinema and that in creating the video Wildflower Cinema shall use their personal artistic judgment to create a video consistent with their personal vision of the event which may be different from the contracting party’s and/or subjects vision of the event. Accordingly, the contracting party acknowledges that the video shall not be subject to rejection based on the basis of taste or aesthetic criteria.
COPYRIGHT, LICENSE TO USE

It is understood that Wildflower Cinema owns the copyright to all of videos taken. We reserve the right to use all video for display, publication and advertising. If you wish to not have your film submitted for publication, you must make us aware of this and have it written into your contract. By signing this contract, you authorize us to submit your films for publication. Limitation of liability: Although great care will be taken with the digital files taken at your event, this agreement limits the entire liability for any claim, loss, injury or failure to deliver to the return of any fees paid by the contracting party under this agreement. In the event of personal illness or other circumstances beyond the control of Wildflower Cinema, an attempt will be made to procure the services of another professional videographer to fulfill the obligations of Wildflower Cinema. Furthermore, Wildflower Cinema is not responsible for loss of video or audio quality due to restrictions at event locations. Wildflower Cinema has working methods in place to prevent loss or damage to your films. However, there is the unlikely possibility that equipment may be stolen or destroyed for reasons beyond our control. In these circumstances liability is limited to the return of fees paid until that moment.
