
Terms & Conditions
1. REthink Leverage acknowledges and agrees that all contact data, login, and passwords provided by Agent to REthink Leverage in this and other documents are the exclusive property of Agent and shall not be used or distributed by REthink Leverage for any purpose other than those services REthink Leverage provides to Agent. Such data, logins, and passwords shall be deleted by REthink Leverage upon the Agent's request. Agent also agrees that REthink Leverage Transaction Coordinator and may use the logins provided to access information and to ensure an efficient and smooth closing/listing process.
Whereas REthink Leverage, LLC is going to have access to Agent’s proprietary information such as client & customer contact data, logins, and passwords in order to provide Agent certain administrative services such as transaction coordination and shall have no right whatsoever to use or distribute for any purpose other than those services on behalf of agent and shall have no real or constructive interest in such data.
2. Transaction Coordinator agrees to process all paperwork transmitted to REthink Leverage within 48 hours of the accepted transaction date.
3. Transaction Coordinator will not begin work until a fully executed contract is in place. This includes signatures from all parties, and signed addenda or counter offers.
4. All pages of the applicable contract(s) must be turned in to the Transaction Coordinator before he/she begins work. This includes Seller Representation Agreements, Buyer Representation Agreements, and Purchase and Sale Agreements. These contracts must be executed and legally enforceable to be considered for TC work.
5. Transaction fees are charged based on the level you choose. Double-sided transactions pay both transaction fees for buyer & seller.
6. There is no fee for a canceled buyer/seller pending contract.
7. All transaction fees are to be paid within 1 week of receipt of invoice after closing. An invoice will be sent via email and the Agent can pay via card, ACH deposit, or check. Payments NOT received within 1 week of receipt of invoice will result in a $50 late fee charged and a new invoice will be issued. Each late week will result in a $50 late fee. Upon 1 month of late payment, invoices that continue to go unpaid will incur an additional 5% late fee for every 30 days they are late and are subject to collections after 90 days past due. REthink Leverage will no longer accept new orders until the delinquent invoices are paid.
8. Agent hereby agrees to indemnify, defend and hold REthink Leverage harmless against any and all costs, losses, claims, actions, demands, damages and liabilities (including reasonable attorneys’ fees) incurred by REthink Leverage arising out of or in respect of any act, failure to act, or assumption of any obligation or responsibility by agent or by any of its members, directors, officers or employees which is in contravention or violation of or in conflict with any of the terms or provisions of this Agreement.
This is an agreement between REthink Leverage, as creditor, and the Agent/Debtor named on this form. By executing this agreement, you consent to services rendered by REthink Leverage and its staff and agree to pay for all services that are received.
9. All TCs employed by REthink Leverage LLC are licensed real estate agents with the State of Michigan. We, however, are NOT actively taking on buyers or sellers AND will NEVER in away way market to your buyers/sellers at any time. We strictly use our license for TC duties that require a license such as drafting addenda, speaking to clients directly about title/lending/closing, etc. We will never at any time offer advice to you or your client regarding the real estate transaction, lending, or title (if advice is needed, please consult your Broker). Communication from TC to buyer/seller is to keep deadlines on track, relay details of the transaction, collect any needs from all parties and get agent-authorized documents signed.
10. All documents drafted by the TC are to be approved in writing by the agent before TC dispurses for signature.
