THIS WAIVER OF LIABILITY, INDEMNIFICATION, ASSUMPTION OF THE RISK, AUTHORIZATION TO CONTACT EMERGENCY MEDICAL ASSISTANCE, AND PRESS RELEASE FORM HAS BEEN APPROVED BY JIMMY MENDIETA TENNIS MANAGEMENT LLC; DBA PRESTWICK TENNIS CENTER ALSO DBA PLAYMAKERS TENNIS CLUB, A SOUTH CAROLINA LIMITED LIABILITY COMPANY, FOR ALL ACTIVITIES CONDUCTED AT/OR ASSOCIATED WITH PRESTWICK TENNIS CLUB. 

If you are over the age of 18, you are releasing legal rights for yourself by executing this form. PLEASE READ IT CAREFULLY.

As an individual over the age of 18, or as a parent or legal guardian of the above-listed child, I freely acknowledge that I have or will voluntarily register myself to participate in tennis and sports activities held/sponsored by JIMMY MENDIETA TENNIS MANAGEMENT, (hereinafter "PRESTWICK TENNIS CLUB"), which include tennis clinics, camps, socials, league play, tournaments and other fitness components. I acknowledge that my participation in tennis activities entails both known and unanticipated risks, that could result in serious and permanent physical and emotional injuries to myself, death, damage to property, and injury to others.

I understand that such risks are inherent in these activites and that even with precautions and safety measures they cannot be eliminated without jeopardizing the essential qualities of the activities. I also understand and acknowldege that injuries myself receive (s) maybe compounded or increased by negligent rescue operations and such, I understand that other than telephoning for an ambuance, no medical assistance shall be provided by PRESTWICK TENNIS CLUB, its agents, staffs, or other representatives in the event that the injury occurs in any event being held. Understand such dnagers, I hereby knowingly, and voluntarily enroll (myself / all members associated with my membership) in events held or sponsored by PRESTWICK TENNIS CLUB.

I willingly engage in the dangerous activities described above, and I assume the risk of the activities. I understand that I do not have permission to participate in any tennis activities at an event held/sponsored by a PRESTWICK TENNIS CLUB member without agreeing to the terms on this release. I understand that this Form is effective for all events held/sponsored by PRESTWICK TENNIS CLUB/USTA scheduled league events and matches or any acitivity participated at PRESTWICK TENNIS CLUB ("effective period").

I have exercised my due diligence to visit PRESTWICK TENNIS CLUB to determine that the property of Prestwick Tennis Club is being operated a lawful safe manner tat is conducive to good sportsmanship and to promote the sport of tennis and other sports. If I deem that my safety may or will be in jeoparty, I shall need seek permission to participate as a guest or member of PRESTWICK TENNIS CLUB. I shall comport myself to comply with the duty as a reasonable person or players in any situation that may arise. If I am on the property of PRESTWICK TENNIS CLUB and sense that my well being mentally or bodily is in jeoparty, I shall remove from the property immediately from the situation asn shall not exasterbate the sitaution, and shall report the incidence to PRESTWICK TENNIS CLUB management. 

I understand by signing this release form I abide by the USTA Friends of Court which states: Members, players, spectators, and other participants in USTA tournaments, programs, and events acknowledge the associated risks, assume those risks voluntarily, and in consideration of their attendance at USTA tournaments, programs, and events, agree to assume any loss or damage, and to waive any claim or demand on account of any injury to person or property arising out of or related to their attendance, including, but not limited to, exposure to infectious syndromes or diseases, whether caused by negligence or other fault. By participating in or attending USTA tournaments, programs, and events, Members, players, spectators, and other participants assume all risks whether known or unknown. Furthermore, Members, players, spectators, and other participants agree to release, indemnify, and hold harmless the USTA, its affiliated Sectional and District Associations, and the host facility (Released Parties) and the Released Parties’ employees, contractors, representatives, and agents for any such injury or loss caused by negligence or other fault to the fullest extent permitted by law. 

Additionally, I acknowledge the Rules and Regulations -104E Player Eligibility:

1.04E(4) Player Agreement. All players participating in the USTA League, as a condition of said participation, agree to abide and be bound by the USTA Constitution and Bylaws; the USTA LEAGUE REGULATIONS; the FRIEND AT COURT - The USTA Handbook of Tennis Rules and Regulations including THE CODE and Wheelchair Rules of Tennis (unless modified by these USTA LEAGUE REGULATIONS); and the standards of good conduct, fair play and good sportsmanship.

1.04E(5) Waiver of Claims. Players, participants, and any spectators or individuals that are participating in the USTA League acknowledge the risks associated with playing competitive tennis, accept those risks voluntarily, and in consideration of their acceptance in the USTA League Program, assume all loss or damage, and any claim or demand therefore on account of injury and/or exposure to infectious syndromes or diseases to the person or property or resulting in illness and/or death arising out of or related to their participation, whether caused by negligence or otherwise. By participating or attending a league event the players, participants and any spectators assume all risks whether known or unknown. Furthermore, Players, participants and spectators hold harmless the USTA, its affiliated Sectional Associations and Districts/Subdivisions and the host facility, their officials (Released Parties) and the Released Parties, employees and agents with respect to any injury or loss caused by negligence or otherwise to the fullest extent permitted by law.

I understand that this release and waiver of liability shall continue to be in effect for all events/activities/visitations/spectatorships/viewing/matches from this date forward. 

I hereby knowingly and voluntarily release and forever discharge PRESTWICK TENNIS CLUB, where myself is injured PRESTWICK TENNIS CLUB, all their respective employees, agents, staffs, coaches, instructors, assistants, officers, owners, shareholders, subcontractors and any other representative or affiliates and their respective heirs, successors, and assigns (collectively with PRESTWICK TENNIS CLUB "PRESTWICK TENNIS CLUB" Representatives) from any any and all liability arisinfg out of or in connection with the above described activities involving myself at any and every event held/sponsored by PRESTWICK TENNIS CLUB. "Liability" means any and all claims, demands, losses, causes of action, lawsuits or judgements of any and every kind that occurs during or incidental to the above described activities, that result from any cause, whether caused by negligence or otherwise.

I hereby agree to and shall indemnify, defend, save and hold harmless PRESTWICK TENNIS CLUB from and against any and all loss, liability, damage, or cost they may incur, including attorney's fees and litigation costs, arising out of or related to the above described activites, whether caused by negligence or otherwise.

I hereby agree that the assumption of risks, the release and waiver of liability, indemnity agreements contained herein extend to all acts of negligence and is intended to be as broad and inclusive as is permitted by the law of South Carolina and any other state whose laws apply to the activities, and that if any potion of this Form is held invalid, it is agreed that the balance shall, notwithstanding continue in full legal force and effect.

I give PRESTWICK TENNIS CLUB the right to photograph or video tape me or likeness of me, and to dessiminate any images or recordings of me for any productions associated or in any way connected with marketing, advertising, publication or marketing of any event undertaken by PRESTWICK TENNIS CLUB. Specifically, I hereby forever and irrevocably grant to PRESTWICK TENNIS CLUB a license and permission to use any such photographic or video reproduction of me in any form of advertisemnet for PRESTWICK TENNIS CLUB or any of its member for promotional purposes. I understand that no compensation will be paid by PRESTWICK TENNIS CLUB for the use of any photographic or video reproduction of me or likeness of me. 

I INTENDED BY MY SIGNATURE FOR THIS FORM TO BE COMPLETED AND UNCONDITIONAL WAIVER AND RELEASE OF ANY AND ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. I UNDERSTAND AND AGREE THAT THIS FORM CANNOT BE AMMENDED OR MODIFIED BY ANY ORAL STATEMENTS OR OTHER WRITINGS AND THAT IS BINDING, AND OUR HEIRS SUCCESSORS, DISTRIBUTEES, GUARDIANS, LEGAL REPRESENTATIVES, AND ASSIGNS, I AGREE AN ELECTRONIC OR A SCANNED SIGNATURE SHOULD BE BINDING IN LIEU OF THE ORIGINAL.
