    IFNet Day Camp Terms and Conditions


    CAMPER (“Camper”) is anyone who has registered for IFNet Camp and is entering 1st to 3rd grades.  COUNSELOR (“Counselor”) is anyone who has registered for IFNet Camp and is entering 10th to 12th grades.  VOLUNTEER (“Volunteer”) is anyone who has registered for IFNet camp and is 18 years of age or older (typically parents of campers or counselors, or college students) and who has graduated high school. IFNet Day Camp 2023 (“IFNet Camp”) is the camp that runs from July 14-16, 2023 operated by Indian Family Network, Inc., a registered non-profit organization. PARENT(S) (“Parent(s)”) is the parent or legal guardian of any camper or counselor.


    CAMPER, COUNSELOR, AND VOLUNTEER PAYMENT AND CANCELLATION TERMS: The fee for registration and attendance is as follows: $250 per Camper. Full payment will be collected upon acceptance of registration. IFNet Day Camp reserves the right to refuse acceptance of any registration at its sole discretion. CANCELLATION: All payments are 100% non-refundable. Any payments or any portions thereof will only be refunded at the sole discretion of IFNet Day Camp. Circumstances in which IFNet Day Camp might consider (but is under no obligation to consider)  refunding a portion of fees, include:  (1) Camper, Counselor or Volunteer has a death in the immediate family, (2) Camper, Counselor or Volunteer  submits a physician note stating Camper, Counselor or Volunteer has a sickness or injury that will prevent the Camper, Counselor or Volunteer from attending camp. All cancellation requests must be in writing and must adhere to the conditions stated above. IFNet Day Camp does not commit to considering or processing any refund requests until after the completion of camp.  IFNet Day Camp reserves the right to issue credits in lieu of scheduled refunds in the unlikely event of an Act of God, War, Terrorism, Civil Unrest, Communicable Disease, or any other non-personal situation that, in the IFNet Day Camp’s sole judgment, could lead to significant cancellations that would have a negative financial impact on the viability of the IFNet Day Camp.


    RULES AND REGULATIONS: IFNet Day Camp is operated solely by the Indian Family Network, Inc., a registered non-profit. Campers, Counselors, and Volunteers, and all Parents/Guardians of the Camper or Counselor, by choosing to register or volunteer, are agreeing to abide by all of the rules and regulations established by IFNet Day Camp, including, without limitation, those relating to enrollment, withdrawal, and visitation of Campers or Counselors during camp hours.  

     

    DISMISSAL OF CAMPER, COUNSELOR OR VOLUNTEER: IFNet Day Camp reserves the right to dismiss, at its sole discretion, any Camper, Counselor or Volunteer whose physical or medical condition, conduct, or behavior is deemed unsatisfactory or detrimental to the best interests of the IFNet Day Camp or to the wellbeing or experience of other campers, counselors, or volunteers, or who violates IFNet Day Camp rules and regulations. No refunds will be made in the event that a Camper, Counselor or Volunteer is dismissed. A dismissed camper, counselor or volunteer must leave IFNet Day Camp as soon as possible.  Parents agree to pick up Camper or Counselor who has been dismissed as soon as possible.

     

    MEDICAL CARE: The Parent(s) grant IFNet Day Camp permission to administer first aid, provide treatment for minor illness/injury, and call for help as the staff deems necessary and/or  appropriate for Campers, Counselors, or Volunteers both on camp premises and off-site. Should on-site or off-site care, including but not limited to emergency room treatment, or the securing of special medications be deemed necessary and/or appropriate for Camper, Counselor, or Volunteer, Parent(s) thereof shall be financially responsible for any such on-site or off-site care, transportation costs, and/or special medications. Parent(s) or Volunteers acknowledge that they have adequate medical and hospitalization insurance for any sickness or injuries that may incur to Camper, Counselor, or Volunteer as a result of participating in IFNet Day Camp. Volunteers acknowledge that they have adequate medical and hospitalization insurance for any sickness or injuries that may occur to themselves as a result of participating in IFNet Day Camp. 

     

    RELEASE AND WAIVER OF CLAIMS AND LIABILITY: As a condition of the Camper, Counselor, or Volunteer being admitted to the IFNet Day Camp, the Camper, Counselor, Parent(s) or Volunteer on his/her/their own behalf and on behalf of any spouse, heirs, personal representative or assignees, hereby release, hold harmless, and indemnify The Indian Family Network, IFNet Day Camp, and their respective  owners, coordinators, directors, officers, employees, volunteers, counselors, contractors and agents from any and all damages, claims, causes of action and liability which results in any way from: (a)  the operations of the IFNet Day Camp, (b) the activities in which the Camper, Counselor or Volunteer participates at the IFNet Day Camp or in conjunction with the IFNet Day Camp, (c) interactions between/among Campers, Counselors or Volunteers, (d) the conditions on or near the IFNet Day Camp premises, or in any place where the Camper, Counselor or Volunteer participates in IFNet Day Camp activities, (e) acquisition and effects of COVID-19 or any other infections condition, and (f) medical care administered to Camper, Counselor or Volunteer by IFNet Day Camp Medical Director(s) or Volunteers. This provision is intended to release and waive any and all claims related to (or stemming from) the time spent at IFNet Day Camp and the conditions of the premises of IFNet Day Camp.

     

    PERMISSION TO PARTICIPATE: Parent(s) grant Camper or Counselor permission to participate in all IFNet Day Camp programs and activities. Parent(s) or Volunteers understand that accidents and injuries can occur in the natural course of participation in such activities. Parent(s) or Volunteers waive, on behalf of the Camper(s), Counselor(s) and/or themselves, any claims based on such accidents and/or injuries.

     

    IMAGES, ETC: Permission is hereby given to IFNet Day Camp and Indian Family Network, Inc. to use in promoting and marketing IFNet Day Camp (or future camps) or Indian Family Network, Inc. in general, and for other purposes directly relating to IFNet Day Camp or The Indian Family Network, (i) digital, photographic, video, and audio images or likenesses of Camper, Counselor, and Volunteer; and (ii) statements, articles, names, music, art, photographs, audio recordings, films and videos created by Camper, Counselor, or Volunteer, or originating from IFNet Day Camp or from an IFNet Day Camp related activity.

     

     BELONGINGS: The IFNet Day Camp is not responsible for Camper, Counselor or Volunteers’ belongings while Camper, Counselor or Volunteer is at IFNet Day Camp. 

     

    SEVERABILITY: Camper, Counselor, Volunteer and Parents expressly agree that the provisions contained within the IFNet Day Camp 2023 Terms and Conditions are intended to be as broad and inclusive as permitted by applicable law and that if any portion of the IFNet Day Camp Terms and Conditions are held invalid, it is agreed that the balance of the agreement, including the remaining IFNet Day Camp Terms and Conditions, shall, notwithstanding, continue in full force and effect.

     

     INTEGRATION: I/we affirm that this agreement supersedes any and all previous oral or written promises or agreements. I understand this is the entire agreement between the parties and cannot be modified or changed in any way by representations or statements made by any agent, employee, organizer, or volunteer of IFNet Day Camp. This agreement may only be amended by a written document duly executed by all parties. 

     

    EFFECTIVE DATE: This Application of Enrollment (the “Agreement”) shall take effect and become binding when (a) registration for Camper, Counselor or Volunteer is submitted to IFNet Day Camp and (b) Camper, Counselor or Volunteer’s registration has been accepted and confirmed by IFNet Day Camp. A confirmation email will be sent and collection of fees will be processed upon confirmation of registration. IFNet Day Camp is not responsible for Parent(s) or Volunteers who are unaware that their registration has been confirmed. 

     

     DISPUTES: All claims, lawsuits, disputes, or causes of action of any kind or nature, whether arising in law or in equity, asserted by Camper, Counselor, Volunteer, or Parents against the IFNet Day Camp or by the IFNet Day Camp against any Camper, Counselor, Volunteer, or Parents, and arising from or related to this Agreement or from the Camper, Counselor or Volunteer’s attendance at IFNet Day Camp, shall be brought and maintained exclusively in the courts of the Commonwealth of Massachusetts (Middlesex County), and Parents, Volunteer and/or Camper/Counselor expressly submit to the jurisdiction of such courts. The substantive law of the Commonwealth of Massachusetts will govern such disputes without regard to conflict of law rules.

     COVID-19 VACCINATION STATUS: Campers, Counselors and Volunteers will be required to show proof of being fully vaccinated to attend camp.  IFNet Day Camp reserves the right to change this policy or any other policy pertaining to Covid-19 at its sole discretion.
