  • For Commission Sales Only: The target sales price for this horse is $. This amount may be amended in either direction depending on market and marketability of the horse. MHF is entitled to a 15% commission from the owner, and in some cases may also receive a commission from the buyer.

  • For On Credit sales only: Owner & Mimosa Hills Farm, LLC agrees that the owner will be paid $ upon sale of the horse. Further amendments may be made depending on market and marketability of the horse, however, the amount paid to the owner will not exceed the above amount.

  • -All animals must be treated with respect 

    -All riders and drivers must wear a helmet while mounted. 

    -All riders must wear safe and appropriate attire and boots. No tennis shoes, no shorts. Only boots, tall boots or chaps, and appropriate breeches or riding pants. Especially in loaned saddles. 

    -Do NOT throw away food trash in the trash cans or dumpster at the farm

    -feed room, hay storage areas, and shavings are off limits. STAFF ONLY

    -changes to diet or routine must be approved by farm owner/trainer

    -notify farm owner/trainer of any requested change of diet, administration of supplements, dewormer, or drugs.

    -always use halters and lead ropes when leading horses. No halters without lead ropes, no lead ropes without halters, do not leave throatlatch unhooked while leading. If the halter doesn’t fit, go get another one.

    -boarders are not to borrow tack from anyone without permission

    -MHF does not provide fly spray, show sheen, hoof polish, shampoo or any other product. If you see these items and they were not purchased by you, please do not use them. 

    -If you just purchased a new horse from MHF and do not yet own a saddle or any other tack, please plan to purchase your own within 30 days. MHF does not provide tack to horse owners but we can help you find what you need! 

    -only leather or breakaway halters can be kept on horses during turnout, if any

    -If the farm gate is closed when you arrive, ALWAYS close it behind you! This means there may be a lose animal.  

    -Minors must be accompanied by an adult and not left unattended

    -All riders and guests who come into direct contact with the horses whether mounted or not must fill out a liability release form which can be found at www.mimosahillsfarm.com. Boarders are responsible for ensuring their guests have properly signed and understand risks. 

    -drive slowly, 5MPH speed limit

    -clean up after your horse. This includes common areas such as tie areas, wash racks, arena, and driveway. 

    -please repair damage to arena jumps and obstacles if directly broken by misuse

    -please repair or replace any equipment, borrowed tack, etc that is damaged by misuse or carelessness. 

    This may include leaving tack or helmets out and it getting ruined by rain or animals, using tack that is clearly in disrepair causing further damage, allowing a horse to step on the reins, catching a stirrup leather on a gate that was not appropriate for horses or not open all the way. This does not include accidents that could not be avoided.

    -clean and care for any and all borrowed tack that is used on personal horses. This includes, bridles, saddles, pads, bits, etc.

    -do not make changes to bridles or any other tack that does not belong to you

    -Personal tack and equipment can be stored in appropriate tack and equipment areas. Mimosa Hills Farm is not responsible for damage, disappearance, or theft of any personal item. Any tack left behind 30 days after your contract is terminated will become property of Mimosa Hills Farm. 

    -no smoking anywhere on the farm

    -no riding off the farm onto adjoining properties without Crosby.

    -well behaved, non-destructive and non-aggressive dogs are allowed as long as they do not cause distress to other animals and people while at the farm. Dog owners are responsible for damages to property or livestock while visiting Mimosa Hills Farm. 

    -bullying or disrespect of any kind toward others or animals will not be tolerated and will be refused service. 

    -report any issues you see. We might not know or notice until it is brought to our attention.

  • Outstanding Accounts (APPLIES TO ALL)
    -Any fee is considered late at day 30 and will inquire a $25 fee, a 15% interest rate will apply after day 30. 

    -Returned or canceled checks will inquire a $40 penalty and must be repaid within 10 days.

    -In the event of non-payment, overdue payment beyond 60 days, or failure to repay returned checks and late or other penalties, Mimosa Hills Farm will enact a lien on this horse beginning on day 61 of non-payment. If the account is not fully settled by day 90, Mimosa Hills Farm will assume full ownership and control of this horse and is entitled to sell the horse in a private sale or public auction to recoup any unpaid expenses. The owner will be notified of late payment at 30 days, an enactment of the lien at 60 days, and assumed abandonment at 90 days. Responses from the owner must be in writing and any lack of communication will be assumed abandonment. The horse may not be removed from the property once a lien is enacted and the account must be paid in full before removing the horse from the farm at any point. This applies to any horse boarded or in training at Mimosa Hills Farm. This also applies to outstanding Veterinary and Farrier services.

    For unpaid Rider Training accounts or any prepay lesson program, a $25 late fee will be applied to accounts unpaid for over 30 days. After 30 days, the rider may only participate in private lessons, paid for the day of the lesson, until the account is caught up.

    If legal action is taken, Mimosa Hills Farm is entitled to recoup legal fees.

    That being said we will do what we can to accomodate difficult financial situations as long as the horse owner is making attempts to communicate and make payments on the account. Horses are only considered abondoned if there is no communication from the owner and no attempt to correct the dept.

  • Emergency Care & Risk of Loss

  • Emergency Care

    The owner of the horse will be notified of any emergency care that this horse needs. If the owner cannot be reached in a timely manner, determined by representatives of Mimosa Hills Farm, reasonable action will be taken. Reasonable action will not include major surgery but may include euthansia unless otherwise stated here:   *   



    In some cases, even insured horses cannot be saved with surgery or hospitalization. If the veterinarian determines that the horse cannot survive regardless of further care or cannot be transported, the horse will be euthanized and the owner will be notified and provided a report from the veterinarian.


    I,   *   *   , agree and understand these terms and will not hold Mimosa Hills Farm, LLC liable for any loss of life or loss of use of any horse in our care.



  • Mimosa Hills Farm and associated trainers, managers, and staff or volunteers will not be held responsible for risk of loss, sickness, illness, disease, injury, theft, or death of any horse, property, or person. The owner of the horse assumes full risk of loss and understands that Mimosa Hills Farm strongly encourages, but does not require, that all horses and riders carry an insurance policy. This applies to any horse, person, tack, trailers, vehicles or other personal property at Mimosa Hills Farm. The owner agrees to hold harmless Mimosa Hills Farm and any related person and Mimosa Hills Farm will hold harmless any horse owner for death or injury or damage to any person or property caused by this horse. 

     

     

    Termination of Contract (applies to ALL)


    This contract can be terminated by either party at any point but is not void until the horse (or account) has been paid in full and removed from the property.
