    If an unmarried couple lives together for 1 year or longer they may be considered common-law by the CRA. If they have a child together, they may be instantly considered common-law spouses for tax purposes.

  • CRA Compliance Questions

  • CRA may share your name, address, date of birth (for age verification), and Canadian citizenship confirmation with Elections Canada.

    Sharing your information will make it easier for you to vote during an election.

  • Most people think of foreign property as real estate. Consider investments, shares, and crypto-currencies held outside of Canada.

  • Generally speaking, your home that you own and live in may be considered to be your principal residence. A vacation property or cottage that you own for personal use may also be considered to be a principal residence.

    Since 2016, it is mandatory to report dispositions of principal residences. Significant penalties apply for not reporting.

    A "change in use" must also be reported. i.e. Changing a principal residence to a rental property has similar tax implications to selling a principal residence.

  • The CRA considers you to be a first-time homebuyer if you purchased a home and did not live in a home that you, or your spouse, owned within the last 4 years.

  • If you owned more than one residential property during the year, only one may be designated as your principal residence.

  • Examples of where this might apply:

    You are the legal owner of a residential property, but you do not live in the property, a family member lives in the property.

    You own your home, but could not qualify for the mortgage alone. Your parents are also on title for your property.

    You are a joint owner of a rental property.

    You have a corporation that owns a residential property.

  • Underused Housing Tax (UHT)

    The underused housing tax is a NEW tax separate from the personal tax filing system. It imposes a 1% annual tax on the value of applicable residential properties. Some owners of residential properties will need to file a UHT return by April 30 to calculate the 1% tax or to file for an exemption from the tax.

    Additional examples:

    • Anyone that holds residential property otherwise than in their own name (consider legal title).
    • Joint ownership of a property.
    • Properties held in trust.

    e.g.    If a family member is the legal owner of your home, they may be holding the home for you in a bare trust arrangement.

    Please tell us if you need to file a UHT return by April 30th. Significant penalties apply for not filing.

    Increase Reporting Requirements for Trusts

    There are new, increased reporting requirements for trusts starting December 31, 2023.

    Properties held in trust, as noted above, may require a T3 Trust return to be filed.

    Did you know? Gambling winnings are generally not taxable in Canada, however, they are taxable earnings in the United States!
  • The above question refers to a GST number that is associated with your personal tax accounts. Do not include a GST number that is associated with a corporation that you own.

    Common scenarios to have a personal GST account:

    • You have a sole-proprietorship
    • A GST account was opened in relation to a real estate transaction
  • We do not require statements for TFSA accounts. TFSAs are not reported for personal taxes unless you contribute more than your TFSA limit.

  • The information that you share on this intake form is used for us to analyze your tax situation.

    You income-related documents may be uploaded to your Tax Checklist, which our team will email to you. Alternatively, you may email your personal tax documents to personal.tax@clearlyfinancials.ca.

     

  • Tax Credit and Deductions

  • If you have any long-term medical conditions please consider speaking to your medical practitioner about completing a Disability Tax Credit form. It is not always obvious what may qualify for the DTC.

  • NEW! Disability Tax Credit for Type 1 Diabetes

    Individuals with type 1 diabetes will be effectively deemed eligible for the disability tax credit. While this change was legislated in 2022, it is retroactive to 2021 and subsequent years.
