Photo Release

This signed contract constitutes that an order should be made for a photography session. While the session fee has been donated to the client, no other products, services or digital images are included with the session. As the photographer has donated time and talent to this session and to Stroll East Shore for no compensation, an order of any size would be greatly appreciated but is not required. For album orders, all changes and edits requested by the client must be made within one month of receiving the proofs. Album orders not completed within one month of the proofs being sent, due to client inactivity, will incur a $100 PER MONTH fee until the album is completed. Prices are NON NEGOTIABLE.

Although care will be taken with the digital files, the Photographer limits any liability for loss, damage or failure to deliver photographs for any reason of Photographers non-performance caused by: any force or similar circumstances, illness, accident or any cause beyond their control. In any event, the limit of Photographer’s liability shall not exceed the contract price stated herein.

(relates to portrait or non-event sessions only) It is understood that no other photographer, amateur or professional, shall be allowed to photograph at the session near Kara Powell while she is working due to reasons of the photographer delivering the quality of images as expected. Any breach of this agreement can constitute a reason for non-completion of the job with no liability to Kara Powell Photography.

If the client purchases digital images it is agreed that dual ownership of the digital files will be maintained by the Client and the Photographer. Upon delivery of the digital files to client’s physical control, the client shall gain personal non-commercial rights to images. It is also agreed that the Photographer will have full rights to use all images for advertising purposes.

It is agreed that the Photographer may display and use photographs from session/event for website and internet promotion, and any other commercial or non-commercial purposes thought proper by the Photographer.

The Photographer has donated the session fee to the client as a gift. Upon booking, the Photographer reserves the time and date agreed upon, and will not make other reservations for that time and date.  Prices are NON NEGOTIABLE.

Photographer agrees to have contracted orders for the photo shoot photographs completed within a reasonable period of time from the shoot day. Usually within 3 weeks of the order date.

This contract is not to be construed as an employment agreement in any way. The Photographer functions as an independent contractor.

In the event that the Photographer is ill, or has symptoms of an illness, all affected sessions will be postponed. The Photographer will give as much notice as is possible and the session will be rescheduled at no cost to the client. If the Client or ANY member of the Client's family is ill or has symptoms of an illness 48 hours before the session, inform the Photographer immediately. The session will be rescheduled at no cost to the Client. The Photographer will take all necessary precautions to keep Clients healthy and will not be held liable if the Client becomes ill.

In the event the Client must cancel the contracted services for photography on this Contract the donated session fee is non-refundable. The photographer will make all efforts to reschedule the session once, at no extra cost to the client.

The model release allows Kara Powell Photography to use the images taken on their social media, blog, and website. The photographs taken and presented by Kara Powell Photography may be used with the purpose of display, portfolio, advertising, website or publication to promote Kara Powell Photography. We do not identify subjects by name on our website or printed materials. We do not photograph anyone without a model release. I, the undersigned, have read, understood, and agreed to the policies, terms and conditions in the SESSION AGREEMENT.
