I acknowledge and agree that by participating in exercise activities and fitness training sessions with my personal trainer, Michel “Mook” Theodore, doing business as myElevation Wellness, legally registered as TME FITNESS SOLUTIONS LLC (herein referred to as “My Trainer”), I am voluntarily assuming all associated risks of injury, illness, or even death.

 

I fully understand that fitness training inherently involves strenuous physical activity and carries risks of injury, including but not limited to: heart attacks, strokes, death, muscle strains, sprains, tears, broken bones, shin splints, heat exhaustion, dehydration, knee, lower back, and foot injuries, and other physical ailments that may occur during or after my participation.

 

I affirm that:

• I have consulted with a physician or otherwise determined that I am physically capable of participating in exercise activities.

• I am solely responsible for monitoring my own physical condition, exertion level, and overall well-being during sessions.

• I will immediately notify My Trainer of any symptoms such as fatigue, shortness of breath, chest discomfort, dizziness, or pain that arise during or after exercise activities.

• I will refrain from any activity that I feel may cause me injury or worsen an existing condition.

• I accept full responsibility for any injuries or health conditions that may result from my participation, whether caused by my own actions, omissions, or otherwise.

 

In consideration for being allowed to participate in fitness activities offered by My Trainer, I, on behalf of myself, my heirs, personal representatives, successors, and assigns, voluntarily waive, release, discharge, and hold harmless My Trainer, including its owners, officers, directors, employees, agents, contractors, and representatives, from any and all claims, demands, causes of action, or liability for any loss, injury, or death that may occur, whether arising from negligence, ordinary care, or otherwise — except for injuries resulting solely from My Trainer’s gross negligence or intentional misconduct.

 

I acknowledge that this release of liability extends to any and all claims arising out of or connected to my participation in fitness training programs, whether on or off premises, including transportation to or from training locations, use of facilities, equipment, or any ancillary services provided.

 

By signing below, I certify that I have read this document carefully, fully understand its contents, and voluntarily agree to its terms. I understand that by signing, I am giving up substantial legal rights, including the right to sue, and I do so knowingly and voluntarily.
