Guernsey Together Festival – Vendor Terms & Conditions
By submitting a booking form and making payment, you (the “Vendor”) agree to the following Terms & Conditions.
1) Booking, Payment & Pitch Allocation
A 50% deposit is required to secure a booking request.
Deposits are non-refundable under all circumstances.
Pitches are not allocated or confirmed until all of the following have been received: full payment, a completed booking form, a valid Public Liability Insurance certificate, and email confirmation of your booking from Guernsey Together Festival (GTF) HQ.
Payment in full must be made before the event by the deadline stated on your invoice/booking confirmation. Failure to pay in full by the deadline may result in your booking being cancelled and your deposit retained.
2) Cancellation Policy
If the Vendor cancels more than four weeks before the event date: no refund of the 50% deposit will be made. Any additional monies paid may be refunded at the Promoter’s discretion, less any non-recoverable costs already incurred.
If the Vendor cancels within four weeks of the event date: no refunds will be given and all monies paid will be forfeited.
Cancellations must be made in writing (email is acceptable). The effective cancellation date is the date GTF receives your written notice.
GTF reserves the right to re-sell or reallocate a cancelled pitch.
3) Compliance, Standards & Stall Safety
Vendors must comply with all appropriate Health & Safety and Trading Standards regulations.
Vendors must ensure that any temporary fixtures and fittings are in good repair and fit for commercial use.
Stalls may not be built higher than 3 metres from floor level without the written permission of the Promoter.
Should Event Staff have concerns about the stability or safety of any fixture or fitting, Event Management will ask you to modify or remove any potentially dangerous items.
Any tables on display must be covered by cloth from the tabletop to the floor.
4) Music & Conduct
Vendors must obtain the consent of Event Management for the playing of any musical instrument or recording at the event.
Please remember you represent your business and the event. Demonstrate good judgement in your daytime consumption of alcohol. You may be asked to leave if you pose a risk to yourself and others.
Vendors can always expect friendly and professional service from our staff and to be treated with respect and courtesy. Abuse of our staff and/or fellow vendors at any time during or between events will result in a Vendor being asked to leave or to have their booking cancelled without refund, and permanent exclusion from the event. We operate a zero-tolerance policy on this issue.
5) Glass, Packaging & Sustainability Policy
Vendors must not sell anything that comes in glass bottles. Should a Vendor wish to sell anything from glass it must be poured into a plastic cup and the glass disposed of safely.
We ask vendors to use recyclable materials where possible. Polystyrene and non-recyclable containers will not be accepted.
6) Waste & Cleanliness
The Vendor will be responsible for removal of any waste produced behind its stall. Any rubbish left by vendors will incur a fee of £25 per leftover item that needs to be disposed of (this does not include rubbish dropped around the festival site from your trading point).
7) Liability of the Parties
Guernsey Together Festival is fully aware that the success of its vendors and their financial well-being is of paramount interest to its continued success and will pursue appropriate promotional activities to achieve this end. As with any event, Guernsey Together Festival cannot guarantee visitor numbers, but they will do their utmost to ensure that vendors have a successful event.
Whilst Guernsey Together Festival takes every effort to ensure that vendors’ details are correct in promotional material for the event, Guernsey Together Festival cannot accept responsibility for any errors either printed therein or in online listings. Guernsey Together Festival shall have no liability to vendors for any claims resulting from such errors.
Guernsey Together Festival will furthermore take public liability insurance for its venues. Every Vendor shall participate in the event entirely at their own risk in every respect and shall absolve Guernsey Together Festival from responsibility for such risks, including personal injury, loss, or damage to property, whether caused by fire, theft, inclement weather, interruption of power, defect in equipment/building, or failure of subcontractors or agents to perform.
8) Required Documentation (Mandatory)
In signing the booking form and making the appropriate payment you agree to provide in-date Public Liability Insurance, Risk Assessments and Proof of Environmental Health Rating (where you are making or selling food). Failure to provide these prior to the event may result in you being denied entry to the event ground with no refund of your pitch fee.
In addition to this you also agree to comply with all relevant Guernsey Health & Safety, Environmental Health, and Fire regulations.
9) Agreement, Receipts & Amendments
When booking at the event, the signature of the Promoter’s representative on the Vendor Booking Form is an acknowledgement of monies paid, not a contract or agreement.
The Vendor will be given the bottom copy of the Booking Form as their receipt.
Any agreements entered by the Vendor with external contractors or suppliers at the event are the responsibility of the Vendor, and the Promoter cannot accept liability for claims resulting from the failure of any contractors or suppliers to deliver goods or services.
Vendors may not supplement, amend, or modify this Agreement unless it is in writing and signed by both a Guernsey Together Festival representative and the Vendor. Agreements not signed by Guernsey Together Festival will not be binding.
Guernsey Together Festival reserves the right to amend these Terms & Conditions at any time.
10) Vehicles, Parking, Access & Site Rules
Once you have entered the grounds of the festival, we will be unable to escort any vehicles out of the festival until the festival has closed. Vehicles will not be able to be moved until after the event, apart from instances of extreme circumstances that are agreed by the organisers. Vehciles parked within the trader parking area will be able to leave the site.
Parking is provided to assist vendors with holding extra stock and goods for their stall and to make setting up and packing down easier as well as allowing you to leave earlier should you wish to do so.
Each vendor may reserve up to 2 parking spaces at £5 per car. Each vehicle will have an allocated numbered space and you must park in your allocated space. Additional parking may be requested if needed and will be subject to availability and approval by the organisers.
All vendor vehicles must be parked by 12:00 noon.
When moving vehicles to pitches for set up and pack down, vehicles must use hazard lights and must not exceed a speed limit of 5 mph.
All keys must be removed from vehicles whilst parked and vehicles must be locked at all times.
No vehicles are to park within 6 metres (18 feet) of any tents which have public access (no exceptions at all). If a vehicle is left in an area which may cause a Health & Safety risk and no owner can be found, it will be removed at the owner’s expense.
11) Vendor Tickets
You will receive a set number of vendor wristbands depending on your pitch size. Additional tickets may need to be purchased.
12) Overnight & Security
Our site is manned by security overnight. Vendors cannot stay on site overnight without authorisation of festival organisers.
We advise that you do not leave any stock or cash on site overnight. The site will be manned overnight but Guernsey Together Festival and its staff hold no liability to any lost, stolen or damaged equipment left on site.
13) Set Up
We ask that all traders have set up their stalls or pitches by Friday 12th June. You will also have the option to bring your pitches to site on the evening of Thursday 11th June if you wish.
We do however advise that you do not leave any stock or cash on site overnight. The site will be manned overnight but Guernsey Together Festival and its staff hold no liability to any lost, stolen or damaged equipment left on site.
No vehicles are to park within 6 metres (18 feet) of any tents which have public access (no exceptions at all). If a vehicle is left in an area which may cause a Health & Safety risk and no owner can be found, it will be removed at the owner’s expense.
14) Pack Down
Pack down will take place after the event. Vendor vehicles cannot be moved until after the event has closed (except in extreme circumstances agreed by the organisers).
Guernsey Together Festival and its staff hold no liability to any lost or damaged equipment left on site overnight. We advise taking any cash or stock home with you if you do choose to leave any vehicle or equipment overnight.
